承运人责任限额之货币计算单位研究

国际货物运输公约一般都规定承运人享有责任限制,但在国际统一立法水平较高的海运和空运领域,承运人责任限额及其货币计算单位并不统一.就责任限额水平问题,不仅《鹿特丹规则》制定时存在争议,中国也有观点认为《维斯比规则》提高了《海牙规则》的责任限额水平.通过对英镑、法郎和特别提款权在空运和海运国际立法中的梳理、比较和实证分析,得出三种货币计算单位各有特点,具有一定历史合理性,不同货币计算单位下的责任限额在不同法律语境下不能简单直接比较,确定适当的责任限额水平要考虑诸多其他因素.     

Elite defection and grassroots democracy under competitive authoritarianism: evidence from Burkina Faso

One determinant of the success or failure of political revolutions is whether there is a split among the ruling elites. Elite defections in a competitive authoritarian regime can tip the balance in favour of regime change and democratization. This article examines when and why elites defect through the case of Burkina Faso. In October 2014, President Blaise Compaoré of Burkina Faso was forced to step down after 27 years in power and multiple term limits contraventions. We propose a new theory linking growth in democratic attitudes at the grassroots to elite defection from hegemonic parties. We argue that a broad increase in popular democratic attitudes can both decrease the costs and increase the benefits of elite defection, creating conditions that enable elites to rescind their loyalty to the regime. We support this argument with interviews with ruling-party defectors in Burkina Faso and two rounds of Afrobarometer survey data. Our findings demonstrate that democratic attitudes can grow under competitive authoritarian regimes, and that these citizen attitudes can impact regime change by increasing the likelihood of elite defection.     

Corporate Governance of Nonprofit Organizations: Cooperation and Control

Abstract

This article explores the limits of institutional economics regarding the cooperation of boards of directors and executive directors of nonprofit organizations. The normative separation of power between these central actors resulting especially from arguments derived from institutional economics is being reflected using the analytical approach from the resource-based view and empirical evidence based upon group and motivational theory. After analyzing the board’s role and the individual board member’s role within a nonprofit organization, the paper explores the limits to decision-making within governing bodies. The paper shows why a unitary board can improve the quality of decision-making within nonprofit organizations by raising the incentives for the executive director to act as desired. The paper also explores the impact of trust and different types of control upon the key actors within the governance process in order to derive the suitable form of control from that analysis.

在城中村融入城市的过程中，城中村村民无论在生产、生活、行为方式上，还是在精神文化生活上，都发生了巨大的变化。村民的市民化转型造成了其不同社会角色的冲突和在许多方面的不适应。为正确引导城中村村民的市民化转型，必须积极转变政府服务思路与工作方式，进一步推动城乡二元体制改革，大力加强面向村民的文化技能培训教育等项工作。
