司法责任制改革取消了庭长审批权,实现了权力下沉至一线法官的目的,但同时庭长却面临着不愿管、不善管的困境。其直接原因在于庭长权责匹配冲突,即权力小、责任大。具体表现为多重角色赋予其所承担的政治责任、基于法院目标管理带来的行政责任以及法官身份回归而需承担的法律责任,但并未赋予相应的权力。造成权责匹配冲突的根源在于在去行政化过程中对权力关系的简单化处理,导致法院外部压力型任务注入与内部平权式治理之间的矛盾;法院功能的超载化,扩充了法院管理的范围。权责冲突带来了负面效应,包括权力的非正式运作,不善管;逆向激励,痕迹化监督与策略性监督,不愿管。要改变这种状态需要从制度保障、动力机制、信息基础、关键因素四个方面入手。  相似文献

The regulations of cross-border data flows is a growing challenge for the international community. International trade agreements, however, appear to be pioneering legal methods to cope, as they have grappled with this issue since the 1990s. The World Trade Organization (WTO) rules system offers a partial solution under the General Agreement on Trade in Services (GATS), which covers aspects related to cross-border data flows. The Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) and the United States-Mexico-Canada Agreement (USMCA) have also been perceived to provide forward-looking resolutions. In this context, this article analyzes why a resolution to this issue may be illusory. While they regulate cross-border data flows in various ways, the structure and wording of exception articles of both the CPTPP and USMCA have the potential to pose significant challenges to the international legal system. The new system, attempting to weigh societal values and economic development, is imbalanced, often valuing free trade more than individual online privacy and cybersecurity. Furthermore, the inclusion of poison-pill clauses is, by nature, antithetical to cooperation. Thus, for the international community generally, and China in particular, cross-border data flows would best be regulated under the WTO-centered multilateral trade law system.  相似文献

我国《物权法》没有明确规定空域所有权,但是应当解释为承认了空域所有权的存在。现行法律没有认可空域使用权的物权属性,只能认为空域使用权是行政许可利益。但行政许可机制的运行与效率价值旨趣相悖,其产生的产权不确定性不利于空域高效利用。市场机制和私权制度的引入是改革的重要方向。国家所有权具有私权属性,空域所有权也不例外,而空域使用权是空域所有权基于权能分离产生的权利,只能具有私权属性。这种定性在价值上也具有合理性,这主要是基于市场机制对空域利用效率的保障作用以及私权属性对市场机制顺畅运作的支撑地位。在私权体系中,将空域使用权规定为物权最为妥当。  相似文献

乡村振兴要以制度建设为基础,以完善农地"三权分置"制度为契机,以城乡融合体制机制创新为支撑,以"活业、活人、活村"为路径。土地制度是实现乡村振兴的根本制度,三权分置是搞活乡村经济的制度设计,乡村治理是实现乡村振兴战略的总抓手。乡村振兴制度建设存在的主要问题是:"城乡二元结构"是农民获取城市权利的障碍,土地"二元制度"是导致乡村失去发展权的根源,农村"宅基地制度"是制约农民发展权的瓶颈。乡村振兴制度建设的基本路径是:为乡村振兴建设提供规划安排,为乡村振兴用地提供制度支撑,为乡村振兴资金提供政府投入保障,为乡村振兴社会稳定提供安全秩序。  相似文献

现代城市因人口聚居、建筑密集、活动复杂而日益成为风险中心,呈现出复合性、联动性、叠加性、扩散性、隐蔽性增大等整体性风险。本文基于韧性视角,引入"韧性城市"概念,剖析了现代城市整体性风险防控实践的六大盲点和弊端,并分别从空间、时间和层级三个维度提出了韧性城市风险治理的范式,梳理出"都市群-城镇带-生活圈"防范风险扩散、"灾前预警-灾中应急-灾后恢复"阻遏风险延递、"宏观搭台-中观定标-微观落地"化解风险叠加的具体策略。  相似文献

Taking into consideration the eugenic nature and perspective of high-performance human resource management functions on organizational effectiveness, the authors examined managerial and employee level of recruitment and selection on operational performance with emphasis on human capital and three indicators of organizational commitment (affective, normative, and continuous) as mediators. Questionnaires totaling 282, 122 for managerial level and 160 for employee level, were administered. A multilevel analysis of data were conducted on a selected number of Ghanaian NGOs using Statistical Package for Social Sciences (SPSS). The study revealed that recruitment and selection ideally leads to improved operational performance, however, this affiliation can be enhanced through the inescapable role of human capital and the three commitment indicators (affective, normative, and continuous). It was also exposed that effective recruitment and selection leads to a desirable employee’s level of affective, normative and continuous commitment, which also have greater influence on the operational performance. The study is thus considered very significant contextual support to existing literature and practitioners since not much of such work has been done in the Ghanaian context. Therefore, the current study implicates recruitment and selection, human capital, and the three commitment levels as a core value-creating ability that drives non-governmental organizations performance.  相似文献

Using interview and survey data, we argue there are three types of places in the rural United States, and that their social and economic conditions help us understand emerging political trends, including the rural support for Donald Trump. More rural votes were cast for the Republican presidential candidate in 2016 than in other recent elections, yet shifts to Republican votes were greatest in places undergoing the most significant economic transitions. Work in rural communities has been a source of pride and cultural identity for people as well as places, but many feel the new economy is not working for them.  相似文献

Concerns over the unethical conduct of leaders and public officials have led to the renaissance of interest in public service ethics and values. Although national and organizational systems and structures have been instituted to either eradicate or ameliorate unethical behaviours in the public service of countries, the practice still persists with devastating consequences. As one way forward, spirituality has been touted as having the potential of stimulating the moral thoughts of individuals who are dealing with ethical issues, thereby reducing unethical behaviour and generating positive organizational behaviour. Drawing from the perspectives of developing and transitional countries, this special issue empirically examines the extent to which ethics, values and spirituality can reduce unethical behaviours.  相似文献

We conduct the first long-term experimental evaluation of a need-based financial aid program, the privately funded Wisconsin Scholars Grant. Over multiple cohorts, the program failed to increase degree completion and graduate school enrollment up to 10 years after matriculation. The program did reduce time-to-degree for some students and modestly increased the number of STEM degrees earned. The lack of robust effects raises important questions about the conditions necessary for financial aid to benefit students.  相似文献

改革开放以来,我国机关事务管理变革工作经历了初步探索、全面改革和深化改革三个时期。我国机关事务管理经不断改革已经取得很大进步,但仍面临管理职能分散化、部门利益分割化等碎片化困境,因此我们应树立机关事务整体性治理理念,构建跨部门协同的集中统一治理体系。调研湖北省、山西省、江西省等地机关事务集中统一管理实践发现,集中统一管理具有优势也面临诸多挑战。未来机关事务管理应增强保障与服务职能,打造服务型组织;提高管理与运营能力,打造高效型组织;健全监督与问责机制,打造责任型组织。  相似文献
