土地的集体所有制与农村安全

土地集体所有制具有重要的社会功能,它为农户尤其是弱势农户提供了规避市场风险的手段,从而保持了中国农村的稳定和安全。然而,由于物权化的承包关系、政治权力对土地权利的干预以及基层组织自身的不作为,土地集体所有制的优势正在丧失。在这种条件下,土地制度必须从中国现代化实现的战略高度进行重新统筹和安排,避免制度本身的单一与僵硬,以给不同地区农户的土地承包留下一定的自主选择权和决定权。     

土地用途管制：悬在土地流转头上的达摩克利斯之剑——违反土地用途管制的土地流转纠纷的法律适用问题探究

土地用途管制制度是我国《土地管理法》确立的土地管理基本制度之一。土地流转是农村土地承包经营制度的一个方面,亦应遵从土地用途管制制度。合同内容违反土地用途管制的土地流转应认定为违反效力性强制规定而归于无效。合同履行中单方违反土地用途管制的为土地流转的违约情形和合同法定解除事由。违反土地用途管制的土地流转不仅会引起民事责任与行政责任的重合,而且两种责任在责任承担方式上亦存在重合之处,这时应优先适用行政责任。司法实践中宜对土地用途管制作适度的扩张解释。     

农村承包地调整制度的法规范分析

现行农村承包地调整制度主要集中体现在我国物权法、农村土地承包法、草原法及土地管理法中,同时还深受相关农地政策的影响。该制度既有保护农民土地承包经营权益的正面效应,同时也存在一定不足。应以尊重农民合法权益为价值目标,充分发挥农民的主体意识,进一步明晰土地承包经营权的享有主体;遵循财产权的基本原理和土地承包经营权的特性,完善土地承包经营权变动制度;在现行制度框架内构建多元化的调整模式,使承包地调整制度能够真正遵循物权理念进行构建。     

我国土地储备制度之完善

我国土地储备制度已在全国大部分市县得以建立,虽然土地储备制度的实施取得了一定成效,但作为新的土地供应方式,法律支撑条件还不完善。文章从具体的制度,包括土地利用规划制度,界定公共利益的范畴,政府优先购买权制度,对完善土地储备制度进行了探讨。     

北美城市规划决策对我国城市建设的启示——以加拿大城市和土地使用规划决策听证为视角

国外城市规划管理一般都比较注重社会参与和全民参与,并通过立法和机构设置保障全民监督的实施。加拿大行政决策公众参与听证被广泛用于公共管理事务以获取来自专家和公众的信息,对我国城市和土地使用规划不无启示。我国不可能完全模仿法制成熟国家的做法,但增加一些公众权利保障的立法规定和管理措施是非常必要的。     

Biofuel Investments in Sub‐Saharan Africa: A Review of the Early Legal and Institutional Framework in Zambia

Concerns about domestic energy security and global climate change mitigation have led the European Union, the United States, and others to introduce policies to enhance the use of biofuels in the transport sector fuel mix. While countries throughout the global South are positioning themselves to capture the economic benefits of this fuel transition, their capacity to do so is highly variable. This paper reviews the early evolution of the biofuel sector in Zambia to explore the extent to which the country is positioned to leverage future benefits of the emerging industry while forestalling negative social and environmental costs. In doing so, it sheds light on an under‐researched dimension of the ongoing debate over large‐scale land acquisitions and foreign investment: the role of legal and institutional frameworks in host countries in shaping outcomes. The analysis draws on the following: policy documents; stakeholder interviews with government departments, investors, and civil society stakeholders; and published and reported data on investments. Findings suggest that while existing and incipient policies and legislation provide an important foundation for attracting investors and achieving diverse sector aims, a number of gaps remain that are likely to hinder efforts to leverage meaningful benefits while minimizing negative impacts.     

Study of an economic issue as a possible indicator of suicide risk: a discussion of stock prices and suicide

There were more than 30,000 suicides in 1998 in Japan, and since then, the numbers have remained high. In 2009, the number of suicides per a day was c. 90. This phenomenon constitutes a major social problem. One of the major reasons for the rapid increase in the number of suicides appears to be the worsening economic problems. It is therefore necessary to research the relationship between economic issues and suicide. In this study, we examined the relationship between the value of the Nikkei Stock Average and suicide rates in Japan. The value of the Nikkei Stock Average may be related to suicide among men. On the basis of the results, relevant researchers and organizations should understand the factors that relate to suicide to better carry out specific suicide prevention measures.

我国在加速推进农村现代化、城市化的同时，也引发了大量的土地征收补偿纠纷。这类纠纷不仅牵涉的主体众多而且关乎广大农民的切身利益，如若得不到及时有效地解决，将不利于农村乃至整个社会的稳定和发展。因此，现阶段确有必要切合农村土地征收补偿纠纷的特点认真思考如何完善其救济机制。既要正确评判和解、民间调解及行政救济对解决此类纠纷所起的作用，亦有必要分析研讨，促进仲裁及诉讼在解决这类纠纷方面功能的发挥。
