论当代中国法学学术话语体系的构建

建国后,我国曾为构建法学学术话语体系进行了四次有益的尝试,但中国法学学术话语体系尚未真正建立。今后法学界应当秉持民族语言与时代精神有机结合、马克思主义法学中国化与中国法治经验马克思主义化有机结合以及合理借鉴中外优秀法律遗产与立足现实的理论创新有机结合的＂三结合＂原则,理性探讨、凝聚共识,着力研究中国问题,从我做起,从当下做起,从而建构中国的法学学术话语体系。     

反思性法制现代化初论

反思性法制现代化的规范基础是商谈政治,法律范式是程序法。中国法制现代化事业应反思西方法制现代化运动轨迹,针对自身社会发展状况,创生一条具有独特个性也切合反思性法制现代化一般要求的合理性道路。     

论域观下的无被害人犯罪概念

不同的论域下有不同的犯罪概念。目前给无被害人犯罪所下的定义存在着论域不清的问题。无被害人犯罪的概念应区分刑法还是犯罪学论域。关于无被害人的含义是界定概念的关键。刑法中,无被害人犯罪的内涵要素是违背伦理道德并法益侵害不明显。犯罪学中,内涵要素是违背伦理但社会危害性小。外延上要与隐形犯罪、没有在意的犯罪相区别。     

迈向“言说”理性的法律会话推理

法律推理是理性的过程,具体而言是一种实践理性.法律实践是一种“言说”的实践,特别是在司法过程中,任何一个环节都离不开“言说”这种会话模式.法律推理的过程就是在法律会话实践中选择最适合结论的过程,它包括一定法律行为正当化的论证和相对于一定目的的最佳手段的确定.法律会话推理①正是从多主体“言说”角度寻找正当性的法律推理方法,是一种“言说着”的理性,其以话语为媒介,以法律当事人之间的会话沟通为方式,通过各方对话语意图理解找到解决问题的最佳行为方法,从而对推理结论进行正当性论证,这里的正当性建立在主体间性的基础上,因而具有主体间的可接受性和社会层面的合理性.     

西方话语与中国法理——法学研究中的鬼话、童话与神话

近代以来的中国法学在很大程度上是西法东渐的产物,故而受西方影响极大。在全球化时代背景下,不同法律文化之间的交流与碰撞本属常态。然而,由于西方文明的强势地位,西方话语对中国法学渐有从“影响”转变为“宰制”之虞。考察五百年以来西方话语在中国知识界——尤其是政法学界的兴衰沉浮与话语嬗变,我们可以隐约发现一个从“鬼话”到“童话”再到“神话”的轨迹,值得深思。在文化自觉、文化自强与文化自信开始成为知识界愿景的今天,我们应该解放思想、实事求是,以更为清醒和开放的心态来看待西方话语：抛弃鬼话,认清童话,破除神话。既要反对盲目排外,也要反对妄自菲薄,而应以翔实的实证研究和比较研究认清真正的西方与中国,将西话变成真话,助力“中国法理”的构建及中国法学的国际话语权争夺,最终确立其在人类政法智慧版图上的应有地位。     

Peasant,Patriot, Environmentalist: Sustainable Development Discourse in Havana

Private urban agricultural ventures, initially a spontaneous response to food shortages during the Special Period, soon became a state‐sponsored project, related to global notions of sustainability. This article explores the relationship between sustainability discourse and its local dimensions to reveal the role of sustainability in the reformulation of the Revolution. Urban gardeners engage with international discourses of sustainability and interact with the Cuban state's articulation of these discourses. While this process forces urban gardeners to adapt to the changing meanings of growing food, it also provides a different language through which gardeners define themselves, especially in the context of a changing relationship with the state.     

Encounters with panaceas: reading flyers and posters on ‘traditional’ healing in and around Johannesburg's Central Business District

Informed largely by the Critical Discourse Analysis framework, this article analyses flyers and posters that advertise traditional/alternative healing distributed and posted respectively in and around Johannesburg's Central Business District. Paying close attention to text and context, the paper analyses the advertising of medicines and practices referred to as traditional/alternative. The advertising, which employs modern media and advertising techniques, is as complex as the multiplicity of religious, secular and corporeal interventions offered by the healers. The ubiquitous presence of flyers and the continued pasting of posters onto city structures, despite warnings by the city of Johannesburg, are an expression of resistance to city authorities. The paper posits that what may appear to be downright charlatanism by the advertisers might in fact be a viable alternative to biomedicine, especially in Johannesburg's context of high in-migration with its attendant plethora of social and health problems. Thus the healing services that the healers advertise pose a challenge to allopathic medicine, suggesting that illness needs to be understood in a broad sense.     

Beyond the literary veil – Women writing Africa: The northern region (2009)

Abstract

Whenever African literature is discussed there is an articulated incorrect assumption that this relates to all the regions of Africa, except North Africa. A related further assumption is that only men in North Africa write. Female writers from the North barely receive critical attention, although they have been writing creative works. The aim of this article is to dispel the notion of literary drought when describing North Africa. Using the text, Women writing Africa: The northern region, the article demonstrates the different sensibilities that female authors in North Africa have created and manifest, when writing against patriarchy as well as against ideological philistinism within their communities. It is argued that female authors from North Africa – African-Arab women – are versatile in their imaginations as they engage with social reality from the perspective of creative art as well as political discourse. The article concludes that this assertion removes the literary veil so that North African female authors can begin to be appreciated artistically, more than has been the situation up to now.     

谈法官与社区关系的话语冲突与实践困境

在法官与社区关系上,一方面强调法官融入社区,与群众＂亲密接触＂,另一方面提倡在法官与当事人间建立＂防火墙＂,法官与社区＂保持距离＂。本文认为,矛盾的基点在于不同的司法理念和现实的需要。一方面法官与社区之间应保持适当距离,另一方面司法应有一定的开放性,以免与社会脱节。然而,实践中往往难于掌握两者之间关系的＂度＂,以致陷入非此即彼的困境。     

中国法学知识谱系建构的主题词

在全球化语境中的当代中国这一客观场景中,任何关涉中国法学知识谱系建构的努力都超越不了＂历史的镜像＂、＂身份的守望＂、＂话语的审慎＂这三个至关重要的主题词,它们簇生性地构成中国法学建构性的知识谱系。中国法学只有融入并超越这种知识权力与价值守护,才能获得自我存在的确认,完成中国法学主体性建构的时代使命。由此也自然而然地展现了马克思主义法学、西方法学和中国近代法学这三个维度之精神空间的交融与对立在中国法学知识谱系建构中的积极价值。
