土地征收的私权保护——兼论我国土地立法的完善

我国由于现行土地征收立法本身存在内在冲突和漏洞 ,又加观念、制度、操作等方面的问题 ,造成土地征收中公权侵害私权 ,产生了严重的社会后果。解决问题的根本出路在于 :更新立法理念 ,贯彻私权保护原则 ;明确界定公共利益范围 ,严格限制征收权的滥用 ;开放农村建设用地市场 ,促进土地资源高效配置 ;健全土地征收程序 ,增强公开性、公正性 ;完善土地征收补偿制度等     

Local Politics and Depolitisation in Chile

Abstract— This study focuses on the consequences at the local level of decentralisation and state disengagement policies in Chile. We proceed in two stages. First, we analyse whether the nature of urban collective goods and services has changed from political to economic. Next, we study the effect of these policies on community/ authority relations, and more broadly, on local politics. A case study of the city of Conception serves to explore our questions. We conclude that the local community has adapted to the economic nature of collective goods and has developed the necessary organisation, technical and leadership skills. Power politics however have not disappeared but are now in higher institutional levels. Politicians do not seem to have followed the trend and thus have still to open to democratic participation and legitimate representation as expressed by the citizens' aggregated interests.     

全球公共产品视角下的中国国际发展合作

中国的对外援助事业随国际、国内形势而变化。近年来官方对国际发展合作的重视不仅促成中国对外援助指导思想的转变,也为对外援助向国际发展合作转型奠定了理念基础。中国为发展合作提供全球公共产品的实践不断丰富:一是基于本国成功经验而开展的减贫国际合作成为重要公共产品,二是通过创新农业技术合作方式为解决全球粮食安全问题提供更多公共产品,三是借助三方合作更好地创新公共产品供给模式,四是持续加强全球卫生公共产品供给。中国对外援助在取得积极成效的同时,也面临经济、技术实力有限、援助项目可持续性不足、受援国国家治理与互不干涉内政之间协调困难、国际发展合作的话语权有待提升等挑战。未来,中国应注重从制度建设、资金筹集、可持续性提升、受援国能动性发挥、国际话语权提升等方面做更充分准备。

唐以前盗罪之变迁研究

尽管名称不一,但盗罪无疑是古今刑事法律均极为关注的罪名,今人也习惯于以财产性犯罪来理解传统中国的盗罪。然而,在中国文字初创之时,“盗”其实是泛指“不正”“不当”之义的词汇;至战国时代,才被相对明确地用来指称侵犯财产的行为,但其“不正”“不当”之义也并未完全消失。此种日常语义的多层次性也影响到战国秦至汉代的法律对盗罪的设计,使盗罪一方面以非法取财为主旨,另一方面又保留着超越财产性犯罪之概念限定的可能,从而表现出一定的含义复杂性。至魏晋南北朝,立法者们虽试图对盗罪予以分化或净化,但由于“盗”字的日常语义依然具有多层次性,作为法律术语之盗罪的含义复杂性也无法彻底改变并最终遗留在唐律之中。

The Punishment on the Private Law——Justification of Putting the Punishing Payment to Damage into the Civil Law Code of China in the Future

There has been a debate about whether the Punishing Payment to Damage should be put into the Civil Law Code of China in the future, for the characteristic of the Punishing Payment to Damage conflicts to the Compensation Principles. From the angle of origin of the Compensation Principles, this paper demonstrate that it should be restricted in the field of private law. Thus we should break the monopoly of public law to punishment, and reserve the space to it in the field of private law. By increasing the amount of the Punishing Payment to Damage, the civil responsibility should be full of diversity and manifold, and the happen of damage could be decreased. Putting the Punishing Payment to Damage into the Civil Law Code of China in the future is not only legitimate but also significant.     

论国际海上货运纠纷中经济损失的可赔性

海上货物运输纠纷中的损害事实指货方由于承运人的违约行为而遭到的损失 ,从实际发生的角度来看 ,损失包括货物物质上的损失以及经济损失。所以明确经济损失的可赔偿性以便以统一的尺度确定承运人的赔偿责任已成为当务之急。

“关系”如何、缘何影响基层官员晋升

基于对桔镇干部晋升过程的考察，我们发现，镶嵌于差序格局社会关系中的基层政府无法将公共规则抽象化、一般化，从而产生了乡镇干部晋升中的关系运作。但关系运作的持续后果会使官员对关系的认同胜于对公共规则、公共理念的认同，进而使制度运作丧失其道德信念层面上的“基础秩序”，显现出权宜性和随意性。
