E时代网络思想政治工作初探

互联网为现代社会提供了即时广泛交往、学习型社会支撑、现代人格开发、社情民意表达四大新平台;在网络日益普及的今天,思想政治工作领域发生了接受的主体性、手段的丰富性、时空的超越性、参与的社会性等重大变化;通过积极建构社会化工作平台,营造优良的网络虚拟社区文化,建立网络伦理导向机制,建设强有力的网络政工队伍,思想政治工作就可以把握时代新机遇,开拓工作新局面。     

论国家赔偿之精神损害赔偿

《国家赔偿法》开辟了国家救济的新途径,对国家行政机关违法行使权力设置了有效制约机制。本文对审判实践中涉及《国家赔偿法》的问题进行了探讨,并着重阐述了建立国家侵权精神损害赔偿制度的必要性、可行性,以及建立国家侵权精神损害赔偿制度的原则、范围及确认依据。     

The National-Bolshevik Party and Arctogaia: two neo-fascist groupuscules in the post-Soviet political space

Mathyl examines two representatives of the Russian groupuscular right-Arctogaia and the National-Bolskevik Party-and their emergence after the collapse of the Soviet system in 1991, in the context of the radicalization of Russian nationalism that took place during the inter-Russian power struggle of 1992-3. The ideological arsenal of these groups consists principally of a politico-historical reconciliation between western (neo-)fascism and authoritarian nationalist Russian and Soviet traditions, in which those traditions are intensified and synthesized into a new kind of 'national Bolshevism'. The success of neo-fascist groupuscules demonstrates how potentially explosive the fascist diagnosis of the status quo can behaving been preserved virtually intact since 1945-when it meets with a new situation of high political instability and is employed in intensive political propaganda, as was the case in post-perestroika Russia. Following the nationalists' military defeat in October 1993, the Russian groupuscular right attempted both to maintain the revolutionary impetus and, through a variety of cultural-political activities, to contribute to the gradual enlargement of the nationalist-imperialist project, thereby demonstrating its close connection to the New Right and its strategy of struggling for cultural hegemony. Since the end of the 1990s, there has been, within the groupuscular right, both an increasingly apparent ideological transfer from East to West, and evidence of the growing influence of national Bolshevism on western third-positionist groups.     

徘徊与期待：涉检网络舆情学术研究综述——以2010-2011年CNKI中国期刊全文数据库文献为对象

涉检网络舆情是互联网高速发展的产物。自2010年最高人民检察院将“网络虚拟社会的建设管理”纳入社会管理创新工作内容以来。涉栓网络舆情的研究逐渐兴起。根据对2010-2011年CNKI中国期刊全文数据库文献研究分析,我们不难看出,目前对涉检网络舆情研究存在起步较晚。成果量少质弱,研究人员构成单一,地域分布不平衡,导致研究进展缓慢．未能为决策机关提供足够的智力支撑。根据文献学分析结果显示：涉检网络舆情的研究主题集中在涉检网络舆情涵义、成因、特点以及人民检察院应对策略等方面;也有学者对今后的研究发展进行了展望分析。     

论侵害人格权之获益返还——兼论《侵权责任法》第20条的适用

侵害他人人格权获得利润,本为现今之普遍现象。但是如何处置此种不当获益,乃民法上之重大课题。我国《侵权责任法》第20条对此设有较为周全之规定,但未言明该请求权之性质,对其适用恐嫌不妥。因此,以批判的观点检讨现行立法及学说的规定,认为其实质上是不法管理制度,并认为其适用范围仅限于人格权受侵害之财产损失,不及于精神损害。同时明确其构成要件和法律效果,明确其与侵权损害赔偿请求权及权益侵害不当得利请求权的关系,至为关键。     

刑侦过程中如何识别与发现精神异常的作案者

由于具有不同于普通人的病理性心理活动,很多精神障碍者的违法犯罪行为同样也表现出了异于普通人犯罪的特点。刑侦人员如果熟悉和掌握这些特点,对于在刑侦过程中及时发现和识别精神异常的作案者具有极为重要的现实意义。

积极心理学致力于研究人们积极的情绪体验、个性特征等对心理健康的影响,挖掘美德和能量。积极心理学弥补传统心理学的不足之处。文章在积极心理学视角下挖掘高职生自身的积极力量,分析了教师、校园活动、心理辅导等对高职生心理的影响,为学生心理健康工作提供参考范本。     

Performance Management in Australia's Public Mental Health Service: A State Based Perspective

This article investigates the implementation of key performance indicators (KPIs) in Western Australia's public mental health system. A nationally agreed performance measurement framework forms part of the much needed reform now taking place within Australia. However, progress in the effective monitoring and reporting of KPIs is slow in most states, including Western Australia. The authors report on the results of a selective case study involving semi‐structured interviews with mental health administrators and offer a more nuanced insight into the intricacies and difficulties involved in performance measurement reform. The principal finding is that effective performance measurement and reporting can be internally problematic, particularly within a fragmented and networked system. This tends to give rise to a conformance‐only approach to performance measurement.     

Trust in the information society

Trust is an important feature for all users of the Internet who rely on the safety and security of network technologies and systems for their daily lives. Trust, or the lack of it, has also been identified by the European Commission’s Digital Agenda as a major barrier to further development of the information society in Europe. One of the areas in which concerns have been raised is in relation to children’s safety online. As a result, substantial efforts have been made by policymakers and by the industry to build greater trust and confidence in online digital safety. This paper examines what trust means in the context of children’s use of the Internet. Should policy on trust enhancement, for instance, include children’s own trust in the technologies or services they use or is it sufficient to seek to reinforce parental and adult confidence that children can be adequately protected? What is required to build that trust from either perspective? Does it need, or should it include a relationship of trust between parents and children? To tease out these questions further, the paper examines current European Union policy frameworks on digital safety, particularly industry responses to the call for a more trusted Internet environment for children, and argues that technical solutions to be effective need to carefully balance a number of competing objectives and to be sufficiently grounded in evidence of parental and child experience of the Internet.
