外层空间军备控制与国际法

外层空间法是维护外层空间安全的基本法。由于各国外空战略利益的差异,以及国际立法的滞后,因而外层空间法在控制外空军备竞赛方面留下了不少疏漏和缺陷。而这些缺陷需要国际社会通过对外层空间法的重大修改或重构予以完善。尤其是当外空军备竞赛越演越烈,外空战争日益逼近之时,国际社会应该把通过法律的形式控制外空军备竞赛和防止外空军事化作为最大的时务。

网络空间的全球性、开放性、不确定性和非中心性,使存在于网络空间的网络犯罪对传统的刑事管辖提出了挑战,传统刑事管辖理论似乎难以统领各国网络犯罪管辖实践。对传统刑事管辖理论进行全方位反思,探讨和研究网络犯罪刑事管辖权对理论和实践都具有重要意义。     

Criticism on the urbanized trend of Chinese law research

By referring to the phenomena of the ever intensifying consummation of anti-fake laws resulting in ever increasing inundation of faking cases, this article describes the correlation between the consumers’ rights and the research on Chinese law. It is further pointed out that the relationship between the study of Chinese law and the protection of consumers’ rights typically interprets the difficult situation of Chinese law research: On the one hand, Chinese law does not give the required attention to the protection of consumers’ rights concerning people’s health and life safety. Worse, all the discussions about the issues of consumers’ rights are all oriented on serious urbanization tendency and departmental law science tendency, judging or measuring the concrete realities of consumers’ rights in China based on the concepts of western laws. The specific time-and-space element of China endowing essential meanings in the research of consumers’ rights in Chinese law as the base and evidence of research is eliminated, leaving the research of Chinese law in a distorted position in China. __________ Translated from China Reform, No. 9, 2005

重婚罪是指有配偶而重婚或者明知他人有配偶而与之结婚的行为。重婚行为作为违法行为是否不论情况均构成重婚罪 ?重婚罪有哪些形态 ?“包二奶”等行为可否以重婚罪论处 ?事实重婚中事实标准如何确定 ?以及重婚罪的法律责任有哪些 ?笔者依据相关法律法规及司法解释针对这些热点问题聊以阐述一己之见。     

关于我国物权法中是否规定空间权的思考——兼评《物权法（草案）》中关于空间权的规定

空间权制度的产生是伴随着世界范围内科学技术的发展而产生的.空间权在一定条件下是完全可以单独存在的,它可以是单独的用益物权.创立空间权具有重要的现实和历史意义.我们现在所探讨的空间权实际上应该是指空间利用权.在<物权法>中要以独立的一节集中地规定空间权制度.空间利用权制度应当包括空间利用权的设定及期限;空间利用权的取得;空间利用权的限制;空间利用权的登记;空间利用权的转让、抵押、出租等.     

Mapping Utopias: A Voyage to Placelessness

I have a map which indicates clearly and beyond any doubt the way to Utopia. I start the journey with a survival kit of paradigmatic egalities, noumenal legalities, and nervous ideals. However, the more I move into the uncartographied space, the more I realise that my survival kit is changing, to the point of becoming porous and permeable. The journey to Utopia is condensed to a log of phenomenological bracketing, where the immersion to the Lebenswelt equals the loss of oneself, and where the descent from the Transcendental to the Natural proves to be as meaningful as the escalating bracketing from the Natural to the Transcendental. The negation of Utopia (ou-topos) displaces not only my Utopia but also my egocentric quest for identity: the ‘I’ becomes ‘me’ before it vanishes, space becomes place, intentionality turns back to itself and retraces its path. The more I approach my destination, the more negation devours distance. When I finally arrive to the designated point, where, according to the map, lies Utopia, the only thing I discover is a map, identical to the one I hold, that indicates, clearly and beyond any doubt, the way to Utopia. 随着人们居住空间的日益紧密,由此引发的相邻纠纷案件逐渐增多。如何对这类案件妥善执行,以使居住空间的扩张与反扩张之战能够平息,这已经成为法院执行工作中的一个难题。只有在分析此类案件原因的基础上,采取若干可行的对策,才能有助该类问题的解决。     

The mother's house of the San Francisco Zoo: the art of engendering space in the modern city

The Mother's House of the San Francisco Zoo opened in 1925 as a sanctuary for women visiting the grounds, and in the 1930s, was ornamented through an ambitious decorative program sponsored by the Public Works of Art Project. The program consists of long-overlooked murals painted by Helen Forbes (1891–1945) and Dorothy Pucinelli (1901–1974), and large-scale mosaics executed by the Bruton sisters—Margaret (1894–1983), Esther (1896–1992), and Helen (1898–1985). While the Mother's House could be interpreted as symbolizing a gilded cage that restricted woman's agency within the modern city, it can also be read as expanding women's roles in the public sphere. My article examines the Mother's House as a case study of the gendering of space wherein the site served not to inhibit woman's movement and participation in the modern city, but rather expanded the feminine realm beyond the domestic sphere, as well as supported the professionalization of women as public artists.     

新马克思主义空间批判范式及当代意义

20世纪60年代末兴起的新马克思主义城市学派，以资本主义生产方式分析为主要入口，探讨“空间的生产”在资本主义体系形成和发展中的重要意义。其贡献不仅在于从政治哲学视角揭露当代资本主义的空间政治经济矛盾，把社会关系再生产的故事完整地叙述出来，从而完成了对资本“空间生产”的价值批判；更在于其坚持了解放政治的宏大目标——通过揭示人类社会变迁的空间路径，寻求重新定位“乌托邦想象”的可能性。这种历史唯物主义的空间化努力使马克思主义在新的时代条件下焕发出新的活力，为我们寻求马克思主义政治哲学的“当代出场路径”提供了一种理论启示。
