关于美国法学职业教育的思考

经过长时间的发展,美国的法学教育走在世界前列.美国的法学教育是大学本科教育后的职业教育,课程设置灵活,充分反映了职业性特点,教学方法也日益完善以利于学生顺利毕业和满足司法实践的需要.     

当前美国网络空间战略变化对我国家安全的影响及思考

当今美国网络空间战略在全方位维护国家网络安全的基础上,更注重积极抢占国际网络空间控制权。以新媒体为代表的＂网络外交＂成为美国实现政治目标的新手段。美国企图以＂互联网自由＂为旗帜,为其主导网络空间鸣锣开道。由于美国在相当程度上掌握着网络技术的制高点,控制着网络的连接权、话语权,因此在网络空间具有先天优势。当前,在对华网络战略方面,美国也已经由单纯的＂网络渗透＂转向利用网络空间的主导权和垄断网络资源的优势,对中国进行全方位的网络＂侵略＂、颠覆和破坏,给中国维护国家安全带来前所未有的冲击和挑战,中国应高度重视美国网络空间战略的动向和变化,妥谋对策。     

六方会谈重启的必然性及难点分析

自朝鲜退出六方会谈以来,朝鲜半岛局势日趋紧张。深入分析朝鲜半岛时局变化特征,找出半岛危机频发的根源,采取合理的应对措施极为重要。由于朝鲜半岛时局危机频发,作为多边对话机制的六方会谈的重要性越来越突出,其意义已经超出和平解决朝核问题本身,成为维护地区局势稳定的需要。鉴于六方会谈有关各国立场和实际努力,六方会谈重启只是时间问题,重新开启六方会谈也将有效推动朝韩、朝美关系改善。     

Extreme poverty alleviation through community-based entrepreneurship: PRODECO in Paraguay

Community-based entrepreneurship projects have been advocated as a potential approach to alleviate extreme poverty as they provide opportunities for income generation and capacity enhancement. This practical note provides an overview of the PRODECO project undertaken jointly by the Paraguayan government and the World Bank (1999–2008) in three southern departments of Paraguay (Itapúa, Misiones, and Ñeembucú). It describes and analyses the context, scope, operations, and results of this project, and identifies five main lessons related to frequent challenges faced by this approach; on size, access to skills, distance from government agencies, pace, and technology.     

Considering the ecohealth approach: Shaping Haitian women's participation in urban agricultural projects

This paper examines the social and gender politics of a women's urban garden project supported by the International Organisation of Migration, in Cap Haitien, Haiti. My study highlights how the development process created an unmonitored symbolic space where society's normalised gender processes reproduced broader social inequalities, which, in turn, prevented the project from meeting the women's practical and strategic goals. Then, I discuss how the ecohealth approach, as an alternative design framework, could make symbolic space visible to be critically engaged and analysed by participants, to account for gender process, and create an emancipatory activity.     

从女性角度析《美国在心中》中菲裔美国人的寻梦三部曲

菲律宾裔美国作家布洛桑的《美国在心中》是菲裔美国文学的扛鼎之作,作品通过自传体形式叙述了早期菲裔劳工的离散经验。本文聚焦于作品中相对零星、却具有较强隐喻性的女性书写,通过分析殖民地菲律宾女性、菲裔社区的妓女和理想化的白人女性3类女性群体,试图证明女性既像一面镜子一样,浓缩并再现了菲裔劳工从家乡到美国的苦难与辛酸,也像一盏明灯一样,指引着他们在黑暗与孤独中,在重重剥削与压迫中奋力前行追寻梦想。在这部书写菲裔男性的书中,零星的女性叙事不是孤立的存在,而是理解与构建菲裔离散经验特殊性与复杂性不可或缺的重要途径。     

美国性犯罪者登记制度的实证研究及反思

对性犯罪者进行登记是美国等西方国家普遍采用的用于遏制性犯罪的做法。但不少研究表明,性犯罪立法在控制性犯罪和减少再逮捕率方面并没有起明显作用,相反,性犯罪者登记制度给相当一部分性犯罪分子带来了诸多负面影响。关于性犯罪者登记制度需要进一步的研究,研究内容包括性犯罪者登记法是否能够减少性犯罪行为,谁来对登记程序进行监管,该制度对性犯罪者及其家庭的影响,以及实施登记法律的成本。     

对美国少数民族教育立法的初步研究

本文在实地调研及文献研究的基础上 ,对美国少数民族教育立法的内容、特点等问题 ,进行了初步的但属开创性的研究。并结合我国的实际 ,提出了加强我国少数民族教育法制建设的若干思考。     

Studying North Korea through North Korean migrants: lessons from the field

This article examines the use of North Korean defectors’ accounts as a source of information for studying the Democratic People’s Republic of Korea (DPRK). Information from defectors fills a vital knowledge gap and improves our understanding of North Korean politics, economics, and society. Witness accounts and interview data collected from people who were born in North Korea but have since left have been widely used by journalists, government agencies, international organizations, non-governmental organizations, and academics. There are, however, serious methodological issues in collecting, organizing, and interpreting information derived from defectors’ accounts. Selection and demographic biases, power relations between researchers and interviewees, monetary incentives, and language barriers are among those issues. We propose focus group discussions and participatory observation as complementary methods of data collection to mitigate the shortfalls of relying on individual interviews.     

美国等西方国家对华“分化”策略的新变化及对策思考

基于政治制度和意识形态的冲突、地缘政治的竞争和战略的不信任,以美国为首的西方国家对华实施"西化""分化"的战略图谋一刻也没有松懈。近年来,中国的快速发展迫使美国调整了对华实施"分化"战略的策略;同时,由于中国正处于社会转型、改革深化的关键时期,社会矛盾的增多、社会冲突的加剧为美西方的"分化"活动提供了诸多契机和借口。面对美国等西方国家的"分化"活动出现的新形式与新特点,为了维护国家的政治安全,中国不仅要在策略方面进行应对,还需要在战略层面提出适应国家整体发展的"顶层设计",更为重要的是在"软实力"上构建一套让全世界都信服且能与西方相抗衡的价值体系。
