A Paradigm Shift in the Practice of Family Law: A Response to Mosten and Traum

In their article, Interdisciplinary Teamwork in Family Law Practice, Mosten and Traum promote the use of an interdisciplinary, team‐based approach to family law practice. This commentary focuses on the two pronged shift in the current zeitgeist of family law practice. First, Mosten and Traum guide us away from an historically adversarial approach to family law practice, in which attorneys advocate for the legal rights of a single client, to a more holistic approach in which the focus is on the Family Global Case. Furthermore, the push toward Family Global Case shifts the focus away from discrete legal issues associated with reorganization to empowering families to self‐determine through their reorganization. This shift follows the movement in both medicine and mental health away from direct intervention for people with disorders to promoting wellness for at‐risk yet healthy individuals. The second prong of Mosten and Traum's approach is a movement toward more collaborative interdisciplinary functioning. However, the shift in the practice of family law from the sole practitioner working alone to being one member of a broader multidisciplinary team focusing on the future well‐being of the family brings with it not only issues of professional role definitions but also the development of a new combined set of ethics and models for training. These are discussed in detail.     

Interlocal collaboration and local climate protection

ABSTRACT

The influences of state government have been curiously absent from most studies of collaboration among cities. Extant research on city collaboration which promotes on climate and environmental sustainability issues focuses primarily on local-level institutions, politics, and processes. Thus, the role of states to constrain or facilitate collaboration among local governments needs to be more fully accounted for. Building on transaction cost and institutional collective action theory and drawing on data from a national survey of US cities, we investigate the influences of city-level factors together with the hierarchical effects of state rules and policies on the extent to which mechanisms for interlocal collaboration are employed in pursuing climate protection and renewable energy development goals. The results confirm predictions that multilevel intergovernmental forces influence the extent to which cities collaborate. These results have both theoretical and practical implications for understanding interlocal collaborations.     

论公司、企业人员受贿犯罪主体的立法完善

《刑法》第163条规定了公司、企业人员受贿罪,但这一规定,仅将犯罪主体规定为公司、企业的工作人员,而没有将其他单位的人员包括在内,因此会导致非公司、企业的单位人员利用职务上的便利收受贿赂的行为无法处理。这一漏洞需要通过修改《刑法》对公司、企业受贿罪的规定,扩大其犯罪主体的范围来解决。

经济全球化给各国特别是发展中国家带来社会不稳定因素,随着人重新"回归社区",也把不稳定因素带入了社区.社区服务多元化和服务水平的提升,能增强社区人的认同感、归属感,是社会稳定、发展的"安全阀".在现代社区服务中要增强社区助老、就业、文化、信息服务功能,并倡导志愿者精神和社会中间组织.     

Palestinian and Israeli Cooperation in Environmental Work During the “Peace Era”

This article presents a report summarizing a pilot study conducted by the Israeli-Palestinian research team of the Peace Research Institute in the Middle East (PRIME). Sixteen Israeli and twelve Palestinian non-governmental organizations (NGOs) that were engaged in cooperative work were analyzed to measure the degree of their effectiveness in their societies, and obstacles encountered in their cooperative work. In addition, this report presents these NGOs' interpretation of the causes of environmental damage and its connection to the Israeli-Palestinian conflict. NGOs data were collected from field interviews, their publications, and web sites. Results showed that while the Israeli and Palestinian NGOs agreed that joint work is needed to address ecological problems, they differed in their reasons for working together. This difference also appeared in their interpretation of the sources of environmental deterioration, relationship of the political conflict to the state of the environment, and the effect of the peace process on solving ecological problems. At the end, it was concluded that environmental narratives of both sides differ greatly, and that the establishment of a culture of peace is a protracted process.     

代位诉讼中的适格当事人研究

理论上之所以对代位诉讼存在着诸多分歧,是因为没有廓清代位诉讼的真正含义,本文采用的纯粹代位诉讼这一概念实际是本质意义上的代位诉讼。代位诉讼的当事人适格的基础是法定的纠纷管理权;债务人作为无独立请求权第三人参加诉讼;诉讼标的是债务人与次债务人之间的法律关系;债务人受既判力的拘束,既判力的客观范围是债务人与次债务人之间的法律关系,关于代位权存否则适用“争点效”理论。     

我国民事审判"终审不终"的法社会学视角

入世后的中国民事审判试图根治"终审不终"的沉疴,其病因不能只从字面的法律规定方面探寻,影响法律运行的诉讼观念和法治生态等法社会学因素同样不可忽视.对"有错必纠"和"以事实为根据"等原则的"消化不良"是程序安定和诉讼风险意识缺失的病根,现行民事审判监督程序的结构缺陷及其在社会生活中的运行失范则是"终审不终"的表征和并发.

略论侦查完美主义

侦查完美主义是侦查的理想状态。它的理论前提是国家赔偿制度、侦查法制化和侦查效益论;它注重侦查前周密策划,但又不排除侦查时随机应变;它主要体现在适当完美的侦查目标、完美的侦查人员、完美的侦查时空、对“可能”与“细节”的把握、取得最佳连锁反应、巧妙衔接侦查手段等方面。侦查完美主义必然由于侦查方的素质与犯罪的隐蔽,时间推移下的情况不断变化等因素而受到限制。
