For Better Procuratorial Work to Protect Human Rights

The Chinese Constitution calls for respecting and protecting human rights. And accordingly, people＇s procuratorates across the country take judicial protection of human rights as their primary task. They are contributing to the development of China＇s human rights cause by getting involved in cracking down on crimes in violation of human rights while seeking to improve their own work.     

Progress in Helping Ethnic Minorities

The issue of human rights should be a point of meeting and collaborating among different civilizations rather than a spot for wrangles and tussles. This is the impression people gathered from the Second Beijing Forum on Human Rights,held on Nov. 2-3, 2009. Officials and experts from 26 countries attended the forum in the--nation＇s capital.     

Practice and Model of China＇s Participation in the World＇s Human Rights Development

China started to participate in the world＇s Human Rights （HR） development from the time when it began to reform and open up. The efforts over the past 30 years have made China one of the countries that are the best in respecting and protecting HR in the world. Not only has China made tremendous achievements in HR development but also attained a deeper understanding of HR that transcending ideology and the universal values for the mankind.     

Achievements and Significance of China＇s Human Rights Activities in the World

Toward the end of the 1970s, the United States began to implement its human rights （HR） diplomacy, trying to export its ideology by exercising hegemony as part of the cold war. Under its influence, some other western countries also introduced HR into their bilateral relations. The drastic changes in Eastern Europe and the disintegration of the Soviet Union gave the United States the chance of spearheading its HR attack against China.

For a Legal Guarantee to Improve People＇s Livelihood and Protect Human Rights--Thoughts on policy concerning Social Insurance Law （draft）

The People＇s Republic of China Social Insurance Law （draft） has undergone three readings at the Standing Committee of the National People＇s Congress. The Law, once promulgated, will be of great significance to implementation of the constitutional principle of ＂respecting and protecting human rights.＂ It will help regulate the various social insurance relationships and the rights and obligations of the parties involved.     

联合国人权工作的改革与现状

一、联合国人权工作的改革国际人权保护机制主要包括以《联合国宪章》为基础的机构和国际人权条约机构。联合国的首要目标是维护国际和平与安全,但同时也负有促成经济社会发展与增进全体人类之人权的基本责任和使命。     

中国大学在人权保障和促进中的作用——以武汉大学法学院为例

人权是一个伟大的词汇,也是一项艰巨的事业。从事这项事业,需要不同部门、各行各业共同参与,为之不懈努力。大学因其资源、人才等优势,在人权知识的创新、传播和应用上有着不可替代的功能,在人权研究、人权教育、人权倡导、人权观念的传播和普及等方面可以对人权事业做出卓越的贡献。本文拟以笔者所在的武汉大学法学院为样本,探讨中国大学在人权保障和促进中已经和可能发挥的作用。     

刑事司法中公民的容忍义务及其限度

公民容忍义务源于每个人为求权利和自由需分出部分私权演绎为公权,所有人的付出意味着个人承担的义务比他的需要对应的义务更多,公权是放大了的私权。公民容忍的限度涉及刑事司法人权保障的规则化、伦理化,目前的看法相当暧昧。公民容忍义务具有共识性、比例性、条件性和模糊性四个方面的特征。对公民应当服从的公权力应通过必要性原则、比例原则来制约,找到个人权利与警察权、检察权、司法权的平衡点,以保障公民的人权。
