落实《老年法》之政策支持探究简

新的《老年人权益保障法》是一部关系数以亿计的社会老年成员在保证晚年阶段生活质量的重要法律，但如果没有各级政府制定和完善的政策支持，该法律的相关条款则势必难以落到实处。因此，“精神赡养”、“就近居住”等条款，需要政府配套劳动、就业政策的支持；建立“长期护理保障”制度，政府需拿出符合中国国情的方案；构建新的养老服务体系，重点应完善养老机构的布局与建设；老年人宜居环境应不止于公共设施，还包括住宅设计、社区服务环境建设等；鼓励老年人“参与社会发展”，需要改革退休政策、防止就业歧视。

论治理“过度医疗”涉及的若干法律问题

“过度医疗”涉及多种因素，依法治理应是根本的途径。本文在界定“过度医疗”构成要件的基础上，探讨了所涉及的相关法律问题，包括法律规范的健全、患者权利的保护及新型医疗模式的构建等。     

The Universal Declaration of Human Rights at Seventy: Rejuvenate or Retire?*

This lecture marks the seventieth anniversary of the Universal Declaration of Human Rights (UDHR) with an analysis of the Declaration's contemporary relevance. It considers whether, in today's turbulent and fractured political environment in which human rights abuses remain widespread, the UDHR still has a role to play. A case is made that the UDHR was, in fact, written precisely for a moment like now. The lecture starts by considering the important legal impact of the UDHR, whilst acknowledging that the legal enforcement of human rights sometimes overshadows the emotions of care and empathy that lie at the heart of both the Declaration and the whole concept of human rights. It then emphasises the significant role the UDHR has played in giving individuals a voice to hold states accountable. Finally, it explores the UDHR's ethical and inspirational vision that helped to create a baseline of norms and standards aimed at promoting diversity, mutual respect and peace. For all these reasons, the UDHR most certainly needs to be rejuvenated rather than retired.     

Deaths While under Probation Supervision: What Role for Human Rights Legislation?

Article 3 of the Universal Declaration of Human Rights (UDHR) states that ‘everyone has the right to life’. This right is contained in all human rights treaties that developed from the UDHR, including the European Convention on Human Rights (ECHR). Yet, as we argue, the UK government is failing to protect this right when it comes to certain groups of people under probation supervision. To date, human rights legislation has failed adequately to protect these vulnerable individuals and to hold the state to account. This article explores the greater potential for using human rights legislation to ensure better accountability in this area.     

Recognition as if sovereigns? A procedural understanding of indigenous self-determination

In the last two decades we have witnessed a growing global acknowledgement of indigenous rights – manifested in the 2007 UN Declaration on the Rights of Indigenous Peoples – challenging the traditional nation-state-centred understanding of political rights and democracy. In this paper, the author argues that indigenous self-determination is to be understood as a way to level the balance of power between indigenous peoples and the nation-states in which they live. Without a solid legal foundation for indigenous peoples to define self-determination in their own languages and to negotiate the conditions of their relation with the nation-states on their own terms, the colonial past (and present) of violent conquest and domination might continue. Indigenous peoples' right to self-determination ought in this perspective to imply recognition of indigenous peoples as having a standing equal to nation-states, i.e. as if they were sovereigns. What self-determination means in political practice would thus be the outcome of negotiations between two (or more) equal political entities. In this way, the right to self-determination has to be interpreted procedurally rather than substantially.     

Ethical and legal consideration of prisoner's hunger strike in Serbia

Hunger strike of prisoners and detainees remains a major human rights and ethical issue for medical professionals. We are reporting on a case of a 48-year-old male sentenced prisoner, intravenous heroin user, who went on a hunger strike and died 15 days later. Throughout the fasting period, the prisoner, who was capable of decision making, refused any medical examination. Autopsy findings were not supporting prolonged starvation, while toxicology revealed benzodiazepines and opiates in blood and urine. Cause of death was given as "heroin intoxication" in keeping with detection of 6-MAM. Legal and ethical issues pertinent to medical examination and treatment of prisoners on hunger strike are explored in accordance with legislation and professional ethical standards in Serbia. A recommendation for the best autopsy practice in deaths following hunger strike has been made.     

对魏伊丝代际公平说的全面反思

为保护地球环境资源而创设的代际公平理论是建立在两个错误认识的基础上的,即把集合概念的人类视为类概念的人类和把地球环境资源财产化。假如没有后代人,人们也同样应该承担保护地球环境的义务。魏伊丝舍今世而求助于后代人及其权利,其原因在于权利时代所型塑出来的权利思维模式和路径依赖。虽然代际公平理论能够给我们提供观察和解决环境问题的时间视角,但它本身并不是什么新的法律理念,无法担负起指导现代环境法制建设和环境保护实践的重任。     

对农传播中的农民权益问题:基于受众本位论的分析

我国对农传播中农村居民的受众角色与地位一直是人们关注和探讨的问题。从受众本位论的角度来看,农村居民的受众角色获得及受众权利保障既具有可能性又具有必要性。在目前我国对农传播中农村居民受众角色缺席的背后,实际上是媒体责任和政府义务的双重缺位。承认且保障农村居民受众权利,本质上是对其公民权和公共物品选择权的尊重。实行多元治理与商业逻辑的协商与共谋,是确立农村居民受众地位和提高对农传播效果的必然之路。     

Co-Reach in IPR in New Media Workshop: CLSR co-hosts policy meeting on ISP Liability

The Co-Reach Workshop on ISP Liability on December 7, 2010 was organised by the Co-Reach IPR in New Media at the Herbert Smith Conference Center in London. The policy-making workshop was co-hosted by Computer Law and Security Review, as part of its aim to position itself at the forefront of policy discussion drawing upon the high quality scholarly contributions to the journal from leading experts around the world.
