无罪推定原则研究

无罪推定原则作为刑事诉讼中的一个重要原则 ,对于确保被告人在审判中受到公平对待、参与法庭判决制作和保障人权具有重要意义。其思想在我国古代已有体现 ,但真正现代意义的无罪推定原则是近代资产阶级大革命胜利的成果。我国现行法律还没有确立完全意义的无罪推定 ,但吸收了其合理内核。在正确理解无罪推定原则时 ,我们应注意该原则与实事求是、沉默权、传统法律观念和配套法律制度等问题的关系     

党员先进性辩证分析

科学分析党员先进性是开展保持党员先进性活动的理论前提,辩证分析党员先进性是马克思主义唯物辩证法的基本要求。党员先进性是阶级性和群众性的对立统一,是个性和共性的对立统一,是理论与实践的对立统一,是现实性和可能性的对立统一。这几个辩证范畴是科学认识党员先进性的必然要求,对实现保持党员先进性活动的目标是十分重要的。

关于加强实践教学 提高教学质量的思考

目前,公安院校的实践教学存在着许多不尽如人意的地方,这些问题严重影响了公安院校实践化教学的进程,使公安院校的教学质量不能得到有效提高、致使公安教育不能适应公安实际需要。文章试就当前公安院校实践化教学中存在的问题以及这些问题存在的原因进行分析,并提出了一些具体的改进对策,以期解决公安院校实践教学问题。     

《程序设计课程》教学方法的探索与实践

程序设计课程是计算机学科的专业基础课和核心课,肩负着专业入门和兴趣培养等重任,对于学好后续专业课程有非常重要的意义。本文依据笔者多年的教学实践,依据我校课程内容体系的确定,从理论教学,到实验教学,最后再到实践教学三个方面加以讨论。     

Religion and the State: The Singularity of the Jordanian Religious Experience

The history of the Islamic movement in Jordan displays glaring contrasts with its counterparts in other Islamic countries such as Egypt, pre-Revolutionary Iran, and Syria. In a marked departure from a history of violence that characterized the relationship between the state and the Islamic opposition in these countries, the Jordanian Muslim Brothers was not only a peaceful movement but also often defended the state against the challenges of radical ideologies. Following the democratization process launched by the late King Hussein, the Muslim Brothers participated in electoral politics. To adapt itself to the new pluralistic environment, the movement displayed a move toward secularization. This process was reflected in an organizational differentiation and the rationalization of religious discourse. This paper attempts to explain this remarkable phenomenon by first considering the effects of the structure, ideology, and cultural policies of the state and of the development of social classes on the Islamic movement. It then considers the way in which the legal framework and political pluralism in the 1990s contributed to the secularization of the movement.     

事实婚姻与重婚罪的重合适用问题辨析

文章从正义和秩序两个角度分析了事实婚姻制度与重婚罪制度的基本价值取向。事实婚姻制度的秩序诉求是要建立一种否认事实婚姻行为效力的婚姻登记制度,通过这一秩序诉求的达到,进而实现意思自由原则、公序良俗原则与诚实信用原则的正义诉求;重婚罪制度的秩序诉求是建立刑法保护的一夫一妻秩序,通过这一秩序诉求的达到,实现一夫一妻的伦理正义。从对两者的比较分析中推论出对事实重婚行为应当同时适用两种制度的结论。     

《法经》新解

作者对战国时李悝的《法经》提出了一些饶有新意的理解。作者认为,从战国至秦,法家的思想虽盛极一时,也不过是儒家法思想在一个方面的极端表现,并没有跳出儒家法思想的总体框架。

总体国家安全观坚持马克思主义基本立场,继承和发展了新中国成立以来中国共产党维护国家安全的实践探索和理论经验,吸收并借鉴了中华优秀传统文化中治国安邦的思想内核,同时深刻汲取了大国兴衰的经验教训。这充分体现了总体国家安全观的包容性、先进性、集成性、思辨性和人民性,标志着我们党对国家安全基本规律的认识达到了新高度。十年来,在总体国家安全观的指引下,新时代国家安全工作取得历史性成就,国家安全领导体制和法治体系、战略体系、政策体系不断完善,国家安全体系和能力现代化水平显著提升,党和国家经受住了来自政治、经济、意识形态和自然界等方面的风险挑战考验。总体国家安全观体现了中国作为负责任大国的全球视野和使命担当,为创新国家安全理念和认知,丰富各国国家安全道路选择,解决现代化进程难题,维护世界和平稳定贡献了中国智慧和中国方案。     

The Coming Age of China’s Mental Health Social Work and Practical Research Agendas

As six Departments of the National Health and Family Planning Commission enacted ‘The Notification of Implementing the Pilot Work on the Integrated Management of Mental Health’(National CDC，2015，No.57) in April 2015, that year has been seen as the first year of the coming of social work on mental health as well as the milestone of epoch-making and historical significance, marking that Chinese people need structural transformation and the development of health care system toward modernity. Mental health has become a national, universal and highest level of health needs. For the four decades since the reform and opening up, China has made remarkable achievements of policies and regulations on mental health, initially forming the system and framework of mental health policies and regulations with Chinese characteristics. However, social workers still stay in a “marginalized” position and cannot give their due profession to full play. The article first provides a succinct outline of the scope, contents and priorities of the framework and system with regard to mental health social work practices. Then the focus is to build China’s social work practical research agendas of mental health, to draw up a “list of practical research issues”of China’s social work on mental health, to designate the direction for future development of social work of mental health and to lay the foundation of social work for the full realization of the magnificent goal of the Healthy China and well-off society.
