论对商品房预售合同购买人权利的保护及其完善

商品房预售合同购买人直接基于合同享有的权利为债权。预售合同登记与否不影响购买人享有债权,但对购买人权利效力的强弱有影响。现行司法解释在一定情况下赋予购买人权利以物权效力保护,但在权利定位、对抵押秩序的影响和与物权法定关系等方面存在明显不足。大陆法系民法承认物权与债权区分的局限性,以预告登记制度保护不动产物权受让人。我国应借鉴预告登记制度,更新认识并改造预售合同登记制度,完善购买人权利保护。     

Performative Rhetorics in Invisibility: Phoebe Philo's Undone Authorship

ABSTRACT

This inquiry analyses the rhetoric of intentionally unfinished fashion contained in the collections from Céline as designed by Phoebe Philo and explicates the implications of this approach to fashion as a feminist text. Shoshana Felman’s seductive promise of speech, modified with insights from Paul de Man’s theory of autobiography as both giving face and defacement, is applied to Philo’s ‘new minimalism’ in order to highlight its appeal to modern female audiences. Using insights from the philosophy of Jacques Derrida, I examine ways in which wearers may seek to create a signature citationality via clothing that produces its own ‘unwriting’ therefore allowing the wearer to believe she inscribes her own iteration while maintaining control. Wearers are offered the chance to identify with a designer who is enlightened beyond fast and flashy fashion while hinting at the notion of the clothing having the substantialising effect that language has (instead of representational). Through this examination, clothing is shown to be a decision, and clothing is also shown to be a fiction. These decisions and fictions are open to failure; yet Felman offers that this failure acts as an opening remaining inadvertent or unacknowledged. Philo's designs invite an exploration of clothing as performative rhetoric.     

Preferred learning style： Gender influence on preferred learning style among business students

Past studies indicate that there was a correlation between gender and students＇ preferred styles of learning. Thus, the purpose of this study is to determine the influence of gender on the learning style preferences of business students based on the VARK （Fleming, 2002b） learning style survey, consisting of the V（isual）, A（ural）, R（ead-Write） and K（inesthefic） learning styles. The sampling design used for this study was non-probability sampling and the sampling technique conducted was convenient sampling on 207 male students and 199 female students from the business school. The study found that gender only influences the V（isual） and A（ural） learning styles of business students. In addition to that, even though both male and female students exhibited a similar response towards both these learning styles, female students were found to demonstrate slightly higher preference for the V（isual） and A（ural） learning styles as compared to the male students. The findings draw attention to facets of learning that may exist in pre-university and tertiary classrooms with a combination of female and male students, which could have an impact on teaching and managing these students.

国家侵权精神损害赔偿制度是衡量一个国家民主法治水平的重要尺度之一。完善国家赔偿中精神损害赔偿是维护宪法权威、建立法治社会的需要,是坚持以人为本、构建和谐社会的需要,是融入世界潮流、适应历史发展的需要。实践中,构建精神损害国家赔偿制度必须从赔偿的范围、方式、标准、程度等方面入手,切实保证国家赔偿渠道通畅,保障公民的合法权益不受侵害。     

Weak states and uneven pluralism: lessons from Mali and Kyrgyzstan

We argue that certain important democratic practices and elements of pluralism are lasting features of political systems in many poor countries. Because of state weakness, such arrangements work to the benefit of both elites and citizens. The broader citizenry and civil society enjoy significant political freedoms and greater access to foreign aid. Elites tolerate these limited civil liberties and regular elections because they produce few costly consequences due to state incapacity. We evaluate this theory of ‘uneven pluralism’ in poor countries using evidence from a paired comparison of Mali and Kyrgyzstan. These two countries have experienced significant political turbulence, but on balance have shown a persistent and robust commitment to a free press, transparent elections, and respect for freedom of association. Our theory suggests that uneven pluralism is likely to continue in countries like Mali and Kyrgyzstan, even as significant limits on judicial independence, persistent corruption, and lack of government transparency make democratic consolidation unlikely.     

Sovereignty,bare life and the Arab uprisings

Five years after people took to the streets in protest at political organisation across the Middle East, the consequences of these actions remain. As the protests gained traction, states began to fragment and regimes sought to retain power, whatever the cost. While a great deal of focus has been upon what happened, very little attention has been paid to the role of agency within the context of the fragmenting sovereignty and political change. This article contributes to these debates by applying the work of Giorgio Agamben to the post-Arab Uprisings Middle East, to understand the relationship between rulers and ruled along with the fragmentation of the sovereign state. The article argues for the need to bring agency back into conceptual debates about sovereignty within the Middle East. It concludes by presenting a framework that offers an approach building upon Agamben’s bare life.
