国际贸易法的新发展及其教学变革新思路

全球法律化与经济一体化对我国高校国际贸易法教学产生了重大影响并对之提出更高要求。为使我国高校国际贸易法教学适应新形势发展的需要 ,本文论述了国际贸易法的新发展及变革国际贸易法教学的必要性 ,并从教学目的、教学内容、教学方法、教学手段、教学实践、教学与研究等方面 ,提出变革与创新国际贸易法教学的若干意见     

农民上访、法律援助与司法公平

信访是一种低效率的和具有人治性质的救济方式,但农民却对此乐此不疲,其中重要的一个原因是:司法是一种昂贵和复杂的救济机制,由于我国法律援助的供给严重不足和分配不平衡,这使很多贫困农民无法获得公平的司法救济,从而踏上上访之路。在建设新农村与和谐社会的过程中,国家一定要重视法律援助工作。     

瑞典国际民事诉讼制度初探

除了参加的有关国际公约和欧盟理事会有关规则以外 ,瑞典法院通常类推适用《司法程序法典》中有关法院特定管辖区的条款来解决国际民事诉讼的管辖权问题。域外送达依 1970年的《送达法》和《海牙送达公约》进行。《司法程序法典》对国际民事诉讼的起诉、答辩、反诉、临时保护措施、审理和判决以及上诉等问题作了规定。外国判决的执行依《判决执行法》、欧盟理事会的有关规则和《卢迦诺公约》及其参加的有关海牙公约的规定进行     

'A Manual of Diplomacy': The Genesis of Satow's Guide to Diplomatic Practice

Often referred to as simply 'Satow', the Guide to Diplomatic Practice stands as a lasting monument to Satow's 'second career' as a scholar of international law and diplomacy. However, there was more to this phase in Satow's life than the Guide's two stout volumes. This article argues that in reconstructing the origins and genesis of this work, Satow's own conception of diplomacy as an historically evolved tool of international politics can be examined much more comprehensively than is possible on the basis on the current fifth edition of the Guide. Moreover, this examination will also offer further insights into the evolution of diplomatic studies as an academic discipline in the early twentieth century.

在国际贸易的实践中 ,TBT侧重于依据产品的自然属性来限制进口 ,呈现出广泛性、隐蔽性、歧视性、影响大、争议大等特点。针对我国的实际情况 ,我国企业应加强有关技术性贸易壁垒的信息收集和研究 ;提升我国出口产品的档次 ,实施可持续发展战略 ;构建我国市场的准入规定 ,寻求合理的贸易保护 ;宣传贯彻国际标准 ,积极开展企业和产品的认证认可工作。     

China’s Response to the Ebola Virus Disease in West Africa

This article examines the Chinese response to the Ebola outbreak in West Africa, first surveying Chinese interests in Guinea, Liberia and Sierra Leone. Many Chinese workers have been evacuated and projects postponed. For the first time, China has extended humanitarian aid to countries facing a public health emergency. China is under pressure to ‘do something’ but faces its own developmental challenges as well as problems of logistics. Chinese knowledge of Africa is still relatively weak and uninformed. Although China’s assistance dwarves that from the other BRICS, the Ebola crisis has revealed problems in Sino-African relations, not least the gap between rhetoric and reality.     

‘Donors are not interested in reality’: the interplay between international donors and local NGOs in Kyrgyzstan's HIV/AIDS sector

This article explores the interplay between international donors and local NGOs in Kyrgyzstan's HIV/AIDS sector. It argues that donors have transposed ready-made policies without sufficient consideration of the local context and that NGOs have responded strategically, adapting their proposals and reports to the expectations of donors. This complex interplay has resulted in unintended consequences that have undermined an effective response to the HIV/AIDS epidemic. It has given rise to ‘virtual realities’ detached from developments on the ground. The funding system has also led to corruption and misappropriation of funds and the failure of NGOs to become sustainable. Largely bypassing the state in the allocation of funds, international donors have also undermined an already weak state.     

Congressional Activism in the Foreign Policy Arena: A Case Study of the 1994 Rwandan Genocide

This article analyzes congressional activism during an international crisis. Using the 1994 Rwandan genocide as a case, this study explores executive–congressional relations during a time when immediate policy responses are needed. A content analysis of policy statements made during committees, on the House floor, and on the Senate floor is used to investigate the specific policy ideas proposed by members of Congress. The models presented pay particular attention to the actions of Congressional Black Caucus (CBC) members, in relation to other more common predictors of congressional activism. In addition to the results for CBC members, other conclusions indicate that foreign policy leaders in Congress are international affairs policy experts without serious concerns of being defeated in their next election.     

从国际私法的角度谈WTO协议在我国的实施

我国加入WTO后如何实施其协议规则 ,是一个迫在眉睫的问题。本文从国际私法的角度分析了WTO规则的非直接适用性 ,指出必须通过“废、改、立” ,把它转化成国内法 ,才能在我国实施。针对目前我国正在清理法律法规 ,相关新法还没有出台的情况 ,本文提出应适用“国际惯例补缺”的原则处理涉及WTO规则的涉外案件。     

古典现实主义视野下的国际法及其实践影响

随着法西斯主义横行以及二战的爆发,极力推崇国际法与国际组织在维持世界和平方面的作用的理想主义学派迅速衰落,而崇尚权力与均势的古典现实主义学派得以崛起,并占据冷战时期国际关系理论与实践的主导地位。在古典现实主义的强势下,不仅同一时期的国际法学经受了极大的冲击,国际法以及国际组织的实践也受到消极影响。或者说,古典现实主义国际关系理论成为我们理解冷战时期国际法与国际组织实践的一个重要途径。
