试论宏观调控法

宏观调控是现代市场经济的内在要求。宏观调控法是国家依法运用宏观调控手段对市场经济运行进行调节与控制的法律,宏观调控必须贯彻计划指导、平衡优化、适度调控、效益公平等原则,宏观调控的调整方法应采取经济手段、行政手段、法律手段三种手段相结合的调整方法,并必须统一于法治之中。     

The economic effects of judicial accountability: cross-country evidence

Judicial independence is not only a necessary condition for the impartiality of judges, it can also endanger it: judges that are independent could have incentives to remain uninformed, become lazy or even corrupt. It is therefore often argued that judicial independence and judicial accountability are competing ends. In this paper, it is hypothesized that they can be complementary means towards achieving impartiality and, in turn, the rule of law. It is further argued that judicial accountability can increase per capita income through various channels one of which is the reduction of corruption. First tests concerning the economic effects of JA are carried out and on the basis of 75 countries, these proxies are highly significant for explaining differences in per capita income drawing both on OLS as well as TSLS.

青年劳动力资源是社会文明进步与经济发展的第一推动力。社会保障机制作为开发与调节青年劳动力资源的重要机制,是维护青年劳动者基本权益的前提;是青年劳动力资源优化配置的保证;是青年劳动力资源再生产的基础;是激发青年劳动者积极性的催化剂;是青年劳动力价值公平分配的调节器。     

社区股份公司的发展困境:逆向嵌入与信任消解——基于深圳市L区的实证研究

社区股份公司是城市集体经济的重要组成部分,对于城市的经济发展与空间拓展具有重要意义。面对现阶段我国多样的市场机会,社区股份公司却长期固守低端物业和租赁经济,经济发展模式单一,发展处于停滞状态。基于深圳市L区31家社区股份公司的实证研究,发现股民通过“出身”股权和宗族网络逆向嵌入社区股份公司,严重束缚了社区股份公司管理层的自主性。由于社区股份公司与地方政府缺乏有效的正式沟通渠道,以及过往合作质量较低等因素,极大地消解了双方的信任,社区股份公司不能很好地回应地方政府的扶持政策。未来需要从做实集体股份、完善公司治理、调整股权结构、重建信任机制以及提高政府服务质量等方面入手,破解社区股份公司的发展困境。     

WTO规则下我国反垄断法律制度所面临的挑战与对策

反垄断法律制度在一个国家经济发展中起着极为重要的作用 ,素有“经济宪法”之称。入世后 ,在知识经济和经济全球化的背景下 ,各种各样的不正当竞争行为、限制竞争行为以及垄断行为对我国经济的健康发展带来了愈来愈严峻的挑战 ,完善与发展我国反垄断法律制度已经成为全社会共同关注的课题。立足我国具体国情 ,较为详尽地分析了入世后我国反垄断法律制度所面临的诸多挑战 ,并在此基础上从立法层面和具体法律制度层面上提出了我国反垄断法律制度的“适世”和发展策略。     

适应市场经济发展要求强化公安队伍正规化管理

公安队伍正规化建设 ,即公安机关在组织机构、勤务方式、内务管理、教育训练、监督制约等方面实现科学化、标准化。其目的是通过队伍正规化管理促进社会政治稳定 ,促进执法为民思想的贯彻落实 ,为经济发展创造平安、和谐的环境。     

论行政许可的优化使用——从法经济学角度进行分析

目前我国立法和政策仅提出行政许可优化使用的总体原则。由于该原则过于抽象或模糊,很难在实践中准确实施。从法经济学角度进行分析,市场机制的"失灵"问题包括信息问题和外部性问题。行政许可较市场自我救济、私法救济、信息监管和事后标准四种措施来解决该问题的同时具有优点和缺点。我国行政许可法的规定存在不足,应该改进。     

The Czech transition banking sector instability: the role of operational cost management

In this article we show—using the estimated cost efficiency of banks—that besides the risk (proxied by the share of non-performing loans), the quality of operational cost management was an equally important determinant of bank failure risk during the decade of banking sector transformation in the Czech Republic.

Immigration to Ghana

Abstract

The globalization of international labor migration is manifest in all countries now engaging in migration systems that are growing in size and complexity and producing an increasing diversity of flows. Furthermore, many of the processes that create and drive these systems operate on a worldwide basis, the consequence of economic globalization, capital mobility and widespread realization by governments that human resources can be traded for profit like any other resource.

This paper looks at Ghana's immigration policy in the light of its economic situation. It characterizes Ghana's immigration policy as geared towards using immigration to attract critical foreign investment, transfer of technology and human resource capital/skills for socio-economic development. Running concurrently is the policy to prevent illegal immigration, transnational crime, economic exploitation, social corruption and human trafficking.

The paper concludes that when the economic situation of Ghana was buoyant in the 1960s it attracted many immigrants especially from neighboring West African countries, however when the country's economy saw a down turn, immigrants were used as a convenient scapegoat and many were expelled. The irony though is that while the current poor economic situation of Ghana has made Ghanaians to immigrate to other countries, the political stability of the country does attract other West Africans and non-Africans and it is affording the country the opportunity to streamline its immigration and citizenship laws.
