Keine Verordnungserlassung durch Kollegialbehörde mit richterlichem Einschlag (Übernahmekommission)

Kollegialbeh?rden mit richterlichem Einschlag sind verfassungsrechtlich nicht zur Verordnungserlassung befugt (teilw Abgehen von Vorjudikatur). Die Ausnahme in Art 133 Z 4 B-VG von Verwaltungsbeh?rden aus dem Weisungs- und Verantwortungszusammenhang mit obersten Organen stellt nur auf Beh?rden ab, die blo? zur Erlassung individueller Verwaltungsakte erm?chtigt sind. Die Verordnungserm?chtigung in Art 18 Abs 2 B-VG stellt auf den verfassungsrechtlich (hier durch Art 20 Abs 2 und Art 133 Z 4 B-VG) abgesteckten Wirkungsbereich der Verwaltungsbeh?rde ab. Die Zust?ndigkeit einer weisungsfreien Beh?rde zur Verordnungserlassung würde die Leitungsbefugnis oberster Organe beeintr?chtigen und w?re im Hinblick auf fehlende parlamentarische Kontrolle aus demokratischer Sicht bedenklich.     

新兴猪IL-18成熟蛋白基因的克隆与序列分析

根据GenBank上登录的猪白细胞介素18(pIL 18)基因序列,设计了1对特异引物。利用RT PCR对从3周龄新兴仔猪脾细胞中提取的总RNA进行了扩增,获得了约500bp的片段。将该片段克隆、鉴定、测序,证实已获得了新兴猪IL 18成熟蛋白基因片段,其大小为474bp,编码157个氨基酸,与GenBank上登录的猪IL 18成熟蛋白基因序列完全一致。

Nach stRsp ist jeder Wohnungseigentümer aus seinem Kaufvertrag heraus zur Geltendmachung von Gew?hrleistungs- und Schadenersatzansprüchen gegenüber dem WE-Organisator auch an allgemeinen Teilen der WE-Liegenschaft aktivlegitimiert. Die Mehrheit der Wohnungseigentümer kann sowohl die prozessuale Geltendmachung dieser Ansprüche (hier: auf Schadenersatz aus mangelhaft durchgeführten Sanierungsarbeiten) beschlie?en als auch deren Durchsetzung nach § 18 Abs 2 WEG 2002 idF WRN 2006 an die Eigentümergemeinschaft abtreten. Ein vertraglicher Gew?hrleistungsausschluss steht § 38 Abs 1 WEG 2002 (§ 24 Abs 1 WEG 1975) entgegen und ist somit rechtsunwirksam. Diese Bestimmung ist nicht nur auf neu zu errichtende WE-Anlagen anzuwenden.

Development and validation of the AmpFℓSTR® Identifiler® Direct PCR Amplification Kit: a multiplex assay for the direct amplification of single-source samples

Abstract: The AmpF?STR^® Identifiler^® Direct PCR Amplification Kit is a new short tandem repeat multiplex assay optimized to allow the direct amplification of single‐source blood and buccal samples on FTA^® card without the need for sample purification and quantification. This multiplex assay has been validated according to the FBI/National Standards and SWGDAM guidelines. Validation results revealed that slight variations in primer concentration, master mix component concentration, and thermal cycling parameters did not affect the performance of the chemistry. The assay’s sensitivity was demonstrated by amplifying known amounts of white blood cells spotted onto FTA^® cards, and the assay’s specificity was verified by establishing minimal cross‐reactivity with nonhuman DNA. No effect on the age of the sample stored on the FTA^® substrate was observed and full concordance was established in the population study. These findings of the validation study support the use of the Identifiler^® Direct Kit for forensic standards and database samples genotyping.

Population displacement in the baltic region in the twentieth century: from ‘refugee studies’ to refugee history

This article explores how Baltic migration, and particularly the experience of forced migration, relates to broader comparative and methodological issues and debates in the emerging field of refugee history. Attention is given to the impact of two world wars and their aftermath in the Baltic, with particular emphasis on the ways in which refugees from the Baltic and elsewhere have related their experiences. The article concludes by drawing attention to the multiple readings of population displacement that historians need to entertain.

1994年世界贸易组织（WTO）的与贸易有关知识产权协议是全球知识产权统一保护的基础,十多年过去了,一个新的趋势是知识产权保护双边协议改变了各国知识产权法律,已经超出了TRIPS标准,这就是所谓的“TRIPS—plus．”条款。熟悉这些条款很重要,因为它们对各国社会和经济的影响远远超越了知识产权这个行业。     

中国人血清脱氧核糖核酸酶I(DNase I)的遗传多态性研究

应用薄层PAGIF（T=5％，C=3％）结合特异酶底物染色技术，调查了中国随机人群DNaseI遗传多态性的分布，检出在中国人群中两种常见的等位基因，即DNaseI*1和DNasel*2，其基因频率DNaseI*1为0．53，DNaseI*2为0．47。家系分析表明：子代个体谱带分别来自父亲和母亲，谱带在亲代和子代之间的传递符合孟德尔遗传规律。按Hardy－Weinberg法则进行吻合度检验，观察值与期望值一致。人血清DNaseI等电点经测定为4．0。
