全国外国法制史研究会第十八届年会综述

就2005年8月在西宁市召开的全国外国法制史研究会第十八届年会上与会学者就其中心议题“20世纪外国刑事法律的理论与实践”提交的一些重要论文及就此展开的学术讨论进行了概括性和综合性的介绍。     

A 26plex Autosomal STR Assay to Aid Human Identity Testing*†

Abstract: A short tandem repeat multiplex assay has been successfully developed with 25 autosomal loci plus the sex‐typing locus amelogenin for a total of 26 amplified products in a single reaction. Primers for the loci were designed so that all of the amplicons present were distributed from 65 base pairs (bp) to less than 400 bp within a five‐dye chemistry design with the fifth dye reserved for the sizing standard. A multiplex design strategy was developed to overcome challenges encountered in creating this assay. The limits of the multiplex were tested, resulting in the successful amplification of a wide range of genomic DNA sample concentrations from 2 ng to as low as 100 pg with 30 cycles of PCR. The 26plex has the potential to benefit the forensic community for reference sample testing and complex relationship evaluation.     

Dienstleistungsrichtlinie und Immobilienwirtschaft

Die Dienstleistungsrichtlinie (RL 2006/123/EG des Europ?ischen Parlaments und des Rates, vom 12. 12. 2006, über Dienstleistungen im Binnenmarkt, ABl L 376/36), die bis 28. 12. 2009 von den Mitgliedsstaaten der EU umzusetzen ist, hat neben ihrem arbeitsrechtlichen Schwerpunkt auch Auswirkungen auf die Immobilienwirtschaft sowie deren rechtliche Rahmenbedingungen. ?sterreich hat durch eine Novelle der GewO 1994 einen der wichtigsten Punkte der DL-RL, n?mlich die obligatorische Berufshaftpflichtversicherung der Immobilientreuh?nder – Nachweis dieser Versicherung bis sp?testens 27. 8. 2008 – bereits umgesetzt. Angesichts verschiedener Vorbehalte bleibt allerdings die Integrationswirkung der DL-RL hin zu einer Europ?isierung des gesamten Wohn- und Immobilienrechts in absehbarer Zeit beschr?nkt.     

用Sep—Pak C18固相萃取柱快速提取净化氨基甲酸酯类农药

本文介绍了一种应用Sep—Pak C_(18)固相萃取柱从各类生物检材中快速提取净化9种氨基甲酸酯类农药的方法,并用大口径毛细管气相色谱进行分析。9种药物包括:速灭威、叶蝉散、灭多虫、灭除威、灭杀威、残杀威、巴沙、呋喃丹、西维因。萃取前,水基质检材用蒸馏水稀释;脏器检材加0.4N高氯酸溶液。用3ml氯仿/异丙醇(9:1)洗脱药物。水基质检材的回收率(尿、血浆、全血)在80—100％之间;脏器检材的回收率(肝、肾、脑)在66—100％之间。Sep—Pak C_(18)小柱用于尿和血浆样品时可反复使用。     

船舶保险条款中的恐怖活动风险

本文扼要介绍“9.11恐怖袭击事件”后船舶保赔保险战争险除外条款及特别保赔保险战争险(SPECIAL P＆I WAR RISKS COVER)的变化,阐明了船舶所有人在市场上安排保赔保险战争险的必要性。     

国家级科技企业孵化器的时空特征及影响因素

该文运用点密度渲染、全局自相关分析和地理探测器方法对中国国家级科技企业孵化器的时空分布特征和孵化器效率的影响因素进行了分析。研究结果表明,第一,在所考察样本及其时空阶段内,中国国家级科技企业孵化器分布密度基本呈现由东部沿海往西部内陆递减的特征,同时呈现孵化器数量空间集聚态势;第二,各个影响因素对科技企业孵化器效率的影响力度不同,且在中国的东、中、西和全国四个层面各因素的影响力度也存在差异;第三,不同因素交互作用后呈现双线性加强态势。创新水平、政府政策、基础设施水平和外商直接投资水平对国家级科技企业孵化器的效率有重要影响。不同地区为提高科技企业孵化器的效率,应注意多种因素的协同和搭配。     

