Articulating the threatened suffragette body: suffragette embroidered cloths worked in Holloway Prison, 1911–1912

ABSTRACT

In public archives there are a number of hand-embroidered cloths worked by suffragettes incarcerated in Holloway Prison between 1911 and 1912. Denied political status, some of the embroiderers used the hunger strike as a political tool and were forcibly fed. In this paper the embroideries are reframed as material and discursive evidence of suffragette prison experiences. The material narratives of the embroidered cloths are traced, drawing on a dialogue between critical theory, material object enquiry, practice as research and the work of contemporary textile practitioners. Embroidering by suffragettes is explored as an embodied and situated ‘thread act’ that materialised the making of networks, the need for protection of the body and mind, the powers and dangers of boundary crossing, and proto-political thinking.     

同种数罪处罚原则新说

数罪并罚问题无论是在刑法学理论上还是在司法实务中都是一个非常重要的问题 ,而同种数罪该不该实行并罚更是刑法学领域争论的焦点之一。目前 ,在司法实务中 ,大多是把其作为一罪从重处罚的。笔者认为 :同种数罪也是数罪 ,将其实行并罚制更有利于打击犯罪、体现罪刑相适应的原则 ,从立法技术的角度来看也更具科学性。

警察作为证人出庭作证在国外十分普遍,然而我国一直将警察排除在证人之外,警察出庭作证少之又少。我国警察应当出庭作证,但应限制在特定范围之内。在目前情况下,警察出庭作证还存在较大障碍,这恰恰是我国刑事司法改革之所在。

中国目前的贫困问题是经济发展问题和收入分配问题的综合表现.收入分配问题主要体现在以下三个层面:区域之间的收入分配公平问题;城乡之间的收入分配公平问题;不同收入阶层之间的收入分配公平问题.我国不公平的资源所有权格局引起了收入不公平的分配.解决收入分配涉及市场经济体制和政府对社会财富的分配体制两大类.必须把"统筹"作为解决收入分配问题的着力点.     

论医疗事故罪的主体

医疗事故罪是新刑法增加的一种犯罪,自规定后争议一直颇大,特别是医疗事故罪的主体范围问题。医疗事故罪主体除了医务人员外,实习人员、医疗单位中从事行政管理、后勤服务等非医疗工作的人员在特定情况下也能成为本罪主体,但是单位不能成为本罪的主体。     

私人侦探及其调查行为的合法性

我国现阶段存在的所谓的私人侦探及其调查行为不具有合法性。针对目前中国社会中出现的公民私人信息调查的需要,现阶段比较稳妥的做法是不断完善公力救济、适度私力救济。公民群体在追求自身权益保障的同时,要切实树立法律至上的观念,严格遵守相关的法律规定,培养法律意识,促动法治的健康发展,使中国的法治由理想变为现实。     

苏轼“以议论为诗”论

苏轼“以议论为诗”的创作实践不但遵循艺术创作思维规律 ,还符合艺术创作的本质 ,开拓了宋诗新体制。苏轼的创作实践检验了“以议论为诗”价值的深远性。尽管成就中有缺陷 ,但掩不住它的整体光辉。苏轼站在盛唐诗的顶端 ,发展了宋诗新体制 ,对后世诗歌产生了巨大影响     

从旭普林公司案看我国法院对国际商事仲裁的监督

运用国际商事仲裁的一般理论和国际商事仲裁立法与实践,结合我国法院就国际商会国际仲裁院仲裁庭根据该院仲裁规则就德国旭普林公司案在我国上海作出的仲裁裁决所实施的司法监督,探讨了国际商事仲裁裁决与涉外裁决、外国裁决和《纽约公约》项下的非本国裁决之间的联系与区别。由此认为本案项下的裁决,既不是我国裁决,也不是外国裁决,而是《纽约公约》项下的非内(本)国裁决。     

Writing,Space and Authority: Producing and Critiquing Settler Jurisdiction in Western Australia

On the edge of Stirling Gardens in central Perth, Western Australia, five large, old-fashioned pen nibs stand in a curved line, their tips in the ground. Anne Neil’s sculpture, Memory Markers, commemorates the history of this site, which includes the Supreme Court. Taking this sculpture as an emblem of writing, which in the context of its setting highlights the relationship between literature and law, this article explores the image of the pen in the ground. As a symbol of literacy, it evokes the powerful network of discourses—particularly law, science and religion—that underwrote the imperial project. It signals, in Michele Grossman’s terms, “the event of literacy [that] radically interrupts and disrupts—but never eliminates—pre-existing Aboriginal epistemologies”. The article goes on to explore the sculpture as a symbol of the assertion of jurisdiction, the speaking of law in and over colonised space. It analyses a group of written texts associated with this site, from colonial legal assertions of jurisdiction over Aboriginal people in Edward Landor’s The Bushman (1847), through a proclamation under the Aborigines Act 1905 (WA), to Stephen Kinnane’s Indigenous family memoir of life under that act, Shadow Lines (2004).
