福利、政府与第三部门——对社会弱势群体权利保护的反思

对社会弱势群体的权利保护关系到福利权制度在我国的建构.福利权的义务主体应当是政府,而不是企业更不是个人.福利权的性质决定了政府应当主动、积极地履行自己的责任,保障福利权的实现.在福利制度的模式选择上,建议我国采取政府支配型的福利多元主义模式.而且,第三郭门的发展在福利制度的建构中越来越扮演重要的角色.     

建立军队科技人才工资体制:一个分析框架

我军高素质才短缺同军队科技人才工资体制的缺陷有关.这种缺陷主要表现在缺乏对军队科技人才工资的制度安排,工资机制方面的责权利关系不对称,工资体例不适应现代市场经济的要求和科技人员的职业特点,工资的人才评价机制和配套性制度相对缺乏.改革工资体制的思路是通过模拟市场功能,建立有计划的军队科技人才工资机制建立军队科技人才属性工资制度;总量控制、结构优化,重视效率工资;制订配套措施,保证军队科技人才工资制度产生好的系统效果.     

UNINTENDED CONSEQUENCES OF BARGAINING FOR ADOPTION ASSISTANCE PAYMENTS

Families that adopt children who are in foster care may receive monthly adoption assistance payments to offset the cost of raising the adopted child. The amount of the adoption assistance payment is the subject of bargaining between the family and the child welfare authority. This article uses a bargaining model to highlight factors that, in addition to the expected costs of raising the child, might influence the outcome of bargaining over adoption assistance payments. Findings indicate that married parents who adopt children already in their care have an advantage in bargaining, and single women who adopt their kin or foster children have a disadvantage in bargaining.     

环境公益诉讼制度实现途径探讨

现代社会环境问题日益严重,侵害环境公益的现象时有发生,但我国相关法律还不健全,很多环境损害问题无法寻求法律救济,在一定程度上影响人类社会与经济的可持续发展,因此有必要借鉴各先进国家的环境公益制度,建立健全我国的环境公益诉讼制度。     

中原行政管理现状分析及法治行政环境的构建

建立精简、高效、负责的法治政府，提高政府公务人员的依法行政意识和行政管理水平，是构建区域发展法治环境的重要方面。目前，中原地区的行政管理及其体制均存在一些缺陷，与中原崛起的要求还存在很大差距。需要我们从政府职能转变、政府行政体制及权力配置改革、机构设置法定化、行政观念转变、加强行政执法等多方面努力，尽快构建推动中原崛起的法治行政环境。     

Towards a new paradigm of the right to self-determination in the world trading system

There has been a shifting meaning of the right to self-determination, since World War Ⅱ, from territorial decolonisation into other meanings such as the right for indigenous people, minorities, ethnics groups and women＇s rights in the territories of independent states. Furthermore, the new phenomenon signifies that it is also used implicitly in the world trading system by states in maintaining their sovereignty from trade liberalization. This has been a dilemma in understanding the right to self-determination within international law. This paper, however, critically evaluates the potential applicability of the right to self-determination in the world trading architecture. It begins by examining the origins, evolution and current struggle to the right to self-determination in the world trading system. It then addresses in General Exceptions, Safeguard Measures and Special and Preferential Treatment as existing and applied principles in the World Trade Organization. It is highlighted that the real world still needs the right to self-determination as a means of struggling for economic justice. The right to self-determination has shifted from the right to transfer territory politically into the right to the transfer of welfare economically and in particular, the right to self-determination of people into the fight to self-determination of states.     

走出福利法治国的困境

西方福利法治国尽管在一定程度上促进了经济增长、社会和谐和政治稳定,但同时也带来了一系列的“福利病”,如不经济性、庞大的政府机构和如牛负重的财政压力等等,并最终导致了福利国危机甚或宪政危机的全面爆发。在“福利国”的反思浪潮中,诺齐克的“最弱意义国家”对抗着罗尔斯的“差别原则”,布坎南的“公共选择理论”回应着马斯格雷夫的“公共财政”学说,但问题的真正破解似乎必须回归自由主义传统,实现税权的有效规范与控制。     

Behavior Process of Child Psychological Abuse and Social Work Intervention Strategy—— A Case Study on Child Abuse

The author of this paper takes a typical practice case, by adopting the theoretical frameworks by APSAC, Glase, and Doyle and Timms, to analyze the abuse behaviors existed in the case, such as abandoning, belittlement, improper treatment, unreasonable emotional response, and confinement, and to look into the psychological abuse process. By employing the case study and child abuse prevention in western countries, and taking into account the independence and intergrowth in psychological abuse process, this paper concludes that the fulfillment of children’s need should be the focus for the overall objective of child abuse prevention, so as to make policies and construct service systems. The main intervention strategy lies in risk factors control, protection factors integration and the construction of the Three-level prevention system. Moreover, classified intervention path ought to be adopted, so as to amplify the advantages of social work in resources integration, relationship coordination and service delivery, accelerate the development of child abuse prevention and build a child-friendly society.     

Youth welfare policy in Turkey in comparative perspective: a case of ‘Denied Youth Citizenship’

This article explores the main characteristics of social and economic policies for young people in Turkey. Inspired by Tom Chevalier’s typology of youth welfare citizenship designed for Western European countries, the article situates Turkey’s youth welfare citizenship model within a comparative perspective and contributes to the extension of Chevalier’s typology to a non-Western European country context. Relying upon the systematic analysis of findings of a nationwide survey on young people that was conducted in 2013, comparative youth statistics, official youth statistics, public expenditures data and existing policy frameworks, the article suggests that Turkey fits well with the denied youth citizenship type in Chevalier’s typology. Two conclusions are drawn with respect to Turkey’s youth welfare citizenship model. First, with respect to the social citizenship dimension, the article finds that social and youth policy structure in Turkey has a familialization effect on young people’s access to income. In terms of economic citizenship, the article suggests that Turkey implements a selective strategy that results in unequal distribution of labour market skills among young people.     

发展城市社区经济的几点思考

社区经济不同于一般经济形态,具有地域性、服务性和多样性的特点。当前我国城市社区经济的发展还处于初级阶段,人们对社区经济的认识还很不够,需要进一步明确以实现社会效益最大化同时兼顾经济效益为社区经济的目标,明确以非政府组织为城市社区经济的主体,同时整合城市社区资源,挖掘社区经济发展的潜力。
