“金砖五国”服务贸易竞争力比较分析

本文在综合既有关于国际服务贸易的理论及实证研究成果的基础上,以贸易竞争优势指数(TC指数)和出口比较绩效指数(CEP指数)为分析工具针对1997~2011年"金砖五国"各个服务贸易部门国际竞争力进行了纵向比较分析;再分别对按照生产要素密集度划分的劳动、资本及技术密集型服务的TC指数和CEP指数进行加权综合得到五个国家的综合国际竞争力指数并进行横向比较研究。通过对巴西、俄罗斯、印度、中国和南非贸易数据的分析及比较研究,总结这五个新兴市场国家服务贸易的发展现状、竞争优势及发展趋势。     

Public Services after Austerity: Zombies,Suez or Collaboration?

Public services—in the UK and elsewhere—are under considerable pressure, not just from austerity, but also from a variety of social, demographic and technological changes (in effect ‘austerity plus’). In this context, three broad options are open to policy‐makers: continue with tried‐and‐tested approaches while spending less money, which in the UK means a reliance on ‘New Public Management’ (NPM); withdraw completely from certain public services; or develop new approaches to public administration. We argue that all of these approaches have been attempted in recent years, but it is the final option that is most interesting and potentially the most beneficial. In this article, we examine experiments with these new approaches in responding to ‘austerity plus’. In particular, we examine various attempts at ‘collaboration’ in public services and discuss the risks associated with them. We conclude by setting out the extent to which policy‐makers have moved beyond NPM and suggesting some of the benefits that this could bring.     

政府应对公共危机的“危机”——以北京“病猪肉”谣言短信事件为例

谣言短信危机是信息社会中一种新型的公共危机。其显著特点是新传媒参与公共事件，这对于新时期政府能力和公信力提出了挑战。“病猪肉”谣言短信事件作为典型案例。暴露出政府危机管理中信息获取能力和危机公关意识薄弱、公共信息发布机制缺失以及政府公信力走低。因此，建立“公众本位”的信息收集发布机制、信息发布的法律规范体系和现代服务型政府的危机应对模式是政府应对此类危机的重要议题。     

《治安管理处罚法》实施研究

实施《治安管理处罚法》需要注意:《治安管理处罚法》与《行政处罚法》应当是特别法与一般法的关系;与《刑法》之间存在着交叉和衔接关系;实施治安管理处罚不能放弃处罚法定原则;主观状态不应作为治安管理处罚的构成要件;公安机关在确认治安违法事实时应当遵循多元化的证明标准。     

Civil Liberties and the Korean War

This article addresses the unsuccessful attempts to suppress free speech during the Korean War, and in particular explains the attempts to silence three reporters of alleged atrocities by United Nations forces. In the absence of carefully targeted legislation, the three individuals – Alan Winnington (a journalist), Monica Felton (a women's movement activist) and Jack Gaster (a solicitor) ‐ were threatened with or investigated for prosecution for treason or sedition, and Winnington was unable to renew his passport until 1968. Drawing heavily on archival sources (including MI5 files, which unusually fail to redact the identity of one of the lawyers who was reporting to Special Branch about Gaster's activities), the article explores the threat to civil liberties from the administrative as well as the legislative and the judicial power of the state. The article concludes by drawing contemporary parallels, and highlighting the continuing relevance of the writings of Winnington, Felton and Gaster.     

自治与法治的协调统一——从长春亚泰案谈行政协会的性质与法律监督

经过二十多年的市场化改革 ,我国出现了如律协、足协、注册会计师协会等具有自治属性的社会组织 ;这些组织具有全体性、自治性和公权力性 ,承担着原由政府部门行使的管理职能 ,成为公共行政的主体。对这些组织既要予以法治监督 ,又要注意保护其行业自治权 ;在司法审查时 ,需要从设置诉前行政救济程序与合理限定司法审查范围等方面防止司法权过度介入其自治权。     

Knowing the past to understand the present - issues in the contracting for cloud based services

This article builds on our previous introductory article to cloud computing ([2009] 25 CLSR 270-274) and seeks to explain how cloud computing has evolved. We then discuss how this evolution impacts on key contractual and legal considerations and how the treatment of these considerations might differ from their treatment in traditional IT supply agreements.     

公用事业公私合作的新思路——政府应对公用事业市场化的新问题

我国公用事业推行市场化之后出现了一系列新问题,如:国有资产流失严重,政府官员腐败机会增加,公共物品和服务从一种垄断走向另一种垄断,等等。出现这些问题的根本性原因,是政府与私营企业的关系没有理顺,仍然沿用简单的“管与被管”的思路来理解政企关系。要走出困境,必须从政府与私营企业的“伙伴关系”来寻找新思路。     

浅谈民警心理健康与民警培训

面对错综复杂的执法环境、面对繁重的公安保卫任务、面对执法过程中遇到的各类意外事件,基层公安民警心理上承受的压力越来越大。因此,心理健康对公安民警特别重要。重视心理健康调适,加强对民警的心理健康教育和培训,是各级公安机关必须重视的问题,也是民警培训工作的一项长期目标。     

地方政府决策与公众参与——以怒江大坝建设为例

市场经济导致的利益分化,使得地方政府越来越多地在利益冲突的背景下进行决策,也使得越来越多的利益相关者在不同层面上介入决策。有鉴于此,需要以怒江大坝决策为例,描述地方政府决策过程中公众参与的一般特征,并对这一过程涉及的利益冲突与表达、抑制决策者的自利偏好、决策程序以及潜规则等问题加以分析。
