众所周知,刑法因其惩罚的严厉性要求刑法适用必须遵循谦抑性的原则。目前实务界在适用中存在违背谦抑性的种种表现:不考虑情节构罪即移送起诉、某些罪名过度适用、被问责主体扩大等。要实现刑法的谦抑性,不单要阐述刑法所具有的谦抑品格,更重要的任务应在实务层面将谦抑精神落到实处,在刑法适用者心中树立一个标杆,塑造谦抑刑法适用的环境。  相似文献

Replacement respondents who move into NCVS households after the initial bounding interview can introduce measurement error since their reports of victimization may be influenced by their mobility (actual experiences) and by their unbounded interview status (response error). Which of these factors affects reporting is unknown and is the focus of this research. The availability of incoming respondent data from the NCVS School Crime Supplement and mobility status from the NCVS provides a unique opportunity to study these effects separately. Both bounding and mobility were found to influence reporting; however, this influence was not consistent. Unlike findings from past research, bounding only had significant effects on reports of property victimization. Conversely, moving only significantly affected reports of violent victimization. As this study is the first to disentangle the effect of unbounded interview status from mobility on reports of victimization, the findings emphasize the need for further research to better understand these issues.  相似文献

Values,Frames, and Persuasion in Presidential Nomination Campaigns   总被引:1,自引:0,他引:1  
This paper examines the persuasability of rhetorical value framing within a presidential nominating campaign, in an effort to understand how values and value-laden language may provide useful signals in electoral contexts where partisan cues are absent. Relying on a survey-experiment conducted during the 2000 Republican nomination campaign, I evaluate the relative persuasiveness of arguments framed in either individualistic or egalitarian terms. Drawing upon an “active-receiver” model of framing effects, I posit that Republican primary voters respond more readily to candidates when they use individualistic frames than when they use egalitarian frames, because individualism is a more “chronically accessible” value construct for Republicans. Furthermore, I hypothesize that this dynamic is particularly pronounced among more educated respondents, who have been trained to recognize abstract value cues and automatically apply them to applied political contexts. Previous research suggests that 3 general processes underlie the decision of property crime victims to notify the police: One that is cognitively driven by reward/cost considerations, one that is affectively driven, and another that is socially driven. This study is the first to employ a community sample of crime victims to compare the 3 processes within a single study. Computer-assisted interviews were conducted with 422 property crime victims (n = 129 burglary, n = 293 theft) located via a random digit dialing procedure. Logistic regression analyses showed that each process independently accounted for a significant amount of the variance in victim reporting, and that there were no interactions among the three processes in predicting reporting. Of the 3 processes, social influence was the best predictor of reporting. Analysis of the affect-driven process showed that reporting was primarily a function of the level of fear rather than anger or the level of generalized arousal upon discovering the crime.  相似文献

ABSTRACT

How much do Italian interest groups undertake their advocacy/lobbying activities at the EU level? How often have groups gained access to different EU level institutions? This paper presents an original conceptualisation for the concept of ‘interest group Europeanisation’, which takes into account both the percentage of EU lobbying and access to EU institutions, and assesses the role of national centrality (i.e. access to national institutional venues and self-perceived influence in national policy-making) in determining whether there is more or less interest group Europeanisation. Original data from a national survey conducted on around 500 Italian interest groups are provided. Groups that are at the core of the national interest system are less likely to undertake a large part of their lobbying activities at the EU level, but more likely to gain EU access.  相似文献

Abstract

Euromaidan and the subsequent Russian military intervention brought about a perceptible change in ethnonational identifications of Ukrainian citizens. Based on three nationwide surveys from various years, the present article seeks to measure this shift and explore its underlying factors and mechanisms. My analysis reveals considerable changes in ethnolinguistic identifications, practices of language use, and preferences regarding language policies of the state, which can be seen as a kind of bottom-up de-Russification, a popular drift away from Russianness. At the same time, I demonstrate that changes in identifications by nationality and native language are related to changes in the perceptions of these categories; that is, that they should be conceptualized as measuring people’s perceived belonging to both ethnic groups and civic nations. In other words, as people are shedding their Russianness in favor of Ukrainianness, they are also changing the meaning of being Ukrainian.  相似文献

How the recent creation, re‐invention or reinforcement of regional levels of political decision making across Europe compounds political representation is one of the key issues of contemporary democratic government. Despite growing scholarly interest, the critical question as to whether the regional institutional setting has brought about distinct representational roles among sub‐state legislators has yet to be addressed. To advance research in this field, this study bridges the literature on multilevel politics and legislative studies that to date have developed in isolation. Using innovative survey data from 14 statewide and 56 regional legislatures across Europe, it provides the first comprehensive test of how the state structure affects a legislator's views on representation. The results highlight that, relative to legislators in unitary states and national legislators in multilevel states, legislators at the regional level are more constituency‐oriented. Moreover, this heightened responsiveness to constituents at the regional level is not offset by weaker collective representation operating through political parties. Beyond these findings’ immediate relevance to scholars of federalism/regionalisation and parliaments, they also speak to the wider normative debate about the quality of political representation and public policy.  相似文献
