民族区域自治法配套法规建设再探讨

<民族区域自治法>要发挥有效的保障作用,必须有一系列配套工程给以强有力的支撑.党中央和国务院非常重视民族区域自治法配套法规建设.民族区域自治法配套法规建设取得了一定成就,但还存在一些问题.国务院及其部委以及自治区和辖有民族自治地方的省、直辖市进一步完善民族区域自治法配套法规建设,是当前我国社会主义民族法制建设的紧迫任务和重要内容.     

The Artist is Present: performing the icon

This article considers the work of performance artist Marina Abramovi?, focusing on the use of reperformance, the practice of hiring others to recreate historical performance works, in her 2010 retrospective at New York's Museum of Modern Art, The Artist is Present. Brawner utilizes Abramovi?'s artistic work with iconography and icon making and draws on her own experience as one of the retrospective's reperformers to highlight both the affective work that went into the creation of the show as well as its function as a religiously inflected meditation of celebrity and art stardom. The artist's work is explored through sources including New York Times art critic Holland Carter's turn of phrase “diva hokum,” a pejorative here reclaimed to mean the process of one's own icon making, a control of image and message that becomes integral to the structure of the work, and a balancing act between the performance and its afterlife.     

Women and War

Susan Hill's novel The Woman in Black (1983) is a radical example of women's Gothic horror. It is a popular ghost story that has been successfully adapted for the London stage. In addition, it offers a social critique of motherhood and contemporary rhetoric surrounding the family. Scullion interprets the novel from several critical perspectives: feminist, psychological, biographical, generic and intertextual. Principally, however, she offers a reading of the novel that engages with its immediate historical context. The contention is that Hill's novel mediates women's anxieties about motherhood and autonomy during the early 1980s when the institution of the family in Britain was an ideological battleground. Set primarily during the 1860s, The Woman in Black exposes Victorian hypocrisy towards the unmarried mother, and indirectly probes the quasi-Victorian values promulgated in the 1980s, during the first term of a Conservative right-wing government. The protagonist of the novel, the eponymous woman in black, resists the lot of the so-called fallen woman. In her physical form, she refuses to submit to Victorian patriarchal values by attempting to reclaim her illegitimate child. In spectral form, she repeatedly inflicts suffering on families by causing the death of their children. Her excessive revenge knows no compassion, and recognizes no boundaries of place and time. Her ghost is never laid to rest. Neither is order restored by the closing pages. Thus the novel, as well as being a popular ghost story, challenges assumptions about women's 'natural' acquiescence and their unconditionally generous responses to husbands, partners and children. Shaped by the social climate in which it was written, The Woman in Black suggests that mothers under extreme pressure have the potential, like any other members of the family, for cruelty to children. Through its forceful rejection of either idealized or derogatory stereotypes of women, this novel belongs to the genre of radical Gothic horror.     

中美贸易摩擦对就业的影响及对策

在"美国优先"的指导思想下,美国特朗普政府对中国意图进行贸易战,借此振兴美国制造业,为底层劳动者创造更多就业岗位。贸易战争背后其实是就业战争。对中国来说,由于对美贸易依赖性较大,因而有可能对国内就业产生比较明显的就业冲击。极端情况下,将会使我国就业岗位减少350-580万个。因此,通过谈判协商是解决贸易争端的最佳策略。而进一步扩大实施"一带一路"发展战略,减少对少数国家贸易依赖,以及加快推进创新驱动战略,将有助于减轻贸易战对我国就业的影响。     

陕甘宁边区高等法院对民事习惯的调查、甄别与适用

从1942年5月开始,陕甘宁边区高等法院通过法院系统内部上下级部署工作和学习任务的形式,以县为单位,由各县审判人员对本县的风俗习惯进行了比较系统的调查和甄别。截止1944年9月,该院共收集到8个县69条具有权利义务内容的民事习惯,并由收集者对之进行了初步的甄别。在此基础上,该院在民事案件的审理中适用了某些习惯。民事习惯的调查、甄别和适用,促进了审判人员对社会的了解和对民事习惯的认知,丰富了民事案件审判工作。该院虽然对所收集到的习惯进行了简单的整理,但未能完成系统的分析,也未制定出相关的政策和规则,因此这次调查未能发挥出更大的作用。     

