雇主不当劳动行为的民事救济——基于我国和美国不当劳动行为救济制度之比较

我国《工会法》第52条规定的责令雇主承担不当劳动行为的民事责任,与美国《国家劳资关系法》第10(c)条的规定看起来很相似,相比之下,这一规范在美国劳动法的实践中很有效,在我国却极少被适用,解释方面也存在较大的分歧。美国是世界上最早创设不当劳动行为救济制度的国家,从《瓦格纳法》规定的雇主不当劳动行为的禁止规范及救济措施,到《塔夫托—哈特莱法》将适用对象扩大到工会和雇员,在雇用自由原则和劳资自治模式的背景下,其演变始终以保护雇员团结权的松紧程度和收放态度为线索。我国《工会法》现正处于第三次修改阶段,适时检讨第52条的解释和适用的障碍,还可以解决其与《劳动合同法》规范的竞合问题。     

浅谈民警心理健康与民警培训

面对错综复杂的执法环境、面对繁重的公安保卫任务、面对执法过程中遇到的各类意外事件,基层公安民警心理上承受的压力越来越大。因此,心理健康对公安民警特别重要。重视心理健康调适,加强对民警的心理健康教育和培训,是各级公安机关必须重视的问题,也是民警培训工作的一项长期目标。

本文从分析养老保险制度的不同筹资模式入手,从对经济增长的影响,应对人口老龄化的能力和改革中的转制成本权衡等方面,阐述了当代中国养老保险制度选择的现状及其困境,并且针对完善养老保险政策制度,提出了保持过渡时期稳定发展的可行性建议。     

美国董事与高级职员责任保险制度及其对我国的启示

美国D&O责任保险始创于20世纪30年代,历经了七十余年的发展,已成为世界上最完备、最复杂和最有影响力的责任保险制度。我国的D&O责任保险发展了近5年,虽然取得了一些进展,但是却存在较多的问题与争议。因此,分析和研究美国的D&O责任保险制度可以给我们诸多启示。     

IS Success and Failure—The Problem of Scale

In the midst of Implementing Electronic Government (IEG), the almost knee-jerk reaction of our political elite seems to be to embrace hugely ambitious Information Systems (IS) solutions to public-sector operations. Problem after problem has been viewed as solvable by throwing some big IT at it. However hindsight and a wealth of evidence and examples shows that overly large-scale public-sector IT projects do not work and persistently end in failure and costly waste. In this article we consider IT projects 'failures' and the combination of social and technical factors that contribute. We illustrate our argument with more detailed reference to the Connecting for Health agenda, part of the NHS National Programme for IT. We suggest 'think local, think modular' to build on good practice and advocate use of the government's own 2004 eGovernment Interoperability Framework (eGIF) to learn lessons from past IT project catastrophes.     

20世纪40年代罗家伦对近代中国民族国家建构与民族发展问题的理论探讨

20世纪40年代,罗家伦顺应中国走向现代化的趋势,从民族与经济、政治、教育、人口、宗教、法律制度、语言文字、地理环境等方面关系的角度探讨了近代中国民族国家建构问题,形成了较为系统的民族发展理论。罗家伦将中国民族国家的建构与现代化联系起来,他所注重的工业化、科学化、民主化以及人的现代化,实质上都是现代化的基本内容。他的民族国家建构理论的主流,正是中华民族在落后的历史条件下,希望通过借鉴世界各国先进的技术和经验,通过自己的发展和创造,赶上先进国家、实现民族现代化的具体体现。     

在党的十六大精神指引下推进高等教育创新

当前,高校面临的一项重要而紧迫的任务,就是要认真学习贯彻党的十六大精神,以江泽民"三个代表"和教育创新的重要思想为指导,坚持党委领导下的校长负责制,推进观念创新、制度创新、教学创新、学术创新,加强师资队伍建设,造就高素质创新人才,推出高水平创新成果,开创高等教育的新局面。     

Pubertal Development, Choice of Friends, and Smoking Initiation among Adolescent Males

Prior research has indicated that pubertal development and peer associations are important determinants of adolescent smoking behavior. However, more remains to be learned about why these variables matter or how they may be related to one another in ways that lead to the initiation of smoking. Using contractual data from the National Longitudinal Study of Adolescent Health, we consider the relationship between early pubertal development and associations with close friends who smoke, and smoking initiation among male youths. The results of the study reveal a link between advanced pubertal development and the initiation of smoking among boys, but we discover that the effect is indirect, mediated by a greater propensity of sexually mature males to forge friendships with peers who smoke. We also find that this propensity is greatest among the youngest adolescents in the sample, suggesting that the age of the respondent conditions the effects of pubertal development on the formation of friendships with peers who smoke.(Ph.D., The University of Texas at Austin), is an Assistant Professor at Washington State University at Vancouver.
