随着《金融服务行动计划》的实施,四级立法程序的采用,欧盟证券法进入一个崭新的发展时期.在证券市场一体化方面,主要建立了新的统一证券服务经营机构监管制度、证券发行与上市及其信息披露制度以及上市公司要约收购制度;在投资者保护方面,主要建立了新的禁止内幕交易与禁止市场操纵制度、上市公司信息披露制度.这些新制度的确立,标志着新的欧盟证券法律体制的已基本建立起来,欧盟证券市场的一体化进程向前迈了极其重要的一步.  相似文献

Recent research and theory suggest narcissistic features contribute to aggression in adults. The present study examined the association of narcissistic features with aggression and internalizing symptoms in 233 students of 5th–8th grade at three inner-city schools. A factor analysis of the Narcissistic Personality Inventory in this sample revealed three factors: Adaptive Narcissism, Exploitativeness, and Exhibitionism. Regression analyses were used to predict the association of these three narcissistic features with self-, teacher-, and peer-reported aggression and self-reported internalizing symptoms. Results indicate narcissistic exploitativeness positively predicted self-reported proactive aggression, and narcissistic exhibitionism positively predicted internalizing symptoms. Narcissism and self-esteem interacted to predict teacher-reported aggression and self-reported internalizing symptoms. Results are discussed in the context of existing theories of narcissism, threatened egotism, and self-perception bias.  相似文献

ABSTRACT

Neopatrimonialism, according to the distinguished development scholar, Thandika Mkandawire [2015. “Neopatrimonialism and the Political Economy of Economic Performance in Africa: Critical Reflections.” World Politics 67 (3): 563–612], provides the ‘common denominator’ for a host of practices of politics in Africa; viz. patronage, corruption, cronyism, and predation. So deeply embedded is this view among mainstream thinkers, that ‘underneath every policy lurks neopatrimonialism’, that the idea has come to be imbued with the ‘air of irrefutable common sense’. This paper deconstructs common sense refracted through the lens of present-day statecraft and the deceptive and subversive nature of contemporary neoliberal governance. It cautiously outlines the contours of a new common sense, placing emphasis on theorisation, a situated politics, institutional recalibration, fundamental changes in social relations, and the adoption of ‘bad’ and unorthodox development policies.  相似文献

ABSTRACT

Why has the internationally promoted Weberian-style bureaucracy failed to replace patronage as the dominant principle of state organization in post-war Kosovo? This article explores how international actors’ rule-promotion activities and local actors’ strategies of resistance play out and interact to explain the failure. The empirical analysis focuses on rules of recruitment in the civil service system in the period 2000–2016. The analysis juxtaposes two consecutive stages of the state-building process, which are marked by different degrees and forms of international involvement: the pre-independence period, 1999–2008; and post-independence period, 2008–2016. Evidence from the case suggests that during the pre-independence period, legal inconsistencies embedded in the internationally promulgated legislation enabled local actors’ formal and informal strategies to recruit political cronies in the newly created civil service system. The transfer of authority from international administrators to elected local authorities, especially after Kosovo’s declaration of independence in 2008, did not solve the problem of legal inconsistencies, and instead, served to consolidate governing parties’ strategies of control over recruitment in the state bureaucracy. More often than not, patron–client relationships that thrive at the borderline between formality and informality of political behaviour, continued to undermine external rule transfers.  相似文献

This article provides a broad overview of the necessity for and challenges of decolonising universities in South Africa. It situates the student protests for the decolonisation of knowledge within the debates on the African Higher Education landscape, the ideology of Pan-Africanism, and calls for an African Renaissance. The article highlights the context in which the Fallist Movement emerged in South Africa and the demands it articulated. This article questions whether or not the decolonisation of knowledge, and the broader university system, can truly materialise, given the inherent nature and functioning of these institutions and the current practices of decolonising universities. The article argues that to date the decolonisation of universities has largely been ad-hoc, performative, and technical, rather than the sustainable and substantive transformative processes that should be at the heart of any decolonisation project. Furthermore, the article asserts that the universities that we are trying to decolonise are rigged spaces as they have been fashioned in the image of western universities and align with their norms, values, and epistemologies. To break this foundational epistemological and cultural bedrock requires a complete overhaul of the structure, ideology, and functioning of the universities. Without major shifts in the power relations, orientation and forms of knowledge production at these universities, there can be no decolonisation.  相似文献

The debate on the nature of the European Union hasbecome a test case of the kind of political andinstitutional arrangements appropriate in an age ofglobalization. This paper explores three views of theEU. The two main positions that have hithertoconfronted each other appeal to either cosmopolitan orcommunitarian values. Advocates of the former arguefor some form of federal structure in Europe and areconvinced that the sovereignty of the nation statebelongs to the past. Proponents of the latter make acase on both socio-political and normative grounds fora Europe of nations. However a third position,favoured by the authors, is gaining ground. This viewcombines cosmopolitan and communitarian conceptions.It emphasises the mixed nature of the European polityand conceives the constitutionalization process asopen-ended. The paper concludes that from this perspectivea bricoleur's Europe of bits and piecesmay not necessarily lack justification and legitimacy.  相似文献

The Roll Call Vote (RCV) of Members of the European Parliament is a standard data source for modern research into the European Parliament (EP). RCV samples are used in particular to study political group cohesion and the emergence of conflict lines within the EP. Current mainstream research thus treats RCVs as a reliable source of data. But other research exists that questions the suitability of the RCV as a sample that fairly represents the population of EP votes. Specifically, this latter research stream points to the over-representation of non-legislative items over legislative items and to the under-representation (or even complete absence) of some committees. However, these critically oriented studies focus on data that does not take into account changes that have occurred in recent years, after the Treaties of Nice (2001) and Lisbon (2007) came into force in 2003 (Nice) and 2009 (Lisbon). By analysing all votes that took place in 2013, the authors find that the RCV has become a more reliable data source in recent years. The most important difference – that which obtained between legislative and non-legislative issues – has completely vanished and the remaining differences show only a very weak effect. The authors attribute this change to the empowerment of the EP in the legislative arena and the amendment of the Rules of Procedure.  相似文献
