中央银行独立性主要是指中央银行制定和执行货币政策的自主性,是中央银行法律地位的核心问题。人民银行独立性不断增强是我国中央银行法律制度建立健全的重要趋势特征。2003年修正的《人民银行法》第2、5、11、12、29、30及38条是目前人民银行独立性的主要法律规范。分析人民银行的独立性,除法律条文的文义性辨析外,还应当探求条文的历史与现实,并在人民银行实际独立性的基础上,进行有关制度重新设计。  相似文献

This paper discusses the Global Environment Facility (GEF) and its achievements and challenges in China, the country obtaining most GEF support. This paper relies on Chinese perceptions, and less on views from the implementing agencies (IAs), the World Bank, UNDP and UNEP. Most attention is given to climate change and biodiversity. The paper asks what has been achieved; how effective has the GEF been? The study concludes that GEF funding has been important for China’s environmental problems. GEF and its IAs have contributed to raised awareness and technology development and have boosted institutional capacity through participation in project activities and training. The main emphasis has been placed on climate change projects and less on biodiversity. Much has been achieved by the GEF in China, but challenges exist. At the international level, the interests and roles of the GEF system, its IAs and recipient countries are not always compatible. GEF projects may suffer as a consequence. Another challenge relates to the seeming difference in effectiveness between World Bank projects and projects of the other IAs. Domestic challenges concern turf battles, problems related to information sharing, and different priorities among actors. The various government institutions’ reluctance to co-operate impacts significantly on the performance of GEF projects in China. The IAs should insist on smoother collaboration, and force the institutions to work together. Moreover, severe problems are apparent regarding financing as well as application procedures. Improvements are under way regarding the GEF application procedures. This will have a limited impact unless the Chinese side simplifies and improves procedures.  相似文献

The Multilateral Environmental Agreements (MEAs) concluded during the past decades have established complex interlinkages between the institutions established by MEAs and institutions such as UNEP, UNDP and the World Bank and the funds administered by the Bank, in particular the GEF. Questions regarding the effectiveness and legitimacy of this system of global environmental governance have arisen both in practice and in research. This essay explores the manner in which these questions have arisen, how they have been addressed in recent research and provides the context for the subsequent contributions to this special issue. 世界银行等国际金融组织在其项目贷款守则中已将是否进行环境影响评价程序作为其项目可贷性的前提条件,中国作为世行的最大受惠国,应该加强对国际项目融资中环境影响评价制度的研究.本文从多方面论证了二者存在的实质性联系,从风险均衡的角度提出了推行环评审查法人负责制的必要性,认为中国的银行在其贷款守则中应考虑将环评程序纳入项目可贷性的内容并确保当事人诉诸法律,对特定事项请求司法审查权利的实现.  相似文献

The Grameen Bank in Bangladesh has become an international model for microcredit as a poverty alleviation strategy. The purpose of this paper is twofold: to evaluate the Grameen Bank as a strategy for empowering and improving the socioeconomic status of women in Bangladesh, and to identify lessons from the Grameen Bank experience that can inform development policy more generally. Arguments for and against Grameen Bank are evaluated in the light of evidence from studies of the Bank and knowledge of women and development. The conclusions that are drawn from this evaluation are that Grameen Bank is not a panacea for poverty alleviation and improving women's lives, that it has increased the income of borrowers, has led to improvements in specific aspects of their lives, and that it has potential if used in conjunction with other progressive social and economic policies to contribute to long-term, sustainable, progressive social change.  相似文献

India has been the highest recipient of workers’ remittances for the past several years. Remittances have had a multiplier effect on the Indian economy and have played a crucial role in the economies of several Indian states like Kerala, Goa, Punjab and Gujarat. However, the absence of a coherent policy framework on dealing with these remittances has not only impeded their optimum utilisation but also led to certain negative impacts in India. If harnessed productively, through institutional backing, remittances can actually become viable instruments for creating alternative livelihoods and sustainable development in the rural areas of the country.  相似文献

Does World Bank aid to countries damaged by civil conflict meet its stated goals of speeding economic recovery and reducing the risk of conflict recidivism? We contend that the Bank’s success depends on its ability to bolster and signal the credibility of politicians’ commitments to peaceful politics and tailor its programs to the post-conflict environment. In the first systematic evaluation of World Bank post-conflict assistance, we estimate selection-corrected event history models of the effect of Bank programs on recovery and recurrence using an original dataset of all World Bank programs in post-conflict environments. Among key results, we find that the Bank tends to select aid recipients according to their pre-existing probability of conflict recurrence and that, once we control for this non-random selection, the Bank has no systematic effect on either conflict recurrence or economic recovery.  相似文献

Dynamic latent trait models combine information from a variety of manifest variables, possibly measured on different scales, that are presumed to be indicators of an unobserved latent phenomenon, while allowing appropriate consideration of the longitudinal character of time series. I use a Bayesian dynamic latent trait model of banking sector financial accounts measured at the country/quarter level to build an indicator of banking system robustness in Latin America. As a methodological innovation, I extend dynamic latent trait models to take into account country-specific effects of bank regulatory regimes through hierarchical modeling of factor loadings. I suggest how these models can be applied to other types of phenomena—for example to combine existing political regime indicators to build a more informative measure of democracy.  相似文献