中国北方7个群体血痕GLOI遗传多态性现象的研究

应用琼脂糖水解淀粉凝胶平板电泳法，对中国内蒙古呼盟鄂伦春、鄂温克、达斡尔、布里亚特、（东北）蒙古人及包头市（西北部）蒙古族、汉族人血GLOI遗传多态性进行了调查，抽样检测7个群体GLOI表型分布频率，计算出基因频率和识别能力。并将本组7个群体表型频率、基因频率与国内外不同民族、不同地区的表型频率和基因频率进行了比较，阐述了上述7个群体GLOI遗传多态性特征。根据表型频率计算出识别能力（DP值），并评价了GLOI在亲子鉴定和个体识别中的应用价值。     

民商事仲裁协议是否可撤销

民商事仲裁协议是民商事协议(合同)争议仲裁解决的协议。其适用民事行为的生效要件、无效制度等一般规定无争议。但其是否能适用可撤销制度有争议。笔者认为《仲裁法》没有规定可撤销制度既有比较法上的根据,也有现行法上的依据,同时对最高人民法院《关于适用〈中华人民共和国仲裁法〉若干问题的解释》第18条规定提出了质疑。     

Teacher Skill Development: Evidence from Performance Ratings by Principals

We examine the dynamic nature of teacher skill development using panel data on principals’ subjective performance ratings of teachers. Past research on teacher productivity improvement has focused primarily on one important but narrow measure of performance: teachers’ value-added to student achievement on standardized tests. Unlike value-added, subjective performance ratings provide detailed information about specific skill dimensions and are available for teachers in non-tested grades and subjects. Using a within-teacher returns-to-experience framework, we find, on average, large and rapid improvements in teachers’ instructional practices throughout their first 10 years on the job as well as substantial differences in improvement rates across individual teachers. We also document that subjective performance ratings contain important information about teacher effectiveness. In the district we study, principals appear to differentiate teacher performance throughout the full distribution instead of just in the tails. Furthermore, prior performance ratings and gains in these ratings provide additional information about teachers’ ability to improve test scores that is not captured by prior value-added scores. Taken together, our study provides new insights on teacher performance improvement and variation in teacher development across instructional skills and individual teachers.     

马来亚印度人国大党的成立及早期政治活动(1946~1957)

二战前,马来亚印度人指向祖籍国印度的民族主义和爱国主义明显加强,进而暂时消除、弥合了印度人群体中一些分化因素,这是马来亚印度人国大党成立的重要社会背景。在尼赫鲁的积极推动下,1946年8月,马来亚印度人国大党正式成立。虽然马来亚印度人国大党深受尼赫鲁和印度国大党的影响,该党成立之初也支持当时的印度政府和印度国大党的反殖反英运动,但它并不隶属于印度国大党。自成立后至1957年,马来亚印度人国大党先是主要致力于开展印度民族主义的活动,不久又深度卷入马来亚制订民主宪法的斗争中,积极争取对印度人有利的公民权问题。在马来亚积极争取独立的浓厚政治氛围中,经过一番犹豫之后,1955年3月,经正式商谈之后,马来亚印度人国大党选择全面加入巫统马华联盟。同年7月,巫统、马华公会和马来亚印度人国大党结成的三大民族政党联盟在竞选中获胜。马来亚联合邦随后正式成立,马来亚印度人国大党作为执政联盟成员之一,长期参与执政。印度人群体的相对弱小及其社会内部的严重分化,部分程度地削弱了马来亚印度人国大党在马国政治中的地位和作用。它的政治活动对马来亚的政治民主化和多元化起到了一定的推动作用。
