论学校教育中未成年学生的隐私保护

自然人的隐私保护在当前是一个突出的问题,对未成年学生这一群体来讲也是如此,现实生活中,未成年学生的隐私保护体系尚存在缺陷,这种缺陷表现在法律制度、学校教育观念、教育管理模式、社会整体的权利意识等方面,因此,解决未成年学生的隐私保护不仅是一个法律或教育问题,还是一个社会性问题,加强对未成年学生的隐私保护,主要应以素质教育为核心,着眼于学校法治意识、教师素质、以及未成年人自我保护能力提高三个方面。     

对研究型教学法的一种比较研究

文中从教学方法变革的角度将中小学教育与高等教育作一比较研究后发现,中小学变更教学方法的热情高,而高等学校教师探究教学方法的积极性相对较低;以至本应以“研究型”著称的大学其教师在教学中采用“研究型教学”的比率相对低,而“研究”不是其主要任务的中小学反而更普遍地采用了“研究型教学法”。究其原因主要是相比中小学而言,高等学校教师的合格率较低,高等学校研究资源贫乏,大学教育评价机制存在偏差等因素造成。长久以来,中小学教育扮演了中国大学教育质量低下的“替罪羊”。     

Racial and Ethnic Minority High School Students' Perceptions of School Disciplinary Practices: A Look at Some Canadian Findings

This study examined perceptions of differential treatment relating to school disciplinary practices in a racially and ethnically diverse sample (Black, South Asian, Asian, White, and other racial/ethnic background) of high school students (N = 1870). Participants completed detailed individual questionnaires assessing general perceptions of school disciplinary practices and various aspects of the school environment. Results indicated that racial/ethnic minority students are much more likely than White students to perceive discrimination with respect to teacher treatment, school suspension, use of police by school authorities, and police treatment at school. Multivariate analyses revealed that such perceptions are particular strong for Black students. In addition, a number of other variables such as gender, socioeconomic status, age of immigration, and views of school climate also predicted students' perceptions of differential treatment toward members of their racial/ethnic group. The implications of these findings are discussed, and suggestions for future research are outlined.     

批判学派科学哲学的后现代主义意向

批判学派的科学哲学虽然属于前现代科学哲学，但是其中既保留了经典科学哲学的合理内核．又体现了现代科学的时代精神，尤其是包含着诸多后现代科学哲学的成分和要素。逻辑经验论的现代科学哲学忽视了这些后现代主义的思想遗产，而后现代科学哲学又把这些超越时代的睿智恣意夸大，从而走向极端。     

Educational policy of the German Bundesverfassungsgericht

This article analyses the jurisdiction of the German Federal Constitution Court over the basic rights of parents, pupils and private schools and the traditional interpretation of the term “supervision of schools by the state” in Art. 7 para 1 Grundgesetz. The term “school supervision by the state” is traditionally interpretated as the state's absolute rights with regard to organisation, planning, control and supervision of schools. The author argues for a new interpretation to limit such supervision to the question of the legality of school activities. Parents should have a free choice between private and state schools. For this it is necessary to give subsidies to private schools in a way that every pupil can enter a school without differentiation according to the social standards or the income of their parents. With these principles in mind, the German Federal Constitution Court tried in 1987 in exemplary fashion to harmonise the constitutional claim and the constitutional reality. However, its recent decisions cast doubt upon this positive assessment. This revised version was published online in July 2006 with corrections to the Cover Date.

本文认为,《霸言》篇可能是完成于齐襄王时期,而不是“写于田齐强盛之时”;是具有儒家倾向的谋略学说,而不是“齐法家的政治、军事作品”。《五辅》篇可以从一般地定为“作于战国”,进一步确定为作于公元前３１８年至公元前２８３年之间;它不是“齐法家之作”,而是吸收了法家思想的儒家理论。《君臣上》篇不是“齐法家著作”,其主导思想是儒学。《形势解》篇并不是“无疑属于齐法家学派”,而是吸收了法家、道家思想的儒学作品。
