法医精神病鉴定在刑事、民事和行政三大诉讼领域中,以鉴定意见的证据形式发挥着重要作用。然而,与其重要性不相匹配的是,法医精神病鉴定学科发展尚不完善、专业发育尚不成熟,尚不能满足社会和民众的期盼和要求,甚至引发负面评价。为进一步促进法医精神病鉴定规范化、标准化建设。以法医精神病鉴定人的视角,结合法医精神病鉴定的内容架构,重点阐述法医精神病鉴定主要项目及其作用、评定要点,尤其聚焦刑事责任能力评定,阐明当前存在分歧和困难;简要介绍法医精神病鉴定人执业要求、法医精神病鉴定质量控制;以及简述法医精神病鉴定与临床精神医学实践的区别与联系。 相似文献

History has taught us that the Global North's attempts to ‘civilise' the rest of the world's population, both now and in colonial times, have been fraught with difficulty. This paper argues that this difficulty is mainly owing to the political standpoint and positioning of our perceived engineering and technical superiority. A failure to recognise this viewpoint and to change the way in which we work together—in a global sense—to solve issues such as climate change, threatens our ability to survive as a species. Political standpoints on such issues still assume a superiority of governments in the Global North. This paper retraces colonial engineering projects, mainly directed from the UK, that failed to consider the development of other populations in the world, and their needs. It is also posited that our exploitation in the Global North, which assumes historical superiority as a basic premise, will fail in tackling major issues. Change is needed through a decolonisation of engineering projects, and western engineering curricula that are used to train future professionals. Evidence of the impact of decolonisation on the engineering discipline itself is scarce, but nevertheless, a response is needed to ensure that a more inclusive curriculum and narrative is developed. 相似文献

The increased use of information and communication technologies (ICTs) has triggered enormous innovation in the public sector and created positive public value at the managerial, delivery of services, and policy levels. However, these positive outcomes do not automatically accrue simply by adoption of ICTs as public leaders can fail to adopt relevant new ICTs, use them poorly, or use them in ways that actually diminish public value, which raises the question of the importance of e-leadership. This article examines e-leadership and innovation capacity at the individual public manager level and fills in some gaps about the practice and implementation of ICTs in the public sector. We explore eight research questions useful in theorizing about e-leadership, develop constructs of e-leadership, and describe the current development of e-leadership. By comparing e-leadership in two country settings (South Korea and the United States), we also overcome the limitations of the existing Western-oriented studies about innovations in the public sector. In addition to the growth of e-leadership use and requirements for a variety of competencies equivalent to, but separate from, traditional communication competences, we find that national cultures exert significant influence on the major constructs of e-leadership, which implies that an effective e-leadership strategy should consider cultural contexts seriously. 相似文献

Smart card technology is one of the most recent computer revolutions, making its way world-wide into the hands and wallets of everyone. Today smart cards are used all over the world as personal identification cards for corporate building security systems and personal computer equipment access control. Governments, financial services, transportation, telecommunications, healthcare, education, retail and many other industries are planning to or already using smart cards as a means of providing better security and improved services to its customers and users. Understanding the factors that influence user acceptance of information technology is of interest both to researchers in a variety of fields as well as procurers of technology for large organizations. The purpose of this study is to develop an acceptance model and evaluate the user acceptance of smart card in Iran. A pilot study is conducted and a total of 46 questionnaires were distributed among the master students in field of computer science (information security and software engineering) at University Technology Malaysia, Kuala Lumpur. This article discusses a theatrical spectacle created by Walt Disney and General Electric for the 1964 New York World’s Fair that has run for the last five decades: the Carousel of Progress, a history pageant that stages the evolution of domestic technology in the twentieth century. As a spectacle dedicated to celebrating tools that bolster women’s participation in the social reproduction of capitalism, the author argues, the Carousel shows how expos utilize theatricality in order to inscribe industrial technologies within corporate ideologies. By apprehending the Carousel of Progress as a site of corporate performance, the author demonstrates how the Carousel’s afterlife in theme park entertainment has enabled Disney to theatricalize disparate modes of capitalist futurity in response to shifting cultural sensibilities. The author situates the Carousel within an economy that has consistently presented female domestic labor as subordinate to corporate capital, culminating with its late-1990s staging of an illusory prefeminism, which fantasizes a twentieth century in which no feminist movement took place. Engaging with theories of corporate performance, this article takes up the Carousel of Progress’s production history as an indication of theatricality’s longstanding utility to corporate capitalism. 相似文献

The past decade has witnessed an intensifying focus on the development of irrigation in sub-Saharan Africa. It follows a 20-year hiatus in the wake of disappointing irrigation performance during the 1970s and 1980s. Persistent low productivity in African agriculture and vulnerability of African food supplies to increasing instability in international commodity markets are driving pan-African agricultural investment initiatives, such as the Comprehensive Africa Agricultural Development Programme (CAADP), that identify as a priority the improvement in reliability of water control for agriculture. The paper argues that, for such initiatives to be effective, there needs to be a re-appraisal of current dynamics of irrigation development in sub-Saharan Africa, particularly with respect to the role of small-scale producers’ initiatives in expanding irrigation. The paper reviews the principal forms such initiatives take and argues that official narratives and statistics on African irrigation often underestimate the extent of such activities. The paper identifies five key characteristics which, it argues, contradict widely held assumptions that inform irrigation policy in Africa. The paper concludes by offering a definition of ‘farmer-led irrigation’ that embraces a range of interaction between producers and commercial, government and non-government agencies, and identifies priority areas for research on the growth potential and impact of such interactions and strategies for their future development. 相似文献

Explanations for national success in science and technology typically focus on domestic institutions and policies. However, that line of research has yet to identify any particular set of institutions or policies that explain variation in national innovation rates across cases or over time. This article offers new evidence that the problem with domestic institutions approaches stems from their failure to consider international security factors. Specifically, this article finds a positive effect for U.S. security alliances on innovation. This finding is robust across different specifications and periods of analysis. While countries that ally militarily with the United States are found to realize benefits in economy‐wide, indigenous innovation, such an effect is not observed in military technologies. This suggests that alliances may substitute for being on the frontier in military technologies. Therefore, this article contributes not just to debates over S&T competitiveness, but also to alliance formation. 相似文献

Drawing on institutional theory, this article articulates qualitative insights from a program of research on Canadian health technology‐based ventures to examine the rules that characterize economic policy, capital investment, and regulatory approval as well as the way these institutions enable and constrain the development of ventures at an early stage. Our findings clarify how economic policy integrates these ventures into the entrepreneurial domain, how capital investment configures them for economic value extraction, and how regulatory approval fully releases their market value. These findings help to revisit current policy modernization initiatives by calling attention to the convergence among the three institutions. Rather than operating solely as a source of constraints, these institutions provide a highly integrated market‐oriented space for health technology‐based entrepreneurial activities to unfold. 相似文献
