Inmigrantes laborales y flujo en tránsito en la Frontera Sur de México: dos manifestaciones del proceso y una política migratoria

This text presents a characterization of Guatemalan labor immigration into Mexico, its historical perspective and processes of change in relation to new places of destination, crossings and labor insertions. It also sets out the most fundamental traits of migrants who cross Mexican territory when in transit from Central America, new crossing trajectories and social costs in terms of human rights, within a framework of greater social vulnerability. It analyzes the role that the Mexican state has played in relation to the establishment of a new migration policy set forth in the last two administrations (2001–2012) by the Partido Acción Nacional (National Action Party), institutional and legislative arrandos gements, progress and unresolved matters with respect to the proclamation of human and labor rights. It is concluded that even though unprecedented progress has been made in terms of immigration regulations, these policies still have serious shortcomings with regards to Central American immigration into Mexico, be it labor immigration or migrants in transit. This migration has taken on new forms and has registered qualitative and quantitative changes in crossing, in an environment of greater risk in Mexican territory.     

日本社会教育的概念研究

明治维新后,伴随着近代学校教育制度的诞生,日本的社会教育也应运而生。本研究不仅考证了社会教育在日本的由来,确认了社会教育乃日本明治以后出现的特有的教育形态;并从教化型、民主型、终身型等三方面厘清了日本不同历史时期学者对社会教育的多元界定;而且对日本的社会教育和社会事业、社会政策、国家教育、国民教育、家庭教育、学校教育、终身教育、终身学习、成人教育、社区教育等相关概念的区别与联系进行了辨析。在此基础上,归纳了日本社会教育概念的五个特征,即丰富多样性、暧昧模糊性、服务主体性、法律健全性、实践追求性等。     

The limits of agency: Emily Hobhouse’s international activism and the politics of suffering

Abstract

This article pieces together the activism of the British welfare worker and feminist-pacifist Emily Hobhouse (1860–1926) during two largely unrecorded episodes of transnational activism: firstly, her ministry of Cornish miners in Virginia, Minnesota, in the United States; and secondly, her interventions during the period of reconstruction following the South African War (1899–1902). The article endeavors to contextualize Hobhouse’s activism and offer a broader understanding of the limitations and restraints on her actions. Ultimately, her activism required a platform that was in the gift of political actors and establishment figures, and dependent on fluctuations within specific political and bureaucratic situations. Based on close inspection of undocumented material in both South African and British archives, the article investigates Hobhouse’s repertoire of missionary and philanthropic roles within a wider context of humanitarian politics. It demonstrates how women’s activism and their behind-the-scenes politicking informed political decision-making in modern imperial and international affairs.     

Acute and Everyday Violence in Sri Lanka

Police torture in Sri Lanka has been subject to extensive investigation and condemnation but remains a widespread and seemingly entrenched practice. Seeking to understand the resistance of such practices to existing interventions, this article locates the police’s use of torture within a broader geography of social violence in Sri Lanka. We discuss the findings of extensive fieldwork conducted in the north-west of Sri Lanka where we examined not only police behaviour and interactions between police and the broader community but also the social dynamics relationships more generally. One significant finding was that violence against certain types of people, including police use of torture against such people, is generally accepted, even as the police are broadly criticised in the community for their unethical and ineffective behaviour. Another significant finding was that the society is riven with social hierarchies and that patterns of domination are embedded in social, political and symbolic systems. We conclude that police torture needs to be understood against the background of broader cultural practices whereby social subjects are disciplined and policed to produce appropriate citizens and punish social boundary violations.

农民进城务工是农村剩余劳动力转移的主要渠道,是工业化、城市化和现代化的必然趋势,是全面建设小康社会的必由之路。在实践当中,我们要完善相关的劳动立法,加大劳动执法力度,及时解决劳动争议案件,加强法治宣传和教育,最大限度地保护农民工的合法权益,促进社会的和谐发展。     

宅基地“三权分置”的法律表达——以《德清办法》为主要分析样本

在落实宅基地\"三权分置\"的地方规范性文件中,既有资格权和使用权内涵与性质的疑惑,又有资格权与使用权分置事实、房屋使用权性质之困惑。宅基地\"三权分置\"实施路径的法律表达,如果解读为\"所有权+资格权(依宅基地分配请求权取得之宅基地使用权)+次级权利用益物权\",可能违背\"一物一权原则\"和\"房地一体原则\"。如果解读为\"所有权+资格权(主要是最先受让权和优先受让权)+不动产用益物权\",不仅可以避免第一种解读的不足,还可以使成员权性质的资格权包括最先受让权,亦可替代实现第一种解读中保留宅基地使用权和收回权的居住保障功能并产生更大制度优势。第二种解读对住房财产权跨集体转让模式和宅基地上共建共享模式均普遍适用。因此,宜以第二种解读为路径,促进地方实践和法典中宅基地\"三权分置\"法律表达的规则完善。     

我国高校学生权利探讨

在我国高等教育实行成本补偿政策后，高校内部管理行为开始进入司法审查的视野。坚持依法治校、依法执教、完善高校管理、保护学生合法权利已成为社会关注的热点，也成为高校亟待解决的问题。高校学生的权利应包括：公法上的权利和私法上的权利。
