法律语言研究三十年回顾与展望

我国30年的法律语言研究，先后经历了“汉语模式”、“英语模式”和“法学模式”三个时代。虽然存在明显的不足，但成绩是重要的。目前三种研究模式“三足鼎立”．但未来的发展是以“法学模式”引领航向已初现端倪。     

Introduction

John King’s introduction to this section surveys the development of Latin American film studies in the UK over the past 25 years. All three papers explore the interplay between local and global factors in the development of Mexican cinema. Andrea Noble introduces the work of Carlos Monsiváis and discusses the role that early and Golden Age cinema played in the processes of modernisation in Mexico. Carlos Monsiváis pays particular attention to the image of the city in recent Mexican cinema, exploring the use of language and the depiction of sex. Geoffrey Kantaris offers a number of theoretical pathways into an exploration of contemporary cinema in Mexico, analysing how ideas of place and identity are disrupted by the crisis of the nation state in a globalised, postmodern world.

汉英文字笔迹特征的比较研究

目的更深入的了解不同国家、地区,不同文种,不同文化背景下的笔迹鉴定工作者对特定文字笔迹鉴定认识的差别。方法以中英文为例,对汉字和英文的特点和笔迹特征进行比较研究。结论汉英文字的笔迹特征分类体系大体相似,并无质的差别,但是不同文字的特点决定了其笔迹特征取向与侧重、价值评断、个别特征的使用率,以及对同一人笔迹特征多样变化的认识上还是有所区别,各具特色。     

我国西部地区宗教政策法律问题研究

我国西部地区民族问题复杂，宗教派别多，宗教政策得当与否关系到西部地区的发展甚至统一。我国自明清以来已经形成了系统的宗教政策，如何运用政策与法律妥善解决西部地区的宗教和民族问题仍是我们当代急需研究的一项重要课题。     

Metropolitan Governance in Deutschland: Normative,utilitaristische, kommunikative und dramaturgische Steuerungsansätze

Der Aufsatz beschreibt die historische Entwicklung und die jüngsten Formen politischer Steuerungsansätze in sechs westdeutschen Großstadtregionen. Es sind dies die Regionen Hamburg, Bremen, Hannover, Frankfurt, Stuttgart und München. Zu diesem Zweck wird im theoretischen Teil eine zweidimensionale Typologie von Formen der Metropolitan Governance entwickelt. In der ersten Dimension werden Governance‐Formen nach dem Strukturmuster der Interaktion unterschieden, in der zweiten Dimension werden die Governance‐Formen aufgrund der zugrundeliegenden Handlungstheorie (normatives, utilitaristisches, kommunikatives und dramaturgisches Handeln) differenziert. Mit Hilfe der dadurch gewonnenen acht Idealtypen wird im darauf folgenden empirischen Teil gezeigt, dass bis in die 1970er Jahre normative Steuerungsformen die Diskussion beherrschten und diese in den 1980er Jahren durch ein utilitaristisches Paradigma in Frage gestellt wurden. Seit Beginn der 1990er Jahre wurde verstärkt auf kommunikative und dramaturgische Governance‐Formen gesetzt, auf deren Grundlage können sich aber ganz unterschiedliche Governance‐Schwerpunkte und z.T. auch ausdifferenzierte “Governance‐Landschaften” in den verschiedenen Stadtregionen etablieren.     

文化研究中的哲学历史观问题

文化可以从动和静两种形式考察,这相当于老子所谓“履”和“迹”的关系。人类的社会生活实践总是从动的形式转化为静的形式,即从时间形式转化为空间形式。要真正达到文化自觉,不能局限于空间形式的考察,而要坚持唯物史观的实践动态观点。     

法律援助值班律师制度比较研究

法律援助值班律师制度是指由政府出资，法律援助机构指派律师在公安、法院等部门值班，免费为当事人即时提供法律咨询、指导、代理或其他法律服务的司法救济制度。设立法律援助值班律师制度的目的，是为低收入人群提供及时、专业、低成本、高效率的法律援助服务。该制度起源于英国，目前已成为加拿大、澳大利亚、新西兰和我国香港等国家和地区的法律援助制度的重要组成部分。我国还处在试点阶段，与国外值班律师制度相比，在提供服务的即时性和无偿性，服务范围和对象的广泛性以及服务类型的多样性等方面有相同之处，但在制度性质、管理体制、服务场所和对象、服务专业类型与分工、服务便捷程度和制度规范程度等方面都有所不同。     

Water crises: political construction or physical reality?

Various definitions of water crises emerge from epistemic communities deploying a great disparity of methodologies and fundamental hypotheses. Scientists' perceptions of which power structures legitimately carry out water management affect their definition of a crisis, their capacity to ask questions and the manner they formulate them. This determines the stakes and the actors they can observe or the scale of analysis they find relevant. This leads some to recommend a ‘solution’ that appears to be a disaster to others. This article examines how three epistemic communities have each built their science by promoting very specific understandings of what is a water crisis. Proponents of the ‘global water crisis’ spawned Integrated Water Resources Management while proponents of the ‘municipal water crisis’ locked the perception of water equity within the Millennium Development Goals. Researchers on small-scale irrigation and property regimes have often disagreed with such recommendations, often presented as inevitable.     

论侦查学的逻辑起点及其理论演绎

我国侦查学一直没有确立体系构建的逻辑起点,致使学科无法完成理论演绎,形成经验主义特征,缺乏理论价值。侦查学的逻辑起点是对犯罪事实的辩证性质断定所形成的自然属性和社会人文属性二重性命题。侦查学经由逻辑起点展开理论演绎必须解决以下几个问题:确立自然属性研究的基础地位;准确把握社会人文属性研究的维度;构建自然和社会人文属性相融合的理论样态;形成学科理论概念、范畴。
