直觉在公安执法决策中具有重要作用。直觉决策一般适用于以下几种情境;时间紧迫、信息有限、新情况、新问题和危急情境以及结果具有两极性。公安决策者应注意从知识、经验、胆识、自信和权威等方面培养自己的直觉决策能力。

Adding to the Controversy? Civil Society’s Evaluation of the National Conference Dialogue in Yemen

ABSTRACT

This article assembles a picture of Yemen’s 2013–14 National Dialogue Conference (NDC) by collecting perspectives from local civil society organizations (CSOs), which are contrasted to the views of international commentators. Despite all efforts by internal parties as well as the international community, the dialogue failed to avert war, which broke out shortly after. Through interviews with 50 CSOs, we reconstructed the reasons for failure, as well as paying attention to the observed strengths of the dialogue. Half of the consulted organizations were directly involved in the NDC, either as an invited participant or in a brokerage role. The other half concerns outside observers. We identify aspects on which the opinion of the CSOs converge, but also highlight striking divergences depending on insider/outsider status. In contrast to the view espoused in the international literature, the CSOs overall feel that, in spite of all its procedural and substantive flaws, the NDC was a significant junction in the long road towards peace and stability and laid important groundwork for future dialogues.     

The judiciary and post-election conflict resolution and democratic consolidation in Ghana’s Fourth Republic

ABSTRACT

In recent times most elections in Africa have been fraught with post-elections conflicts that have had dire consequences on citizens. Kenya, Ivory Coast and Zimbabwe are few of these cases. This makes post-election conflict resolution a very important aspect of the electoral process deserving enormous attention. However, extant literature has not accorded it the needed attention. It is as a result of this, that this study investigates the nature of post-election conflict resolution in Ghana’s Fourth Republic. The study, based on a qualitative case study approach, found among others that, the Courts have been instrumental in consolidating democracy in Ghana, and stakeholders are devotedly operating within the legal framework governing elections, despite logistical, law enforcement and justice delivery challenges. The study being conscious of the progress made over the years concludes that, where democratic institutions are consolidating, the use of unconventional means to resolve conflicts is usually not an option.     

保证和抵押——对同一债权的双重担保

保证和抵押的双重担保是指对同一债权的全部或者一部的共同担保。债权人首先实现哪种但保方式 ,应当区分担保的方式 ,由债权人做出选择。抵押是“物的担保” ,保证是“人的担保” ,这决定了在债权人实现抵押权的情况下 ,抵押人不享有代位权 ,保证人自然免除保证责任。相反 ,在债权人要求保证人承担保证责任的情况下 ,保证人享有代位权 ,抵押权不能自然消灭。因此 ,债权人放弃抵押权的 ,保证人相应地免除保证责任 ;债权人免除保证人的保证责任 ,抵押人则不能以之抗辩。
