“中国法哲学”及其法治思维的形成

为平息在中国有没有“中国法哲学”的争辩,结束当今“西方法哲学在中国”占主流地位的尴尬局面,中国法哲学需要展开对中国法治理论与实践问题的研究.中国法哲学是中国人独特的法治观和方法论,是对欧美“法治和平演变论”和中国“法治捍卫江山论”的理论超越;我们不仅要借鉴西方分析性文化对形式逻辑的重视以及实证主义思维的缜密,也要继承中国整体性文化的优势及其对方法的整合功能;既要把传统中国的和谐道德继承下来,也要吸取西方法哲学关于公平正义的普世价值.中国法哲学的目标不在于有些学者所主张的西方化或中国化,因为这两种思想倾向都难以成就为中国法治建设服务的法治观和方法论.我们需要在历史时空中,立足全球视野,寻找确定中国民主、法治建设的路径,从而避免过度西方化或中国化的可能性误导.

Use Your Illusion: Televised Discourse on Journalistic Ethics in the United States, 1992-1998

Journalistic ethics are predominantly created and maintained through authoritative discourse, not codification. 'The line' between mainstream and tabloid news media is a ubiquitous discursive formation that is reified and circulated through mass media and vernacular usage. This paper investigates the validity of the 'boundary' that separates the trustworthy from the questionable, through an analysis of the discourse by journalists on television programs in which transgressions are discussed. Results of the analysis show that little evidence exists for rational belief in the impermeability of the boundary, nor any support for the mainstream media claim that tabloid practices are 'contaminating' media practices generally. It is concluded that such arbitrary distinctions legitimize the dominance of mainstream media by creating a veneer of credibility, while continuing to engage in tabloid-style practices.

Measuring grievance thinking in sexual offenders: The revised Dissipation–Rumination Scale

Abstract

Rumination is an important part of “grievance thinking”, which has been linked to recidivism in sexual offenders. Grievance thinking is a dynamic risk factor that can be targeted in treatment, and is characterized by a perception of being wronged accompanied by angry, hostile rumination about revenge, and has similarities to the “dangerous world” implicit theory . A revised version of the Dissipation–Rumination Scale is used currently to measure grievance thinking in sexual offenders incarcerated in England and Wales. The study aimed to establish whether this revised measure is valid to use with this population. The scale demonstrated adequate reliability and good convergent validity. However, analyses revealed problems with both construct and predictive validity. Further, it is suggested that the scale may not be sufficient to measure the whole of the “grievance thinking” concept. The results do not provide overwhelming support for the use of this tool with sexual offenders; further research is required before firm conclusions can be drawn regarding the scale's utility. Directions for future research are discussed.
