Fiscal Federalism and International Capital: The Effects of Fiscal Federalism on Foreign Direct Investment and Sovereign Dept Ratings

Although the study of federalism has become one of the most intensely studied areas in economics and political science, no consensus has emerged on the impact of fiscal federalism on macroeconomic performance. I focus on one specific element of the debate‐ the role of fiscally federal institutions in allowing a country access to international capital markets. In an empirical analysis of 60 countries from 1975‐1995 I find fiscal federalism has no clear impact on inflows of foreign direct investment. In an examination of the impact of federalism on sovereign debt ratings for 40 countries from 1980‐1998, I find that fiscal federalism is associated with lower levels of sovereign debt risk.

Viorel Virgil Tilea and the Origins of the Second World War: An Essay in Closure

The 'Tilea Affair' of March 1939 is among the most contentious of the short-term events leading to the Second World War. V.V. Tilea, the Romanian minister in London, brought information to the British Foreign Office, about an alleged German threat to his country. The guarantee to Poland soon followed and, in turn, the outbreak of the war. This article examines the evidence offered by contemporary British witnesses, the ensuing historical controversy - bringing to bear a variety of new revelations, including materials derived from the author's acquaintance with Tilea - and the present state of historical knowledge. It concludes that closure can be applied to most aspects of the 'Tilea Affair'.     

Was There a Clinton Doctrine? President Clinton's Foreign Policy Reconsidered

This article discusses the concept of 'doctrine' within American foreign policy and seeks to locate a possible Clinton Doctrine. It argues, against some interpretations of the Clinton presidency, that Clinton's foreign policy did have a degree of coherence necessary to sustain a 'doctrine'. The broad development of Clinton's foreign policy between 1993 and 2001 is summarized and assessed. Five possible Clinton doctrines are investigated. The article concludes that the best case for being regarded as the Clinton Doctrine relates to the doctrine of 'rogue states'.

后军人时代缅甸的“双头政治”及其外交影响

缅甸进入后军人时代后,国内呈现由军人集团和文官政府组成的"双头政治"权力格局,这种格局是前军人集团政治设计的结果,对现在缅甸的外交政策有很大影响。在外交政策的制定、落实和应对国际压力的过程中,"双头政治"的博弈因少数民族的政治参与而变得更加复杂,体现为军人、文官政府和少数民族的"三方博弈"。在缅北民族和解进程中,各方政治力量的博弈使得缅甸陷入既需要外部帮助斡旋而又让外部难以有效参与的困境。在中资大项目问题上,这些博弈导致缅甸对华政策出现"依赖"与"反依赖"纠葛,而中缅关系无法有效推进的局面。在若开罗兴亚人问题上,各方博弈更使缅甸陷入国际道义、政治与法律围攻的窘境。究其根本,缅甸仍停留在"求稳定"与"求发展"的初级阶段,而国内长期存在的政治认同分歧与族群割裂,使其在后军人时代可能进入另一个"乱局"。军人势力仍然强大、文官政权软弱、少数民族各自进行不同程度的国际动员,各方"自助"而"不得助"的客观形势,使得民盟政府初期良好的外交环境日益恶劣。因国内政治而不断引发外交危机,缅甸孜孜以求的独立自主、中立主义和韧性外交受到极大影响,缅甸的复兴梦与发展梦未有穷期。     

东盟5国汇率制度新探

自2005年马来西亚汇率制度改革以来，东盟5国均转向浮动类型的汇率制度。各国货币延续之前缓慢升值态势直到2008年全球经济危机爆发。在应对危机以及危机前后本币持续升值的走势中，东盟5国汇率制度产生了新的特征，本文分析其利弊及对中国汇率制度改革的启示。     

从Petrobras案看美国《反海外腐败法》的域外管辖问题

Petrobras案反映了美国《反海外腐败法》(FCPA)的域外管辖权存在合理性的问题。通过回顾该法的立法历史和研究其条款的规定,分析FCPA针对外国公司的典型案例,表明美国FCPA执法机构宽泛地解释法律,借助微弱的连接点,扩大FCPA域外管辖权的行使范围。这既与美国国内法和司法实践中确定行使域外管辖权的合理性平衡检验标准不一致,同时也不符合《经合组织公约》和习惯国际法规则的要求。究其实质,美国《反海外腐败法》一方面为国际社会治理跨国贿赂提供了国际公共产品,另一方面也在维护了美国和美国公司的利益,收取额外的霸权收益。
