无直接利益冲突犯罪初探

社会转型时期，由于利益的分化，社会冲突呈现出新的特点，部分地区甚至出现了无直接利益冲突的犯罪行为，需要引起足够的重视。本文介绍了对无直接利益冲突犯罪的合理界定，分析了在中国的现实状况和表现出的特点，阐释了无直接利益冲突犯罪存在可能的原因，最後提出社会合理化的刑事立法、司法和刑事一体化的综合规制对策。     

关于武装冲突法适用的几个问题

武装冲突法内在地包含着缔约国及其军队遵守和执行武装冲突法的义务。各国适用国际法的政策和实践决定着各自军队适用武装冲突法的情况。我国军队应从实际出发,在借鉴别国及其军队做法的基础上,正确认识武装冲突法的地位作用,合理规范武装冲突法条约缔结和适用的行政权利、立法规划和司法体制,维护国家和军队的根本利益。     

Interpersonal Violence in Alcohol Complicated Marital Relationships (A Study from India)

This study compared 75 wives of alcoholics with an equal number of wives of non-alcoholics matched on key socio-demographic variables, using a cross sectional ex-post facto research design. Instruments to assess the extent of conflict and danger perceived by them in their marital relationship, besides the communication apprehension experienced towards their partners were administered. Analyses showed that the wives of alcoholics as a group had higher levels of conflict, perceived more danger and experienced more apprehension in relating with their spouses, than the subjects of the reference group. Results indicate the need to consciously focus on the spouse of the alcoholic and to help her resolve various marital issues with which she is faced. Implications for therapeutic intervention with couples in alcohol complicated relationships to enable them overcome their marital life deficits are discussed. 性权利与婚姻的冲突与衡平

婚姻是对性的某种束缚,配偶权与性自主权之间存在固有的张力和冲突。平衡配偶权与个人性权利的关系,不仅要考虑到个体的自由,也需要捍卫婚姻的合理价值。为此,强化配偶间的忠实义务、同居义务的同时,对非婚性行为、婚外性行为适度宽容和规范,改革离婚法,以促进个体的性权利的实现。     

So far away from me? The effect of geographical distance on representation

Legislators face numerous trade-offs with regard to how to spend their time. One factor is, however, beyond their control: the distance between their constituency and the legislature. A more distant constituency implies increased travel, which decreases the time available for activities within the legislature itself, while also raising the possibility of centre–periphery dynamics in representation. Previous work has found that as distance between constituency and legislature increases, so does constituency focus, but it has not established why this is. This article explores the impact of geographical remoteness on representational activity, analysing a dataset of parliamentary activity in the British House of Commons (2005–2015), showing that the more remote an MP’s constituency, the less likely that MP is to attend votes, while being more likely to sign Early Day Motions. The article further shows that this is most likely driven by a centre–periphery dynamic rather than simply being a response to longer travel time.     

Simple and simultaneous quantification of cyanide,ethanol, and 1-propanol in blood by headspace GC–MS/NPD with Deans switch dual detector system

Cyanide is a powerful and rapidly acting poison. In Japan, cyanide poisoning is rare, and regular cyanide testing can be costly and time consuming. In contrast, alcohol analysis is routinely performed in most forensic laboratories. In this study, we attempted to develop a method for the simultaneous quantification of cyanide and alcohols in blood using headspace gas chromatography (HS–GC). As nitrogen-phosphorus detection (NPD) is more sensitive to hydrogen cyanide than mass spectrometry (MS), a Deans switch was used to switch the detectors during a single run. The separation provided by three analytical columns, PoraBOND Q, CP-Sil 5 CB, and HP-INNOWax, was investigated, and PoraBOND Q was selected. The use of HS–GC–MS/NPD with a Deans switch enabled the simple and simultaneous quantification of cyanide, ethanol, and 1-propanol. Eighteen other volatile compounds were detected in the SIM/scan mode of the MS.     

Lowering the age of consent: Legal,ethical, and clinical implications of adolescent-directed therapy

This article discusses a recently enacted Colorado law that aims to reduce the youth suicide rate by lowering the age of consent for psychotherapy from age 15 to age 12. The author discusses the challenges therapists face when young adolescents seek therapy without parental consent in cases involving interparental conflict. Suggestions for managing adolescent-directed therapy are offered.     

Hearing the voice of Donbas: art and literature as forms of cultural protest during war

This paper analyzes literary, visual, and street art works of writers and artists from Eastern Ukraine produced during 2014. Two Donetsk artists, Serhii Zakharov and Anzhela Dzherikh, and two Luhansk writers, Serhii Zhadan and Olena Stepova, play with the myth of the proletarian Donbas, on the one hand, and debunk the popular perception of Donbas people as being in consent with the politics of the self-proclaimed Donetsk and Luhansk People’s Republics, on the other. They explore familiar tropes and images of Donbas and use guerrilla tactics (shock effects, provocativeness, and deception) to initiate public reaction to the war. Their works are united by their search for a shared communication space and direct access to the audience on occupied territories. These artists challenge the accepted perception of Donbas as a free but uncivilized space and participate in the creation of a new Donbas text. The interaction between politics, art, and activism makes their voices and vision powerful and infectious and can help achieve civic consolidation in Donbas.     

城镇已婚女性的工作与家庭冲突研究——基于时间利用的分析

利用第三期中国妇女社会地位调查资料,从时间利用的视角分析城镇已婚职业女性的工作与家庭冲突状况发现,婚姻和生育是女性平衡工作与家庭关系面临的巨大挑战,工作时间的刚性减少了女性对家庭的时间投入,城镇已婚在业女性比男性面临更大的工作与家庭冲突,公共服务的供给可在一定程度上缓解这种矛盾和冲突。在政策方面,建议推动用人单位公平对待职业女性,有条件地实行弹性工作制;政府要增加公共服务供给,提高服务水平;同时倡导男女共同承担家庭责任。     

商号与商标:权利冲突与解决

作者针对我国现行立法中对商标和商号分别予以保护,并由此而致的商号权与商标权的法律冲突问题,分析了冲突产生的原因,并提出了解决两权冲突的途径。
