COMMUNITY ACCOUNTABILITY,MINORITY THREAT,AND POLICE BRUTALITY: AN EXAMINATION OF CIVIL RIGHTS CRIMINAL COMPLAINTS*

A growing body of evidence shows that minorities are disproportionately the targets of police brutality, but important theoretical questions about the causes of that inequity remain unanswered. One promising line of research involves structural‐level analyses of the incidence of police brutality complaints; however, existing studies do not incorporate variables from alternative theoretical explanations. Drawing on the community accountability hypothesis and the threat hypothesis, we tested the predictions of two prominent structural‐level explanations of police brutality in a study of civil rights criminal complaints. The study included cities of 150,000+ population (n = 114). The findings reveal that two community accountability variables—ratio percent Hispanic citizens to percent Hispanic police officers and the presence of citizen review—were related positively to police brutality complaints, partially supporting that perspective. Two threat hypothesis measures of threatening people—percent black and percent Hispanic (in the Southwest)—were related positively to complaints, as predicted. The relative degree of support for the two hypotheses is assessed.     

Rural land ownership reform in China’s property law

With regard to rural land ownership, there exist many problems, such as absence of the subject of right, ambiguity of the definition of right quality, and imperfection of the taking system. To perfect the rural land ownership system in China, we should continuously take villagers’ groups and villages as the subject of collective ownership and affirm the right of the members of collective organizations. In order to promote the development of the rural economy and realize the value of land, the contractual management right should be deemed as a property right and allowed to be transferred. The transferability of collective land ownership should be gradually established and the process of taking should be further normalized. Meanwhile, the farmers must receive sufficient compensation. The house site usage right is a special form of right of usufruct. To follow the principle that property should be made best use of, the house site usage right should also be transferable.     

东盟自由贸易区与东盟合作机制--东盟合作机制变迁的社会学考察

东盟自由贸易区建设使东盟合作机制具有了越来越多的正式色彩.这种变化并不是事先刻意而为的,而是为解决协议不执行问题、通过讨价还价逐渐演化而成的.东盟国家之所以没有一味地固守其传统的合作特性,而是有所变化,主要是因为作为一种经济合作安排,东盟自由贸易区不仅关系到东盟国家的经济增长和政治安全,也关系到东盟作为整体在国际上的信誉.     

试论政治合法性与中国共产党组织基础的扩展

现代化的进程,就是对社会力量不断进行整合的过程。从历史—现实的维度与合法性的视角看,中国共产党组织基础是一个不断扩展的过程,也是中国共产党政治合法性基础不断增强的过程。尤其是当今市场经济的发展,中国原有的力量分布格局发生了变化,社会阶层进一步分化,这对中国共产党的组织发展提出了新的要求。以江泽民为代表的中国共产党人,审时度势,大胆进行理论创新,提出新的政治思路,基本解决了这个新问题,因而扩大了中国共产党的组织基础,增强了中国共产党执政合法性基础。     

西方非营利组织理论述评

本文评述了当前西方非营利组织研究的主要理论 ,包括政府失灵理论、合约失灵理论、第三方管理理论、政府与非营利部门关系类型学以及政府、市场、志愿部门相互依赖理论。在此基础上 ,文章认为 ,现有的西方理论在解释中国非营利组织的生成和运作时还存在着理论上的局限性。因此通过精细的实证研究 ,发展出更具解释力的理论是非常必要的。     

社会资本视角下中国善治问题研究

经济全球化和政治民主化浪潮的加速发展催生了社会对善治的诉求,但是,社会资本与善治之间存在着结构性制约与依赖的关系。我国政权的性质和谋求发展的政策取向决定了我国对善治的必然选择。目前,我国现代社会资本还相当缺失,制约了善治模式的普遍形成。发展公民社会的现代公民意识,增强公民的主体意识、权利意识和参与意识;发展公民社会的公共精神,提高公民社会的认同、信任、合作和互助水平;培育民间组织的发展,形成现代社会资本的网络结构,对于我国善治的普遍形成具有重要的意义。

基于农村合作经济组织立法的必要性与紧迫性 ,农村合作经济组织应采取分业立法模式 ,分别立法 ,重点是制定单独的《农业专业合作社法》 ,并明确农业专业合作社的法律地位 ,合作社设立、变更与撤销 ,合作社管理 ,合作社成员的权利和义务 ,合作社产权及盈余分配制度等。
