广东省法学会禁毒法律政策研究会2013年学术年会综述

2014年1月7日,广东省法学会禁毒法律政策研究会2013年学术年会在广州市举行,会议主题是"新刑事诉讼法背景下禁毒执法、司法热点问题研究"。会议采取专家论坛与专题论坛相结合的形式,为理论界与实务界两者的契合提供了平台,创新了年会模式。随着新刑事诉讼法的实施,毒品侦查工作面临着严峻挑战与发展机遇,广东毒情严重,网络贩毒、利用物流和快递贩毒、外国人贩毒等成为近年凸显的犯罪形式,毒品案件侦查中证据的收集与运用存在诸多不足,没能形成证据链条,电子证据获取与运用困难,会议就上述几方面展开了热烈的讨论。     

Bringing People Back in Politics: The Role of Civil Society,Political Parties,and Regional Organizations in a Changing Middle East

The Introduction briefly presents the ideas behind this collection of articles, namely to analyze popular mobilization and the role of civil society, political parties, and regional organizations in relation to the developments in the Middle East and North Africa (MENA) over the last years, and to discuss theoretical approaches and paradigms of relevance for the analysis of these new regional dynamics. The MENA region experienced, in connection with and following the Arab uprisings, a hitherto unseen popular mobilization. Despite the recent highly problematic situation in several Middle Eastern states, the Introduction emphasizes the continued relevance of focusing on a repoliticized MENA reality. The Middle East is still on the move away from the established image of unshakeable authoritarianism attributed to the region, which made the upgrading authoritarianism paradigm seem forever relevant and without any realistic alternative for the decades to come—therefore, the relevance, offered in this collection of articles, of bringing people back in politics.     

Problematising the community-contribution requirement in participatory projects: evidence from Kyrgyzstan

This article examines the extent to which the World Bank-funded Village Investment Project in Kyrgyzstan promoted empowered participation of citizens in co-financing arrangements. It is based on in-depth qualitative interviews and focus-group sessions in 16 rural communities. The study found that the poor and marginalised did not always have the ability to engage in the processes of consensus building, influencing local decision making, and exercising free choice with regard to the contribution requirement. Participatory projects must carefully design arrangements and operational procedures for the co-financing component of the project, in order to support citizen empowerment and democratic inclusion.     

Prevention of sexual violence by those who have been sexually violent

This article argues that indeterminate sentencing is the optimal means of preventing recidivism among sex offenders, both as an instrumental matter and jurisprudentially. Once a person is convicted of an offense, the duration and nature of sentence should be based on a back-end decision made by experts in recidivism reduction, within broad ranges set by the legislature. This position is defended against a number of objections, including claims that such a system relies on flawed risk assessments, ignores societal views of justice, denigrates offenders and victims, undermines deterrence and norm enforcement, depends too heavily on costly, uneven and demoralizing risk management schemes, and, as a result of one or more of these objections, is unconstitutional.     

风险社会与侵权损害救济途径多元化

现代风险社会给人们带来更多的不确定性和不安全感,传统侵权法律制度在面对不断涌现的新型侵权行为以及灾难性、大规模的人身损害事故时存在局限性。对此,我国《侵权责任法》在功能定位、保障范围、加害事由、归责原则等方面的制度设计,对风险社会的现实状况和生活形态作出了回应,尤其强化了侵权法的救济功能。侵权法的这种制度变化改变了我国责任风险的原有形态;同时,在侵权法律体系内也不可能完全解决对受害人的赔偿和救济问题,由此给责任保险和社会保障制度提供了更大的发展空间。在以侵权法、责任保险和社会保障为主体的多元救济体系中,各项制度之间应注意协调,避免赔偿不足或赔偿过度。     

建设两型社会试验区：约束条件与改革框架

该文着眼于分析武汉-长株潭两型社会试验区建设面临的主要约束条件,即经济发展阶段制约、政府公共治理机制缺失、技术硬约束、文化理念落后等,并在此基础上探讨了两型社会建设中地方政府的短期行动安排与中长期改革框架。     

English Education Policy after New Labour: Big Society or Back to Basics?

This article considers possible future directions for education policy and public service governance under the Conservative‐led coalition government. The article considers the extent to which Conservatives might develop a distinctive strategy for managing public services that breaks decisively with that of the New Labour era. The coalition faces a markedly different political and economic context for public service reform compared to its predecessor. This article argues that these contextual constraints make a continuation of the New Labour governing strategy less viable, but unresolved tensions in the coalition education policies enacted to date may hinder the development of a novel project for education reform. As a consequence, the New Labour education project seems likely to remain largely intact for the foreseeable future.     

大众社会与人的大众化

大众社会不仅是一个指涉社会形态的概念,更是一个与社会结构变迁相关联的概念。在大众社会概念与现实的基础上,作为人本身怎样从自己的家中被分离出来,又怎样在陌生的地域成为自己的陌生人,并再度在被社会化的过程中走向大众化,这个过程的循环往复,既包含了个人角色的演变,也呈现了人与人之间构建社会关系的基础。也正是在这一过程中,大众社会在个体的场内落下了根,个体在大众社会的现场中也不再是漂浮的了。     

赖昌星“难民”案的法律分析

赖昌星携家人潜逃加拿大后,向加拿大移民部提出了"难民"申请,由于加拿大难民制度完善而复杂,该案也一波三折。本文就赖昌星"难民"案所涉及的加拿大难民法律制度、该案争讼的焦点和该案目前的进展与前景做了简要介绍和分析。     

The Big Society: Back to the Future

This article contributes to the steady flow of critiques of the big society idea contained in The Political Quarterly. It focuses chiefly on two sets of parallels. The first is between the big society and the policies pursued by the Thatcher government which, despite their obvious rhetorical differences, contain many striking similarities, including their neoliberal origins, application of the ‘crowding out’ thesis and uncritically idealised notions of community. The second is between the big society and a policy with the same name pursued doggedly by the Chinese Communist Party for nearly 20 years until being abandoned as a failure. Lessons for the Prime Minister's flagship policy are drawn from the Chinese experience. The article concludes with a welcome for the rediscovery of the social by public policy and some suggestions as to how a more participative and democratic state could follow from this breakthrough.
