民事执行检察监督的实践探索与制度构建——基于广东检察办案实践的实证分析

实践证明,民事执行的检察监督对于实现生效裁判所确定的内容、救济当事人权利、维护司法公正与执行公正意义重大。然而,由于立法缺陷、理论分歧、实务冲突等因素的制约,民事执行的检察监督仍然面临极大的困境。在中国,民事执行的检察监督,具有宪政依据、政策依据、法律依据及现实依据。在民事诉讼法再次修订时,应当明确规定民事执行检察监督的内容及相关程序。     

裁判公开制度研究

裁判公开与审理公开是审判公开制度的两大基本内容,但我国却疏于对裁判公开进行必要的研 究与规制。其实,裁判公开具有丰富的价值功能,各国立法对裁判公开的层面选择并不完全相 同。我国程序立法应当重视裁判公开的多层面性,并在此基础上结合我国的实际情况作出立法 选择。     

公安行政复议制度的进程回顾、现状与前瞻——写在《行政复议法》颁布10周年之际

《行政复议法》颁布10周年以来，公安行政复议工作取得了可喜的成效，但也发生了一些问题。在肯定成绩的同时，更应总结经验、教训，并进行有针对的整改，以促进公安行政复议制度长期健康地开展。为此，一要总结10年来公安行政复议工作的基本情况，二要找出问题，三要探求改进措施，完善公安行政复议制度，以实现行政法治。     

Ex-offender employment programs and recidivism: A meta-analysis

One consequence of the tremendous growth in the number of persons under supervision of the criminal justice system, whether incarcerated, on parole, or on probation, is the effect of this criminal history on finding and keeping a job. Ex-offenders, especially those recently released from prison, face substantial barriers to many types of legal employment; nonetheless, stable employment is one of the best predictors of post-release success. Thus, policy-makers concerned about high recidivism rates face an obvious need to improve the employment prospects of ex-offenders. Over the last 25 years, many programs that were designed to increase employment (and, by so doing, reduce recidivism) among ex-offenders have been implemented and evaluated. [Wilson, D. B., Gallagher, C. A., Coggeshall, M. B. & MacKenzie, D. L. (1999). Corrections Management Quarterly 3(4), 8–18; Wilson, D. B., Gallagher, C. A. & MacKenzie, D. L. (2000). Journal of Research in Crime and Delinquency 37(4), 347–368] conducted a quantitative synthesis and meta-analysis of 33 evaluations of educational, vocational, and work programs for persons in correctional facilities. To date, however, the evaluation literature on employment programs for those with a criminal record who are not in custody has not been systematically reviewed. This paper presents the results of a quantitative meta-analysis of eight random assignment studies of such programs, using the Campbell Collaboration methodology. The results indicate that this group of community employment programs for ex-offenders did not reduce recidivism; however, the experimental design research on this question is small and does not include some of the promising community employment programs that have emerged in the last decade.

Avoiding Theoretical Stagnation: A Systematic Review and Framework for Measuring Public Value

Public value theory has become a hot topic in public administration research, but its proponents have long recognised difficulties in empirically testing the theory's central propositions. There has been a lack of clarity about how to measure the extent to which organisations are generating public value, which has rendered researchers unable to quantitatively study the causes, consequences and correlates of public value. The current study systematically reviews the growing literature on public value measurement to identify, evaluate, and synthesise available measures. Through a qualitative synthesis of the themes present in published measures, we identify four key components for measuring public value that appear to be important across a range of policy and national contexts. Our review identifies a promising framework that could be used to structure a comprehensive measure of public value and, in doing so, provides a means to progress theoretical development and testing of the public value approach.

制度性歧视与平等权利保障机构的功能——以农民权利保障为视角

制度性歧视是指由国家的正式规则所形成或被国家的正式规则所接受和保护的歧视。城市化进程中针对农民的歧视性制度安排,主要表现在经济和社会领域。具体可分为如下几类:户籍制度;农地征用制度;社会保障制度;教育制度;就业制度等。上述歧视性的制度安排严重侵犯了农民财产权、劳动权、获得物质帮助权、教育权等基本的宪法权利。通过立法的方式建立专门的以反歧视为目的的平等权利保障机构或职能更宽泛的人权保障机构,既是国际人权法所倡导的,在世界上许多国家以及我国的香港地区已有成功的实践经验。平等权利保障机构就其功能而言,适合于以大多数农民为代表的弱势群体的生存状态和权利诉求。