冷战初期日本南海政策及东南亚战略取向

冷战使日本在美国的全球战略中作用提升,成为反共"防波堤",其具有政治目的性的东南亚"经济外交"呈现出明显的海洋战略取向,且影响至今。因地缘利益、东南亚战略,日本南海政策的基本出发点自冷战开始后始终没变,即追随美国遏制中国政策,对南海诸岛归属问题上采取模糊态度和立场,这为后来南海周边某些国家侵占南海岛礁留下所谓借口。此时日本还曾插足于南海诸岛,由于海峡两岸对南海权益的维护使其非法行为无法为继,但随着经济的发展,日本越来越依赖南海航道和加大南海石油资源的开发,这决定其"关心"南海问题就是势所必然了。     

韩中建交二十一年——论充实、拓展韩中关系与学术交流的重要性

韩中建交以来,双边关系分别经历了"发展阶段"(1992~1998年)、"构建阶段"(1998~2003年)、"提升阶段"(2003~2008年)等三个历史过程。现在,两国关系已经开始进入"强化阶段",即"充实、拓展两国关系内涵阶段"。中国外交部韩半岛事务副代表徐步对韩中建交20年给予了积极的评价。他指出:"在过去二十年间,两国加强了政治互信和战略沟通,韩国是第一个承认中国的完整市场经济地位的国家,是中国主要的贸易伙伴。两国间人员往来十分频繁,在处理国际和区域问题时始终坚持相互沟通与合作的原则。"建交21年来,两国关系取得了飞跃发展,但在诸多领域仍存在矛盾、摩擦。因此,本文在回顾两国关系发展过程中的一些摩擦,并为消除两国关系未来发展障碍提供两点建议。     

When Private Capital Becomes a Security Asset: Challenging Conventional Government/Business Interaction

With the increase of cross-Strait economic activity, the interaction between Taiwanese business people and the Chinese government has gradually changed. As Taiwanese investment grew in volume, so did the number and frequency of contacts between the parties; a more institutionalised form regulating these contacts was established as a result. Nowadays Taiwanese businessmen have become an identifiable factor in Chinese governmental policy implementation; the process also has far-reaching implications. This paper argues that Taiwanese capital has become a Chinese governmental security asset and examines the importance of this factor when discussing conventional government/business interaction. This paper concludes that a superior national interest guides the warm welcome given by the Chinese government to Taiwanese businessmen.

Constitutional values and civil servant recruitment: The principles for filling revenue service positions in Poland

The functioning of public administration should be consistent with the general interest, common to all citizens, and independent from the particularized interests of changing political forces. A condition for the proper functioning of administration is the selection of appropriate personnel to perform the duties defined by the state. According to the premises of this paper, the recruitment of personnel based upon objective criteria is of fundamental importance for the effective realization of the administration's mission. This article analyzes the weaknesses of personnel policy in fiscal administration in Poland after 1989 against the background of the broader process of creating a Polish civil service. The study aims at determining the extent to which the actual relations between politics and administration reflect legal regulations. The article focuses on personnel policy with regard to senior positions in fiscal administration, whose occupants have leverage over decision-making processes and human resources policy in various agencies. It turns out that after every parliamentary election there is major turnover in the personnel occupying senior positions in the fiscal administration offices, that is, the persons associated with the previous governing team are replaced with individuals enjoying the confidence of those who have just come to power. In light of these findings one can infer that, contrary to the constitutional principles guiding the functioning of the government administration in Poland, its politicians have deliberately designed legal regulations in such a manner as to enable them to assume control over fiscal administration.
