国资委的出现意味着我国国有资产管理体制的重大变革.在"管资产和管人、管事相结合"原则指导下的国资委肩负重任."管人"是该原则的核心所在,"管资产"、"管事"都是通过"管人"来实现的.但国资委如何行使"管人"职责使其在监管国有资产运营时既到位又不越位是值得深思的问题.本文拟从国资委"管人"职责定位出发,在分析借鉴国际经验的基础上对国资委的"管人"职责提出了几点参考性建议.  相似文献

In 2004, the U.K. parliament passed the Civil Partnership Act which provides a scheme to enable same-sex couples to obtain formal recognition of their relationships through the registration of a civil partnership. When the Civil Partnership Bill was making its way through parliament, attempts were made in the House of Lords to derail the Bill through amendments seeking to extend the Bill to certain familial relationships of care and support. In order to counter these attempts and to facilitate the removal of the amendments, the government gave the assurance that the matter of the economically vulnerable cohabitant would be referred back to the Law Commission for England and Wales for review. Consequently, in July 2005, the Law Commission commenced its project on cohabitation. This paper seeks to examine models of reform (such as the one proposed by the Law Society of England and Wales in its 2002 Cohabitation report) as well as those introduced in other Commonwealth countries. The aim is to identify some of the crucial questions that the Law Commission will need to give careful consideration to if they are to make recommendations that will provide a more radical approach to this area of the law, rather than adopt the more conservative approach of including cohabitation in ‘piggy back’ mode on the marriage model.  相似文献

ABSTRACT

European integration has added an extra dimension to the perceived crisis of contemporary democracy. Many observers argue that the allocation of decision-making powers beyond the nation state bears the risk of hollowing out the institutional mechanisms of democratic accountability. In EU governance, the Commission has emerged as a particularly active and imaginative actor promoting EU–society relations, and it has done so with the explicit desire to improve the democratic legitimacy of the EU. However, assumptions concerning the societal prerequisites of a working democracy differ with the normative theory of democracy employed. Therefore, expectations concerning the beneficial effect of institutional reforms such as the European Commission's new governance strategy, which was launched at the beginning of the century, vary according to normative standards set by different theories of democracy on the one hand and to the confidence in the malleability of society on the other. Our contribution seeks to pave a way for the systematic assessment of the democratic potential of the European Commission's consultation regime. To this purpose, two alternative theoretical conceptions that link participation to democracy will be presented. A list of criteria for both conceptions that enable us to empirically assess the democratic potential of the EU Commission's participatory strategy will then be presented.  相似文献

This paper assesses the performance of Mexican electoral authorities during the 2012 presidential campaigns concerning citizens’ right of information. By means of a theoretical review of the concepts of freedom of speech and right of information a case is made for the necessary complementarity and interdependence of both concepts. The paper explores the approach that electoral authorities adopted on three different spheres, namely, the “suggested guidelines” that were submitted to radio and television agencies for the coverage of electoral campaigns; the monitoring of campaigns coverage by radio and TV news broadcasts; and the organization and promotion of electoral debates among Mexico’s presidential candidates. This review reveals a considerable clash between theory and the ife’s and tepjf’s practices. The paper closes with some general remarks on freedom of speech and the role of electoral bodies in Mexican politics, as well as with a proposal of various reforms that could reinforce freedom of speech and the right of information in the coming electoral campaigns.  相似文献

The electoral system has often been considered an important determinant of the political stability that the Federal Republic of Germany has enjoyed in the half-century of its existence, so that it has been often indicated as a 'model' for electoral reforms in other democracies. The analysis of the political impact of the German electoral system after 1949 shows that such impact was different in the different phases of evolution of the party system. In the 1950s, the German party system was characterised by a higher level of fractionalisation, which the electoral system contributed progressively to reduce. That phase was followed by 30 years of concentration and defractionalisation of the vote. In the last decade, the post-reunification party system presents again higher electoral fractionalisation, which the electoral system has partially reduced in the vote-seats translation. In the current political contingency it is doubtful, however, that the electoral system by itself can contain fragmentation on a durable basis.  相似文献

Political behavior has been changing all over Western Europe and electoral volatility is one of the facets of politics in which this change is apparent. Theories on stabilization of political attitudes and behavior in lifetime and the slow rate at which change in the electoral arena is found to proceed, have led to the assumption of generational replacement as the mechanism driving change. The Netherlands, however, provide a remarkably different case of this trend in electoral volatility. The country has shifted from an example of how cleavages stabilize politics to one of the most electorally volatile countries in Europe. The Dutch surge in electoral volatility thus contrasts with expectations of a slow process driven by generational replacement. Starting from this apparent contradiction between the evolution of volatility in the Netherlands and theories on generational replacement, this article investigates time effects of electoral volatility. The study is based on an age, period and cohort analysis on the repeated cross-sectional data of the Dutch Parliamentary Election Studies, 1971–2010. Based on characteristics of such repeated cross-sectional data, individuals are cross-classified in birth cohorts and election years respectively, which overcomes the identification problem inherent in cohort analyses. Results of a Cross-Classified Random Effects Model (CCREM) indicate that, contrary to the hypothesis of new generations causing the increase in volatility, the Dutch change can be attributed primarily to period effects. As such, the analyses indicate that a general shift in the Dutch electorate has caused the growth in volatility and that supply-side factors should probably be analyzed when trying to explain electoral volatility.  相似文献

The UK's second nationwide referendum, held in May 2011, offers rich opportunities for analysing the dynamics of a referendum campaign. The articles gathered together in this symposium address three themes. The first concerns the determinants and dynamics of public opinion during a referendum campaign, the second relates to the potential for interaction between the referendum and simultaneous elections, and the third focuses on coverage of the referendum in the media. Following a brief outline of the background to the referendum, this paper introduces the contribution that each article makes to these themes.  相似文献

In democracies, a constant tension exists between the stability and integrity of the community as a whole, and the desire to ensure minorities a voice in politics. Reserved seats and reduced thresholds are two common means by which ethnic minorities gain legislative seats, though little or no empirical work exists testing their efficacy in this regard. Combining multivariate analysis with in-depth case studies, this article shows that both reserved seats and lower thresholds increase minority representation, though reserved seats accomplish that goal more consistently. Reduced thresholds tend to increase the share of votes and seats won by ethnoregional parties but reserved seats do not. Additionally, Mauritius' unusual best-loser system aids both minorities and ethnoregional parties.  相似文献

Propensity-to-vote (PTV) scores are ever more commonly used in electoral research as a measure of electoral utilities. Yet a growing literature employs them as dependent variable in the voting equation in place of the lower information granted by vote recall questions. However, this choice can be seen as problematic because of the very structure of election survey research. To the extent that voters' PTVs are measured in post-election surveys (as it is often the case) these are likely to result endogenously produced by actual voting behavior in the past election – thus partly undermining the validity of the PTV question which, ideally, should not be related to any specific election. In this paper, we try to disentangle the relationship between short-term political attitudes (leader evaluations, issue proximity, economic assessments) and voters' changing patterns of propensities to vote in both an electoral and a non-electoral context. The latter scenario serves as a means to rule out the potentially contaminating effect of voting choices on voters' PTVs. The data comes from two panel surveys of Italian voters conducted by ITANES in occasion of the 2006 general election, and in 2011 (that is, in a non-electoral year) respectively.  相似文献
