诗性正义的实现——从刑法学方法论角度探讨

文学作品与刑法学研究的逻辑起点和适用终端均为社会中的人,二者所要面对的问题具有同源性,均为社会制度与人类意志、行为之间无穷尽的矛盾和冲突。面对多样态的矛盾和冲突,刑法以抽象性原则、强制性规范予以调整,而文学却以多元的视角、敏锐的触觉深刻再现了矛盾和冲突的萌芽、发展和激化,着力于探索其形成过程背后深刻的社会背景和历史根源——二者于方法论层面存在者隐性融合和交叉。文学可以将刑事古典学派、规范学派和社会学派的观点有机融合,拓展刑法学研究视野,将刑法学研究进一步推向深层次、广维度。     

构建文学经典在《综合英语》课程教学中的辅助作用

《综合英语》课程的教学过程中师生关注的重点侧重于教材中节选自各种题材或体裁的文本内容,较少涉及英美文学作品本身。而文学经典因其涵盖的丰富内容,在学生语言技能的构建和人文素养的培养过程中应当发挥重要的辅助作用。结合应用学习者自我决定论和合作学习策略,阐释了教师可以在《综合英语》课程的教学过程中取得重构文学经典的助学地位和提高英语专业学生人文素养的双赢效果。     

中国古代判词的法学与文学价值

制作好判词是中国古代为官执政司法的一个重要内容。中国古代的判词发展,不但与古代社会的政治、经济和文化发展、朝代更替有着密切的关系,而且还与中国古代法律儒家化的进程有着密切的联系。判词要进行规范评价、旁征博引,就有一个引经据典的叙事说理过程,从而使判词具有强大的穿透力和不可违拗的说服力。古代判词的价值评价往往通过文情并茂的文学表现形式加以展现出来。对古代优秀判词加以批判地继承和转化,从而将今天的裁判文书写得更加完美,也会有利于今天的法治文化建设。     

近十年国外助推理论研究述评及进展

助推是行为经济学、社会心理学、政治哲学、公共政策学等多领域社会科学的新兴热点交叉议题,自2008年提出后,备受国外学界关注。公众选择不免会落入认知误区,助推以自由父爱主义为精神内核,利用不同选择架构工具推进助推目标,既为公众自由选择提供了选项,又增加了做出“更好的选择”的几率。但不可否认,助推也在伦理道德上饱受质疑。     

From Sarmiento to Borges: The Construction of an Intellectual Lineage in the Magazine Punto de vista under the Argentine Dictatorship

This article analyses the revision of the Argentine intellectual tradition demonstrated in the magazine Punto de vista throughout its first nineteen issues, published during the last Argentine dictatorship (1976–1983). From Sarmiento and the generation of 1837 to Borges and the Sur generation, the reassessment of Argentine intellectuals' legacies set out by editors of Punto de vista was an explicit attempt to insert the magazine into a recognised intellectual lineage. At the same time, it responded to a search for identity prompted by the critical and repressive context in which the magazine was first published.

扬雄《方言》中古鲁国表达"重"之义时使用"锤"这种说法;但今天的鲁西方言中表示"重"的含义已不再用"锤"这个词,而是使用"沉"和"坠"两种说法。那么,"锤""沉""坠"这三个词之间古今有什么样的联系呢?本文将在语音、语义方面,就这三个词的来源以及它们的同源词之间的联系进行引证比较,由文献分析,发现它们之间有必然的联系,是一组古今同义词。     

Generational discourse in urban youth images

The history of generations is often researched in the light of ego-documents, including diaries or letters. These sources of communication between young and old require methods of literary criticism, as this article suggests in exemplary cases. Popular (and in some cases popular forms of learned) literature show how stereotypes dominated letters between Nuremberg fathers and sons fom the 16th century. Reading these letters as witnesses of direct emotional expression, as has been done so far, would be problematic on a theoretical level of the concept of autobiography (according the Ricoeur ‘an other’ of the self), but also an empirical level. Letters were cultural artefacts that were considered well-formed only when they met the standards set by the urban youth image. This included a conglomerate of religious discourses, psychological assumption about the nature of emotions, the urban system of values and honour relating to merchant education more specifically. In letters of this intergenerational context, even information could be put into the context of a situational self-representation of the person writing. Writing a letter as an apprentice or a student was not at all confined to convey factual information. Rather than that, writing letters meant to participate in the generation of norms and to act on a meta-level of communication, as well. Negative images of youth were rhetorically implemented in letters to maintain and reaffirm the hierarchy within the family. Letter exchanges secured economic stability of family firms and the subsequent social rise.     

Open Government: Origin,Development, and Conceptual Perspectives

The term “open government” is frequently used in practice and science. Since President Obama’s Memorandum for the Heads of Executive Departments and Agencies in March 2009, open government has attracted an enormous amount of public attention. It is applied by authors from diverse areas, leading to a very heterogeneous comprehension of the concept. Against this background, this article screens the current open government literature to deduce an integrative definition of open government. Furthermore, this article analyzes the empirical and conceptual literature of open government to deduce an open government framework. In general, this article provides a clear understanding of the open government concept.
