论刑法对两性性自由权的不平等保护——以强奸罪的犯罪主体和犯罪对象为视角

我国刑法典和理论界一致确定强奸罪的对象只能是女性,但依此却无法解决实践中存在的女性奸淫男性问题。性自由权是包括男女两性在内的人类的共同自然人权,男性的性自由权自然应当受到保护。现行刑法将男性性自由权排斥在法律保护之外,违背了平等保护原则。应对刑法相关条文进行修改。

随着案件管理机构的设置及相关工作的开展,案件管理工作的职能定位、人员求、与内设部门关系、工作方式方法及效率效果等均面临着规范化、科学化、效率化的考验,应对案件管理工作实施流程管理,完善流程监控,开展案件质量考核、业务考评及案件评比,将这一工作规范细化。     

浅析附条件不起诉制度

附条件不起诉是检察机关自由裁量权的一种形式,属于审前程序处理。2012年我国修正后的《刑事诉讼法》正式确立了附条件不起诉制度,规定对符合法定条件的未成年人犯罪案件可以适用附条件不起诉。该制度的确立,能够扩大检察机关的自由裁量权,促使未成年犯罪嫌疑人改过自新,提高诉讼效率。然而,司法实践中,该制度在适用范围、程序启动、听证等方面仍有需要完善的地方。     

Powerful perpetrators,hidden in plain sight: an international analysis of organisational child sexual abuse cases

ABSTRACT

There is virtually no literature on child sexual abuse committed by “powerful perpetrators”, who, use position, reputation, wealth and/or power, to become influential members of their organisation. Seventeen cases relating to youth serving organisations were identified using a comprehensive search of databases covering case reviews from England, Australia and the US. A Quantitative Content Analysis was used to analyse the sample with a focus on identifying offenders’ “modus operandi”. Findings revealed a number of critical differences between powerful perpetrators and other child sexual offenders described in the literature. Findings are discussed in relation to their implications for creating safer youth serving organisations. In particular, focusing on educating YSOs to recognise and address risks posed by powerful perpetrators; expanding organisational safety policies and practices and taking steps to develop a strong, positive organisational safety culture are commended as key approaches.     

LGBTQ+ Tensions in the 2018 Chilean Feminist Tsunami

In this article, we will critically reflect on the 2018 feminist student mobilisations in Chile through an analysis of interviews and discussion groups with LGBTQ+ students who participated in the feminist student protests and occupations. We will argue that even though these feminist student mobilisations can be considered an example of transfeminist coalitions, some relevant conflicts and tensions remain, such as discourses and practices that still use an either/or, binary, cishet framework, maintaining a problematic separation between feminist and LGBTQ+ agendas, undermining the intersectional feminist understandings necessary for a more complex idea of social justice.     

Murderer vs investigator: factors influencing the resolution of sexual homicide cases

ABSTRACT

The objective of this study was to identify the factors associated with the duration of criminal investigations and determine whether these factors influence the seriality of sexual murderers. To this end, data on the investigation of 62 sexual homicides (homicides committed by a serial sexual murderer = 24; homicides committed by a nonserial sexual murderer = 38), were analyzed. Organized behaviors, typical of serial sexual murderers, were not all associated with a longer criminal investigation. However, it was possible to develop a model of the duration of investigations, and predict the seriality of sexual murderers, by taking into account the decisions of murderers and investigators.     

Assessing child-safe culture and practices in organisational settings: a validation and refinement of Kaufman's Organisational Safety Climate Survey

ABSTRACT

Using an Australian sample of employees (n?=?1068) we assessed the psychometric properties of Kaufman’s Organisational Safety Climate Survey and its practical utility for measuring child-safe culture within organisations. The 60-item survey was found to have adequate psychometric properties. Initial factor analyses indicated a unidimensional factor structure, despite the survey being originally conceptualised into four subscales. Cronbach’s α coefficients were .95 for the full survey, with subscales ranging from .65–.94. However, qualitative feedback from respondents indicated that the survey was somewhat laborious and repetitive, with some item ambiguity noted. Refinements to the survey resulted in a 24-item short-form survey. The psychometric properties of the short-form survey were re-assessed. Factor analyses indicated a three-factor solution. Despite a significant reduction in items, internal consistency of the scale was not compromised; reliability of subscales also improved. Validation of this short-form survey as an alternative, time-efficient measure to maximise employee participation and contribution, is recommended.     

Sexual Assault Victimization,Fear of Sexual Assault,and Self-Protective Behaviors: A Test of General Strain Theory

According to Agnew’s General Strain Theory, many individuals who experience strain are more likely to engage in crime or become delinquent. To date, past research has examined the relationship between victimization and fear of crime, as well as the corresponding relationship between fear of crime and self-protective behaviors. Yet, the mediating role fear of sexual assault may have in accounting for the association between prior sexual assault victimization and self-protective behaviors has not been evaluated. The current study addresses this gap in the literature using data collected from a random sample of college students from 12 universities in the United States. The results indicated that the relationship between prior sexual assault victimization and self-protective behavior is partially mediated by fear of sexual assault. The study concludes with a discussion of implications and limitations, as well as directions for future research.
