存车收费合同之法律界定

存车收费的法律性质是属于保管合同还是车位租赁合同在我国目前的立法上没有明确的规定。但随着社会经济的发展和私车拥有率的提高,这一问题的重要性日益突出。对这一法律关系的认定直接关系到司法实践中当事人责任和权利义务的划分。本文从这一法律关系的性质、特征、当事人的真实意思和约定的习惯等方面入手进行分析,并结合理论和司法实践中对此存在的争议。旗帜鲜明的提出了自己的观点和看法：“存车收费应定性为保管合同。”以期对司法实践中因这一问题的不确定所带来的混乱有所裨益。     

试论破坏选举罪适用范围之扩展

民主选举是社会主义民主的重要体现和保障，现实中破坏选举的行为层出不穷。而破坏选举罪适用范围上过于狭窄，致使不少严重危害行为置于刑法的射程之外。因此，应将破坏选举罪适用范围扩展到相当范围的政治性选举活动，具体到我国，应包涵基层群众自治组织选举、中国共产党党内选举、人民政治协商会议选举、各级人大代表法律议案表决活动等国家政治生活中重要的选举。     

Is there a relationship between election outcomes and perceptions of personal economic well-being? A test using post-election economic expectations

Do individuals believe that an election victory by their favored candidate will improve their personal economic well-being? Previous work has either adopted an approach that is not well suited to determining this relationship, or ignored this question to focus on perceptions of macroeconomic conditions. In this paper we adopt a new approach that allows us to determine the relationship individuals perceive between elections and personal economic welfare, examining the relationship between vote choice, the election outcome, and post-election expectations for personal economic well-being. We find that economic individualism plays an important role in shaping the relationship individuals perceive between election outcomes and their personal economic well-being. Individuals who reject economic individualism do perceive a relationship, with those viewing an election outcome as favorable more optimistic in their expectations for personal economic well-being than those who view the election outcome as unfavorable. Conversely, election outcomes do not influence the expectations of economic individualists.

论文分析2020年台湾地区“二合一”选举结果及其对政党政治的影响。根据2016年以来三次选举中不同政党得票情况的起伏变化,观察“蓝、绿”和南北政治光谱的周期性变化规律,评估政党内部因素和外部环境对岛内选举结果的短期效应和长期影响,进而展望台湾政党政治的未来发展趋势。     

‘Get Brexit Done’: The New Political Divides of England and Wales at the 2019 Election

This article analyses the successful Conservative election campaign of 2019 and how it took advantage of a fractured political and economic landscape. It reviews the unique circumstances around the 2019 election and the ‘surprising death’ of a no-deal Brexit. We then analyse the divergent political communication strategies in the 2017 and 2019 Conservative campaigns showing how the latter was much more coherent and politically unorthodox. Drawing on socioeconomic, demographic and British Election Study data, we argue that Boris Johnson’s messaging was carefully tailored towards the demands of voters in the ‘red wall’ seats. Conservative success was built around an appeal to voters in these economically depressed ‘geographies of discontent’. But while tremendously successful, the coalition this created is potentially fragile. An unconventional, ‘leftish’ Conservative campaign built a new, diverse bloc of voters. It includes a number of left-wingers expecting change alongside traditional Conservative supporters, and will be hard to keep together given the economic turbulence ahead.     

L'impact du mode de scrutin sur l'élection des femmes à l'Assemblée fédérale Suisse (1995‐2003)

Cet article analyse l'impact du système électoral sur l'élection des femmes à l'Assemblée fédérale (1995‐2003). La littérature a souvent mis l'accent sur l'importance du système proportionnel en vue de l'amélioration de la représentation des femmes au Parlement en se concentrant souvent uniquement sur le taux de femmes élues. Dans cet article, nous argumentons qu'il est nécessaire d'étudier les trajectoires des candidats et de prendre en compte à la fois les candidats hommes et femmes. Nous montrons que l'effet women‐friendly du système proportionnel au Conseil national semble davantage jouer au niveau de la stratégie de désignation des candidats et des candidates que lors de leur élection, et ce particulièrement pour les partis politiques du centre et de droite.     

储蓄存款被冒领后的相关法律问题探析

我国现行的合同法对于储蓄合同没有专门的规定,储蓄合同应该作为一种无名合同来处理。在储蓄存款被冒领的情况下,存款的所有权应该认定已经转移给了银行。在储户对银行的民事诉讼中,不应当适用《最高人民法院关于在审理经济纠纷案件中涉及经济犯罪嫌疑若干问题的规定》中的“先刑后民”的原则。

侵占罪的构成必须具备四个要件 ,即犯罪客体是公私财物的所有权 ;客观方面表现为非法占有他人财物 ,数额较大 ,拒不退还或者拒不交出的行为 ;犯罪主体为达到法定刑事责任年龄 ,具有法定刑事责任能力的自然人 ;主观方面是故意的 ,并且具有非法占有的目的。侵占罪的犯罪对象较为复杂 ,即行为人代为保管的他人财物、他人的遗忘物或埋藏物
