The gender agenda: NGOs and capitalist relations in highland Cambodia

Cambodia’s mountainous northeastern province of Ratanakiri, which only twenty years ago was home to mainly indigenous minority groups largely focused on subsistence production, has undergone rapid ecological, social, and economic transformation. Deforestation and land alienation in the context of large-scale plantation agriculture, land speculation, and smallholder cash cropping have led to concerns that indigenous communities are being alienated from their land and not benefitting from economic changes. This has resulted in a significant number of NGO and government programs that attempt to protect and “empower” indigenous people, particularly women. This article examines a one-year research project which explored the relationship between indigenous women and land change in two indigenous villages. It discusses how indigenous women as well as Khmer and landless Cham immigrants have dealt with the commoditization of land and labor. It focuses on the differentiated way capitalist relations have pushed men, women, landless laborers, and increasingly wealthy landowners on increasingly divergent life trajectories. Compelled by donors to focus on gender and indigenous women as an object of governance, the NGO that directed this project struggled to keep up with the realities of capitalist relations on the ground.

诚信是法治政府的基础和本质,是法治政府的标准,是法治政府的义务和责任.只有加强诚信建设,我国才能实现建设法治政府的目标.当前各级政府应该做到:政府的政策与规范应具有稳定性与不可溯及性;公布的信息应具有真实性、准确性、全面性;应严格执行法律、法规、规章及有关政策;严格遵守信赖保护原则.     

数字环境下著作权合理使用与侵权的法律边界——由《一个馒头引发的血案》引起的思考

《一个馒头引发的血案》视频短片在网络上传播,引起了人们对著作权合理使用与侵权的争论。本文认为《馒头血案》是独立作品,并且是合理使用产生的作品,而不是戏仿作品。对于戏仿作品应当在著作权法中给予合法地位,以保障数字环境下新的作品创作形式,繁荣文学艺术。但《馒头血案》完全符合著作权法第22条之(二)的规定,属于为介绍、评论某一作品或说明某一问题,在作品中适当引用他人已经发表的作品的合理使用作品,不存在侵权的问题。     

论国有土地使用权的性质

以出让方式取得的国有土地使用权制度是我国重要的土地使用制度,国有土地使用权也是物权法要规定的重要内容之一.正确地认识并确定国有土地使用权的性质是必要的,应该充分地认识到:在我国现行的土地制度中,以出让方式获得的国有土地使用权是惟一可自由交易的土地使用权,在我国土地公有制的条件下, 一般公民与法人享有的是近似于所有权的土地使用权,在民法上土地使用权起着所有权的功能,土地使用权才是我国不动产的"自物权",土地使用权是不动产市场的基础.     

农村宅基地使用权制度探讨

农村土地主要包括农用地、宅基地、乡村企业建设用地、乡村公用地.在目前制定民法典的过程中,专家学者对农用地的关注非常多,而对作为农民立身之本的宅基地的研究相对缺乏.通过对有关农村宅基地使用权的概念特征、现行法律制度及现状中存在的问题进行探讨,对农村宅基地使用制度的完善提出看法.     

Cross-gender Violence Perpetration and Victimization Among Early Adolescents and Associations with Attitudes Toward Dating Conflict

This study examined gender differences in cross-gender violence perpetration and victimization (ranging from mild, e.g., push, to severe, e.g., assault with a knife or gun) and attitudes toward dating conflict, among an urban sample of 601 early adolescents (78% African-American). Comparisons across gender groups for cross-gender (e.g., female-to-male) violence perpetration and victimization indicated higher levels of perpetration for girls and higher levels of victimization for boys. Girls also reported higher levels of verbal and physical violence toward partners with regard to attitudes toward dating conflict. A path model was specified and indicated that cross-gender violence perpetration, harsh parenting, peer deviance, low family income, and neighborhood hazards accounted for significant variation in attitudes toward dating conflict. Findings were discussed regarding the need to identify developmental precursors of dating violence in early adolescence and to focus prevention efforts on components (e.g., social skills, coping strategies) necessary to prevent the onset and escalation of adolescent dating violence.

论刑事庭前审查程序的价值——兼论我国庭前审查程序的完善

刑事庭前审查程序的价值主要体现为三个方面:一是对公诉案件进行"过滤",从而抑制公诉,防止不必要的和无根据的审判发动;二是对公诉案件进行"分流",使不同刑事案件适用繁简不同的诉讼程序,防止简单案件适用复杂的诉讼程序,或者是复杂案件适用简单的诉讼程序;三是保障人权并节约诉讼资源.在此基础上,提出了"建立我国预审法官制度"等完善我国刑事庭前审查程序的构想.     

The End of Sprawl? Not so Fast

This article takes a careful look at the recent state of sprawl among America’s 178 largest metropolitan areas through the lens of four sets of questions: (a) Measured at the metropolitan level, is sprawl really declining? Is it declining everywhere, or just in selected metropolitan areas? (b) If sprawl is indeed declining, are more compact growth forms on the rise? (c) If sprawl is indeed declining, is it the result of antisprawl land use and development policies? (d) Which metropolitan-level land market, demographic, and economic factors are most associated with changes in sprawl? It concludes that sprawl is indeed declining when measured by average population densities, but that the decline has been much less widespread if measured in terms of population growth in core-area neighborhoods, changing density gradient intercept and slope estimates, and increased employment clustering. In terms of policy, it finds no evidence that local regulatory regimes or growth management programs have had any effect on sprawl, but finds that the consistent administration of local regulatory programs in ways that incentivize infill development and send consistent signals to developers does contribute to reduced sprawl.     

明星模仿的侵权认定与例外——以形象权保护为视角

我国法学界对明星模仿涉及的法律问题给与了很多讨论,讨论的主题涉及明星模仿的方式、侵权构成要件、法律规制等方面。目前来看,理论界对于明星模仿侵犯了权利人的合法权益并无异议,但对于认定侵权的标准和侵犯了权利人何种权益等问题仍有待进一步讨论。本文试图引进形象权的概念和形象权理论中＂附带使用＂规则对明星模仿侵权相关理论进行分析。
