论常识主义刑法观

刑法学发展至今貌似精巧,但理论构造似乎离生活常识越来越远,使得理论与公众的规范感觉、认同感觉之间的分歧很大。刑法研究无论走何种道路,可能都面临需要重新思考的问题:在我们的生活当中,哪些是常识性的东西,亦或哪些是生活经验上特别值得重视的东西。刑法学回归常识主义,要重视两个问题:一方面,刑法本身对社会有什么益处?或者刑法的社会功能究竟是什么?另一方面,刑法学回归常识主义,是否有可能性?亦即使刑法学和生活常识接近,或者尽量回归生活常识、尽量让公众能够去认同是否有可能?如果有可能,则其出发点或者基点是什么?常识主义刑法观对于欧陆刑法学会给予特别关注,强调跨文化的刑法趋同性,肯定了通过刑法保护社会中通行的规范关系的重要性。     

尼采透视主义中的生命哲学和实证主义精神

尼采将自己的认识论定义为透视主义,透视主义将一切放到生命的体验中来考察,透视主义是一种对生命的直观,直观中艺术、科学、价值一体。透视主义用一句简单的话表达就是：没有真理,只有解释。这个论断隐含着尼采的实证主义立场,实证主义认为认识只是一种功能,真理没有不变的形而上学的本质,存在的只是我们对事实的价值设定透视主义与对主体性的反思相连,尼采认为,主体的观念本身就是人为的虚构。

随着我国改革开放的不断深入,人们的物质生活水平得到较大提高,然而,人的精神生活问题却日益凸显。精神生活是人类所特有的,随着社会的实践活动产生并发展。精神生活作为人类特有的活动,有其独特的内涵,具有超越性、历史性和多样性、社会性、阶级性等特点,有其运动和发展的规律性。了解和把握精神生活的特点及运动规律对于我们解决人的精神生活问题,建设人的健康精神生活,构建社会主义和谐社会有着十分重要的现实意义。

新媒体作为一种全新的社会力量,已逐步普及并渗透到社会生活的各个方面,深刻地改变着社会面貌,影响着人们的思维观念和价值取向。青少年是新媒体技术使用最为广泛、最为活跃的群体,探析新媒体对青少年的影响,应该同时考虑如何控制新媒体对青少年的负面影响。     

《命》的主题拆解与女性生命体认

日本当代女作家柳美里于2000年完成的《命》,是一篇备受瞩目和欢迎的作品。作品以私小说的笔法,诠释了爱情、婚姻并不是女性生活的全部,爱情困境往往是女人的魅宝。小说深入思考了生命的本质,在令人感伤的调子里,触及了生命意义、价值和作家的个性体认。自述了她从怀孕到成为未婚妈妈的艰难,和面对以前的情人、自己的恩师"东"生命即将完结时的无奈。强烈地表现了作家渴望通过文字探寻生命的意义的主观倾向,即便是濒临迷茫与虚无之境也在所不辞。从而为柳美里小说风格的形成,平添了一条韵味独到的风景线。     

间接语言与梅洛-庞蒂的艺术观

本文以法国著名哲学家,知觉现象学的创始人莫里斯·梅洛-庞蒂晚年未完成的著作《世界的散文》中专论艺术的一节——＂间接语言＂——为研究对象,通过阅读文本提炼大师梅洛-庞蒂的艺术观。在梅洛-庞蒂的眼里,艺术是实在性的展开,是存在者存在状态的彰显,是对生活世界的知觉显现的瞬间捕捉。对于＂生活世界＂的认识,以及艺术如何＂表达＂生活世界的观点,他迈入了前人从未涉足的领域。     

A research–note on the slave registers of Suriname, 1830–1865

In 1826, the Dutch government decreed that slave owners in the Dutch colony of Suriname had to register all enslaved persons in their possession and all changes in ownership. Registration was done in a central register until the abolition of slavery in Suriname in 1863. The registers give a continuous overview of the enslaved population in Suriname stretching for more than three decades. The level of information on the enslaved population of Suriname make the slave registers into an exceptional source for the study of slavery. As part of the project Make the Surinamese slave registers public a database of these registers was created. The database is the first step to create a Historical Database of Suriname (HDS) covering a substantial part of the population of Suriname between 1830 and 1950.     

A Life Table Approach to Estimating Disproportionate Minority Contact in the Juvenile Justice System

Disproportionate minority contact (DMC) in the U.S. juvenile justice system persists despite substantial efforts to reduce it. The juvenile justice system is comprised of a series of interconnected stages, yet few studies to-date use methods to measure DMC that take the cascading nature of the decision-making process into account. Our study addresses this gap by applying life table analysis to identify the cumulative nature of DMC across multiple stages of the juvenile justice system using data from 2008 to 2010 in Georgia that include white, black, and Hispanic/Latino youth. We then compare these state-level results to life tables from a national sample of black youth and a subnational sample of Hispanic/Latino youth. Our findings show that arrest/referral accounts for the greatest proportion of total system-wide DMC for black youth, but most of the total DMC for Hispanic/Latino youth results from later stages.     

The Time Path of Legislative Party Switching and the Dynamics of Political Competition: The Italian Case (1996–2011)

Political competition is more realistically described as a dynamic process rather than as a series of static stages in which parties compete over policy and government formation. This paper focuses on legislative party switching as the main manifestation of this endogenously evolving process, linking individual switching behaviour to policy and office incentives that are assumed to evolve throughout the life of the entire legislature. Using a new data set tracking the timing of MPs’ changes in party affiliations between 1996 and 2011 in Italy, it is found that switching is mainly motivated by policy reasons and that it is more likely during government formation periods and budget negotiations. These results are a consequence of the interplay between MPs’ ambition and the alternation of key phases in the legislative cycle.     

Migrant life stories and the Web: the experience of having your life story made public

The life stories of migrants are increasingly being told, as part of the work of cultural organizations, and websites are well suited to making such life story projects accessible to the public. However, by using the lives of real people as raw material in a public forum, Web projects raise important questions about the terms on which participants are given a voice. This article focuses on a Danish website which depicts the life stories of migrant men through written texts, audio clips, and photographs. It presents a detailed analysis of the life story of one young man from a Muslim background who has openly declared himself an atheist. The article examines his experience of having this somewhat sensitive story made public. The religious aspect inevitably positioned his story in relation to broader political debates about Muslims in Denmark. Since migrants' stories often touch on highly politicized issues, it is crucial that their stories are not co-opted by societal discourses which they do not themselves support.
