公民权益保障建设研究

城市化进程的急速推进,打破了传统社会的利益格局,社会大转型引发了众多的社会问题,导致涉诉信访问题层出不穷。研究和解决公民合理的利益诉求表达、协调各方利益、畅通公民权益保障渠道建设尤为重要。本文从大连地区社会不稳定因素产生的原因入手,针对当前公民权益保障中存在的问题提出领导干部应提高认识,转变观念,树立公民权利至上理念,多方拓展保障公民合法权益的途径,使维权维稳工作健康有序。     

金融全球化视野下的统一监管模式检讨

为了提高金融监管的有效性,越来越多的国家开始采用统一监管的模式,或者通过建立职责覆盖全部金融领域的统一监管机构,或者将两个主要的监管机构合并。统一监管模式在提高监管有效性、对金融集团实施监管、降低监管成本方面具有制度优势,但在监管权力和机构整合问题上存在困难,这需要结合一国的实际情况制定监管改革方案。     

Managing Social Risk in China Local Administration: An Examination of SSRA Initiative

Social Stability Risk Assessment (SSRA) sponsored by the local administration is perceived as a socially defined risk-coping initiative since it became mandatory in China. This article observes and unravels SSRA practices by selecting Xuzhou municipality as a sample case. Findings show that local SSRA is operated by the tridimensional mechanism and antecedents of its effectiveness in enforcement are linked with multiple elements of administrative supports. The findings contribute to a full understanding of SSRA in mainland China where there is no electoral democratic regime, and provide implications for developing countries alike. Some recommendations are proposed as a potential driver of these results.     

构建我国金融控股公司监管立法框架的设想

在我国现实经济生活中,各类金融控股公司在法律的间隙中生存发展,这种情况从某种程度上来说已经处于脱法的状态,蕴含着极大的风险。我国要从法理角度加强金融控股公司的监管,结合现阶段金融控股公司监管存在的问题,探索适合我国国情的立法模式,构建我国金融控股公司的立法框架,完善金融立法上的空白,推动我国金融业依法经营监管和法治建设向纵深发展。     

嵌入式监督:探索权力监督有效实现新模式

纪检监察派驻监督是党和国家监督体系的重要组成部分,也是实现国家治理现代化的必要环节。在监督范式转换、党纪法规调适、反腐倡廉要求和监督探索实践的共同驱动下,部分地区将嵌入性理念、技术和制度引入权力监督领域,创新形成了“党的领导、权力制约、过程监督、信息沟通和制度规范”的嵌入式监督模式。这一模式借助理念嵌入、组织嵌入、技术嵌入和制度嵌入系统建构路径,形成了“权威性、精准化、全程性、常态化和制度化”的权力监督机制,整体推进监督制度优势转化为治理效能。嵌入式监督的实践深化还存在自主性、适应性和融入性困境。纪检监察派驻机构还须提升角色定位能力、目标执行能力和融合监督能力,以此实现权力监督长效化与国家治理现代化。     

Lost in space? the role of place in the delivery of social welfare law advice over the telephone and face-to-face

ABSTRACT

Advice that is provided exclusively over the telephone has been promoted by government as more convenient and accessible than face-to-face appointments. The resulting push towards telephone-only provision, as implemented by the Legal Aid, Sentencing and Punishment of Offenders Act 2012, challenges the long history of association between social welfare law advice and local delivery within disadvantaged communities. This article reports on qualitative research comparing telephone and face-to-face advice which uncovers the continuing relevance of place in the dynamics and mechanics of social welfare law provision. Familiarity with the geographical location, knowledge of local policies and procedures, relationships with opponents and allies, and an understanding of the ‘local legal culture’ mean that face-to-face advisers are often able to conduct their legal casework more effectively. Conversely, local knowledge is unlikely to be available to Community Legal Advice telephone advisers. This research suggests that, in addition, telephone-only advisers may be developing a more narrow understanding of the essential qualities of casework. These findings are particularly significant in view of the likely future expansion of remote methods of delivery in legal aid work.     

State transformation and cross-border regionalism in Indonesia’s periphery: contesting the centre

Abstract

This article examines how the decentralisation and fragmentation of the Indonesian state and resultant central–local dynamics affect cross-border regionalism in Indonesia’s periphery. It argues that cross-border regionalism projects are best understood as sites for scalar contestation over regulatory control between central and local government. Moreover, scalar contestation around cross-border regional projects is characterised by the struggles to control relationships with transnational capital between elites operating at different tiers of the state. When elites at different scales have conflicting interests and strategies, this can cause policy incoherence, inhibiting the development of cross-border regionalism. Conversely, when they align, and intersect with the interests of transnational business, cross-border regionalism can succeed. To illustrate the argument, this article utilises the comparative case studies of the Batam free trade zone and West Kalimantan–Sarawak cross-border cooperation.     

Secondary traumatic stress and vicarious traumatization in child welfare professionals in Serbia

Child welfare professionals in diverse positions are exposed to a variety of traumatic events including family violence and child abuse and neglect. This secondary exposure puts child welfare workers at the risk of experiencing Secondary Traumatic Stress (STS) and Vicarious Traumatization (VT). For the first time in Serbia, this study quantitatively investigates whether STS and VT are present in child welfare professionals employed in the social welfare centers, foster care and adoption agencies, residential care programs, and shelters for children and youth. It attempts to identify whether the type of service, time exposure to clients, and supervision function as risk or protective factors for negative outcomes. A convenience sample comprised of 135 child welfare professionals completed a series of self-reported measures. Findings indicate that VT and STS are present in this population. Differences in the presence of STS and VT were found according to the types of services offered and length of exposure. Contrary to expectations, supervision was not a protective factor with regards to STS and VT in this population.     

监狱企业财务管理存在的问题与对策

随着监狱体制改革的实施，监狱企业开始成为真正的经营和理财主体，但目前监狱企业财务管理还不能很好地适应体制改革的要求。因此，必须认真分析监狱企业财务管理中存在的问题，研究强化监狱企业财务管理的对策，从而推动监狱事业不断向前发展。

自20世纪80年代中期至今,杜芳琴先生在中国古代妇女/性别史、妇女学理论的本土探索与学科建设等领域进行了广泛深入的研究,取得了丰硕成果。考察杜芳琴先生的学术贡献,不仅可以窥见中国女性学者从事学术研究的艰辛、执着与收获,也可窥探中国大陆妇女/性别史研究发展的历程,对于总结妇女/性别史研究中的利弊得失、展望妇女/性别史研究的未来也不无裨益。
