关于废除我国有关职务犯罪死刑的思考——兼议《中华人民共和国刑法修正案(八)》

文章在结合《中华人民共和国刑法修正案(八)》[3]分析我国职务犯罪的现实情况基础上,指出了废除职务犯罪死刑正当性理由。同时,从主客观两方面对目前我国废除有关职务犯罪死刑存在的现实困境进行剖析。最后,针对我国废除职务犯罪死刑提出构想和建议。

随着中国经济的高速发展,中国的职业安全健康态势也日趋紧张,工伤事故及死亡人数、职业疾病情况以及过劳死现象已经成为日益严重的社会问题,并严重影响了劳动关系的健康运行.这背后既有劳动力成本导向的发展路径问题,也有劳动执法虚弱的问题,同时也存在着诸多制度困境和弊端.因此,唯有推动产业升级和技术改造以及发挥工会作用等手段才能有效治理中国的职业安全健康问题.

本文提出安保专业职业能力包括社会基础能力、职业基本能力和专业核心能力三大专向部分,并分别对各专向能力所需的具体内容和重要性进行了调查统计分析。通过对专家组与新手组的比较,进一步明确了安保专业职业能力的构成,从而为学习领域的教学任务模块设计提供借鉴。     

深挖职务犯罪工作机制研究——以北京市区县院反贪局办案实践为视角

北京市检察机关自侦部门在查办职务犯罪工作方面有着突出的成绩。随着经济社会发展,职务犯罪侦查迎来了新的形势,面临着新的难题。以北京市各区县院反贪局办案实践为依托,总结近五年来反贪案件的特点,分析变化的原因,对工作方法和工作机制进行探索性的分析。

Planned Complex Occupation‐related Suicide by Captive‐bolt Gunshot and Hanging*

Abstract: Planned complex suicides are committed by using two or more previously planned methods simultaneously to make sure that death will occur even if one method fails. Herein, we presented a case of occupation‐related planned complex suicide, committed by captive‐bolt gunshot and hanging. A 29‐year‐old man, who worked as a butcher, was found dead in the stable, hanging by the neck with a captive‐bolt gun embedded in the forehead region of his head. The hanging was complete. Along the bolt canal were bone fragments, and at the end of the path was the punched‐out fragment of the skin and soft tissue. There were no fractures of the hyoid bone and laryngeal cartilages, and a superficial hemorrhage was present in the right sternocleidomastoid muscle. Our case underlines the utility of forensic autopsy and death scene investigation in reconstructing the mechanism of death, as well as the dynamics of the event.     

新生代农民工社会适应研究——基于浙江省杭州市的调查

当前,新生代农民工逐渐成为流动人口群体的主力,其社会适应程度不仅关系到农民工个体的生存质量和发展可能,也关系到城乡居民之间的关系,甚至还牵涉到整个社会和谐与稳定程度。本研究对在浙江省杭州市务工的新生代农民工的社会适应展开了调查。调查发现新生代农民工在心理认同上有一定的趋同性,社会交往上呈现封闭性,而经济生存上有着明显的脆弱性。增强新生代农民工社会适应要积极推进户籍改革,要继续增强新生代农民工的心理适应,要逐步加强新生代农民工的社会交往,要努力促进新生代农民工的经济适应。     

论量刑公正的一般标准

在近代刑法学术史上,西方国家曾经围绕报应刑论与目的刑论的对立,就刑罚价值取向和量刑公正标准量刑进行过激烈的争论:报应刑论认为"刑罚轻重应当与罪行轻重相适应",目的刑论认为"刑罚轻重应当与人身危险性相适应"。最后在两者之间形成折中主义刑罚论,认为"表明行为社会危害性和行为人人身危险性事实情况都是影响刑罚轻重的因素",此说为多数学者所赞同并为多数国家刑事立法所采纳。根据现行刑法第五条规定,我国量刑公正标准属于折中主义刑罚论,表现为"罪责刑相均衡",其精髓在于:刑罚的宽严程度应当与行为的社会危害程度以及行为人的人身危险性程度"相互适应",因此,正确处理法定刑、量刑情节与宣告刑三者之间的数量关系,是实现量刑公正的唯一途径。     

What Do They Want in Life?: The Life Goals of a Multi-Ethnic, Multi-Generational Sample of High School Seniors

This study investigated ethnic as well as gender and generational similarities and differences in the life goals among graduating high-school seniors. Adolescents came from six ethnic groups: White, African, Mexican, Other Latino, Filipino, and East/Southeast Asian Americans. Their self-articulated medium-range life goals were grouped into 8 major categories such as occupational, educational, familial, and material goals. Group differences in various aspects of future plans, such as priorities given to different life goals, time frame of attainment, and perceived controllability over their attainment, were also examined. Hypothesized group differences based on current social realities and small-scale qualitative studies on ethnic minorities were not found; there were very few ethnic, gender, and generational differences in adolescents’ life goals. All groups reported a higher priority for, earlier expected attainment of, and more control over their medium-range educational and occupational goals than their family-related and material goals. Further, long-term educational and occupational aspirations were high across all groups. There were moderate ethnic differences in educational expectations and none for corresponding career expectations. Thus, current inequalities in educational and occupational attainments across ethnic groups were only partially reflected in the life goals of adolescents on the brink of graduating from high school.This study was supported by the School of Social Ecology and the Department of Psychology and Social Behavior at the University of California, Irvine; as well as the Max-Planck-Award for International Cooperation granted to Jutta Heckhausen and funded by the German Federal Ministry of Education and Research (BMBF).
