传统法律文化调适的必要与可能

从清末变法改制以来的一百年间,如何调适传统法律文化以适应法制现代化的需求,就成为一个历久弥新的话题。仁政与宪政、义务本位与权利本位、家族与个人、纠纷解决与权利保障等的不相容或实质性差异,决定了对传统法律文化调适的必要,而立法中的择善而从和司法中的因势利导,则为这种调适提供了可能。     

Community Involvement as a Vehicle for Integration: A Study with Young Immigrants

ABSTRACT

Immigrants are often exposed to conditions of economic deprivation or to hardships of a social nature connected to their status. These factors increase their feeling of impotence, thus slowing down the integrative process. An element that could counter these disadvantaged conditions is participation in an association that promotes immigrants’ demands on a socio-political level. The first aim of this study is understanding the relationships between involvement and integration. The authors hypothesize that youth engaged in community are more integrated than not engaged immigrant youth. The second aim is to investigate the relationship between the type of activity, type of association and integration. The participants were 644 immigrant youth (Age range 19–35, 56.2%) that were involved in the community. The results show that involved immigrant youth report higher levels of both ethnic and national identity compared to not involved youth. Regarding the type of activity carried out, there is a statistically significant difference between activity of a social type, which obtains higher means, and of a civic type, which rather obtains lower means. While exploratory, the study shows and confirms the relationship between community engagement, young immigrants’ integration process and construction of identity.

Formal and informal governance networks: Diabetes care in Australia and India

The concept of networks has gained interest in public administration and management. They address concerns such as the coordination of multiple actors within the policy process. Networks take both formal and informal forms. As the integration of formal and informal networks in public service delivery is gaining traction, this paper uses the example of diabetes care in Australia and India to provide an analytical framework to examine one of the ways such integration of networks take place. Diabetes, a chronic long‐term disease, poses to be a global problem with a high rate of diagnosis with implications for public health expenditure. A multi‐disciplinary team, which comprises both formal and informal categories, is required to manage diabetes. This paper highlights the integration of networks in diabetes care in different institutional and cultural settings. For such form of integration of networks to work, collaboration among the various actors is important. Lessons learnt from diabetes care will be relevant for other long‐term chronic conditions to help reduce the human resource and financial burden. The analytical framework developed based on the example of diabetes care will provide useful lessons for examining the mechanics and dynamics of the integration between formal and informal networks in the field of public administration and management.     

利益诱惑情境与腐败事件的生成及控制——基于18个典型案例的分析

现实发生的各类腐败行为和腐败案件均有公职人员与特定当事人在特定时空进行越界交换的共同特点,用利益诱惑情境来解释越界交换现象具有独特的价值。利益诱惑情境是内蕴于公务情境中的行为活动场景,以其即时性、选择性和感染性形成集成机制,进而使公职人员在场定义发生认知错位、规则变异和取向偏差,在标准、内容和程序上突破腐败与不腐败的临界点,生成腐败事件。控制临界点不被突破也就控制了腐败事件的发生,需要在利益诱惑情境的时间和空间环节加强监督,建立健全制度,重视对行贿人的查处,培育理想信念与信守从政道德,真正建立固守廉洁阵地的防线。     

The Bordered World of Cross-border Cooperation: The Determinants of Local Government Contact Networks within Euroregions

The article discusses the determinants of local government contact networks within cross-border cooperation organizations (Euroregions). Relying on social capital theory, a combination of social network and qualitative analytical tools are applied on data from two Scandinavian and two East Central European cases. The analysis reveals that, even in favourable circumstances, contact networks are thin and Euroregions fail to develop into truly integrated political spaces. The analysis also shows that contact patterns on one side of the border, determined primarily by inter-municipal cooperation, will matter for how contact networks are formed across the border. The findings are important, as membership in a Euroregion is expected to foster cross-border political relationships that could have possible spillover effects in terms of encouraging policy cooperation outside the framework of the Euroregion, which in turn would enhance the likelihood of well-functioning cross-border governance spaces.     

中日韩贸易一体化趋势研究:自组织理论的视角

区域经济贸易一体化过程既有来自市场的驱动力,也有来自政府的驱动力。其中前者表现为经济贸易体系偏离均衡状态、从无序向有序演进的自组织过程。中日韩三国近年来经贸合作日益频繁,三国之间的贸易增长远快于三国对世界的贸易增长,相互出口结构进一步与区域内的需求结构相契合,产业分工水平进一步深化,表现出明显的区域贸易一体化趋势。这一过程客观上要求突破原有的国家边界的束缚,在区域内实施更加开放的经济贸易政策,促进区域竞争力的提高和经济的持续增长。     

中国城市化进程中的农民权利诉求

中国的城市化作为缓和城乡二元结构状况为目的的一种社会发展趋势,既为三农问题的解决带来了机遇,也使农村中固有问题和矛盾日渐凸显,同时在其不断推进中还将带来新的问题。农民的权利诉求是农村城市化中的主体回应,与城市化进程是一个双向互动的过程,诸如社会结构、现代化目标、流动性、社会心理等城市化中的多种因素影响着农民权利诉求的产生与变化,而农民的权利诉求同时也促进着城市化发展的动态平衡。     

尊重与培训,新生代农民工市民化的良好途径——来自青岛港的调查

加快形成城乡经济社会发展一体化新格局,是缩小城乡差别、实现城乡共同繁荣的根本途径。加强对新生代农民工的培训,提高其综合素质,不仅是加快新生代农民工市民化、使其身心融入城市的根本措施,也是促进城乡一体化发展的关键。青岛港采取尊重的态度与相应的培训方法,将有稳定劳动关系的新生代农民工逐步转化为现代产业工人,走出了一条让新生代农民工具备社会需要素质的独特之路。     

我国基本公共服务均等化问题研究

20世纪90年代中后期以来,随着我国经济的快速发展,城乡经济社会发展却严重失衡,居民收入差距逐渐扩大,社会矛盾日益突出.同时,广大社会成员对社会公平、正义的要求也比以往任何时期都更为迫切和强烈.要解决这些问题,实现基本公共服务均等化是一个很好的切入点.换言之,逐步实现基本公共服务均等化已经成为我国当前改革和发展的重要内容和重要目标,具有重大意义.但是,在我国这样一个发展中的大国,实现基本公共服务均等化不可能一蹴而就,应实施"同步推进,分步实现"的发展战略.
