日本特殊法人改革及其前景

特殊法人 ,作为日本国有企事业单位的重要形态之一 ,曾经为战后日本经济的迅速恢复和高速增长发挥了重大作用。但是 ,战后半个多世纪以来 ,日本的社会经济形势已经发生了翻天覆地的变化 ,当初设立特殊法人的前提条件已不复存在 ,其积极作用已丧失殆尽 ,消极作用日益突出。 2 0 0 1年4月上台的小泉内阁决心对其进行集中且彻底的改革。本文试对日本特殊法人改革的必要性、改革经过及其前景作一分析 ,以期我国在国有企业改革中参考和借鉴

Population genetics of 17 Y-chromosomal STR loci in Japanese

Haplotypes and allele frequencies of 17 Y-chromosomal short tandem repeat (Y-STR) markers were examined using the AmpFlSTR Yfiler PCR Amplification Kit (Applied Biosystems) in a population sample of 1166 Japanese male volunteers in 6 prefectures: Miyagi, Yamagata, Osaka, Tottori, Fukuoka, and Okinawa. A total of 1058 haplotypes were observed from 1166 males, and the most common haplotype detected in 12 males had a frequency of 1.03% and the discrimination capacity was 0.907. The R_ST analysis showed statistically significant differences between Okinawa and the other subpopulations.

试论日本文化的源与流

无论是从人类文化学的角度抑或是从文化发生角度看，从属于汉文化分支的日本传统文化到属于东西合璧的日本现代文化，都是一种多源汇流的文化。日本文化的特质是采集东西文化成果，消化变形为日本民族独具特色的东西方汇流文化。中国文化对于日本文化曾起到过重要的哺育作用，日本文化吸收了中国文化的诸多要素，但是日本不是简单地克隆、复制外来文化，而是按照自身文化特征消化、吸收外来文化，并将其融合到本民族血脉之中。

日本将修复司法活动引入到日本少年院的课程当中,并在少年院中实施了考虑被害人感觉的教育,请被害人到少年院进行讲演,让有问题青年真正地认识到自己所犯的罪行,制定犯罪被害人的保护法制等等,无疑对日本青少年的不法行为是一种有效的矫正措施。     

历史文化因素与日本人的自杀行为

日本现行罚金刑制度及发展趋向考察

日本罚金刑在现行刑法、刑事政策和司法实践中均占有重要的地位。其适用对象侧重过失犯和初犯;其适用方式多为选处和单处;罚金刑的量定未采用日数罚金制,仍袭旧制;执行制度有缴纳制度、执行犹豫、劳役场留置以及犯规通告制度。《日本改正刑法草案》反映了日本在罚金刑适用上的一些变化,罚金刑的适用范围有所扩大,方式更为多样合理,幅度变低并细化,裁量方式更趋完善。     

日据时期台湾经济警察现象探析

日据台湾期间,殖民政府为扩大侵略战争,适应战时统制的需要,在台湾各级警察机关设置经济警察单位及经济警察人员,实施经济警察制度,形成了台湾警察的经济化现象。日本殖民政府借助警察这一国家机器、利用经济警察这一制度加速经济殖民政策在台湾的实施,从而实现对台湾的强力统治。台湾经济化警察产生的特定历史背景对其机构设置、主要职责等方面产生了重要的影响,并为其进行经济掠夺和殖民统治的史实埋下了伏笔。     

Japanese diplomacy during the Cambodian peace process and Japan's post-Cold War role in Southeast Asia: the legacy of the Fukuda Doctrine, 1989–1993

Japan's role during the Cambodian peace process after 1989 is often considered a successful case of post-Second World War Japanese diplomacy. In contrast to claims in the existing literature that Japan began to consider and initiated its involvement in the settlement only beginning in the late 1980s, this article demonstrates that Tokyo's role built upon a diplomatic platform that the Japanese had constructed through peace efforts since the Cambodian conflict erupted in 1979. The policy framework, objectives and initiatives of Japan's Cambodia diplomacy during the peace process represented the culmination of a ten-year diplomatic endeavour. Ultimately, Japan's involvement in the Cambodian settlement, guided by its Southeast Asia strategy of promoting coexistence and cooperation between ASEAN and Indochina, legitimated and favoured Japan's attempts to expand its post-Cold War role in regional political and security affairs.
