行政决定说明理由正趋于成为英国行政法上的一般规则,它和自然正义、正当期待及公正等原则相关联。说明理由是良好行政的基本原则之一,有助于行政机关的自我拘束,有助于程序性权利的保障,有助于法院开展有效司法审查。官员在特定情形下必须为行政决定说明理由,但在特定的例外情形下可豁免于说明理由义务。欠缺理由说明可能导致行政决定无效或者被撤销。在中国,应进一步扩大说明理由的适用范围,对法律、事实和裁量问题予以充分说明。  相似文献

Research on legislative ethics has shown how scandals often trigger ethics reform; yet, the content of the reform often differs from that of the scandal. Why is this the case? And if scandals don't explain legislative ethics reform outcomes, then what does? If not this kind of external shock, then what factor(s) shape legislative reform outcomes? These questions provide the point of departure for a case study of the European Parliament's 2011 ethics reform. Drawing from the legislative ethics literature and from recent theories of institutional change, the article examines the impact of the scandal that initiated the reform, the interests and strategies of reform agents who wanted a quick reform process that would not undermine the EP's independence; and the institutional order in which those actors were embedded. It argues that an institutional logics perspective offers a convincing and comprehensive account of EP ethics reform, and suggests a new analytical framework that might be used by researchers in future research on legislative ethics.  相似文献

This paper contributes to discussions surrounding interest group representation in the European Parliament. Drawing from conceptualizations of legitimacy, and theoretical work on information-access we argue that different procedures bestow a different type of authority to parliamentary committees affecting their legitimacy orientation, in turn impacting the balance between private and public interests mobilised. We assess a population of 10,000 accredited lobbyists, and the procedural output across the 7th legislature’s committees (2009–2014). Our analysis indicates that committees with a higher ratio of Ordinary Legislative Procedures to Own Initiative Reports see greater private interest mobilisation. Conversely, in committees where the procedures’ ratios are inverse we observe greater public interest mobilisation. Theoretically, we provide a novel approach for framing the committee’s nature from a procedural perspective, bridging discussions on interest group mobilisation and the democratic deficit. Empirically, the results overturn the premise of business dominance across the institution’s committees through a unique dataset.  相似文献

Security incidents such as targeted distributed denial of service (DDoS) attacks on power grids and hacking of factory industrial control systems (ICS) are on the increase. This paper unpacks where emerging security risks lie for the industrial internet of things, drawing on both technical and regulatory perspectives. Legal changes are being ushered by the European Union (EU) Network and Information Security (NIS) Directive 2016 and the General Data Protection Regulation 2016 (GDPR) (both to be enforced from May 2018). We use the case study of the emergent smart energy supply chain to frame, scope out and consolidate the breadth of security concerns at play, and the regulatory responses. We argue the industrial IoT brings four security concerns to the fore, namely: appreciating the shift from offline to online infrastructure; managing temporal dimensions of security; addressing the implementation gap for best practice; and engaging with infrastructural complexity. Our goal is to surface risks and foster dialogue to avoid the emergence of an Internet of Insecure Industrial Things.  相似文献

Parliamentary party group leaders (PPG leaders) are crucial – yet understudied – actors in modern representative democracies. Inspired by the literature on parliamentary roles, we test a deductive approach in order to explore the attitudes and behaviours of PPG leaders. Given their common duties, such as monitoring group members and securing party cohesion, we expect that PPG leaders across several countries would exhibit a common pattern that distinguishes them from other MPs. However, neither a common, nor a distinguished pattern of attitudes and behaviour is confirmed by our results based on Partirep MP Survey data. This, together with other theoretical difficulties, points us to the need to study PPG leaders’ roles by using in-depth single-country studies.  相似文献

Drawing on an original dataset covering more than 100 political parties in over 20 European Union Member States, this article analyses how political recruitment procedures affect the proportion of women nominated on party lists in the context of the 2009 European Parliament elections. The findings show that the inclusiveness of the selectorates in the early stage of candidate selection processes is a key determinant of the representativeness of lists regarding their gender composition. Moreover, it is found that neither territorial centralisation nor the inclusiveness of the selectorate in the later stage of candidate selection play a significant role. The key to the puzzle, therefore, lies in the composition of the initial pool of potential candidates and those who make initial nominations.  相似文献

This article is an examination of the rising prominence of House of Commons select committees during the 2010–2015 Parliament, which takes into account the impact of the Wright reforms. The new system of electing committee chairs and members is explored as a central reform that has burnished the autonomy, independence and credibility of the committees. In addition, the characteristics of the coalition government and circumstances entailed by a two‐party executive are seen as factors that have made more robust the neutrality of the committees, which have been looked to ever more urgently as impartial scrutineers of government policy and personnel. As the system has been strengthened and received greater attention from the government, the public and the media, select committees have also come to present a platform upon which certain members and chairs have grown their profile. This phenomenon in turn has added to the desirability of roles on committees, which now present an alternative career route to the ministerial ladder.  相似文献

While the 2014 European Parliament elections were marked by the rise of parties on the far right‐wing, the different patterns of support that we observe across Europe and across time are not directly related to the economic crisis. Indeed, economic hardship seems neither sufficient nor necessary for the rise of such parties to occur. Using the cross‐national results for the 2004, 2009 and 2014 EP elections in order to capture time and country variations, we posit that the economy affects the rise of far right‐wing parties in more complex ways. Specifically, we compare the experience of high‐debt countries (the ‘debtors’) and the others (the ‘creditors’) and explore the relationship between far right‐wing party success on the one hand, and unemployment, inequality, immigration, globalisation and the welfare state on the other. Our discussion suggests there might be a trade‐off between budgetary stability and far right‐wing party support, but the choice between Charybdis and Scylla may be avoided if policy‐makers carefully choose which policies should bear the brunt of the fiscal adjustment.  相似文献

Public policy initiatives aimed at the prevention of future financial crises originate with global harmonization in the form of executive standards issued by the Basel Committee on Banking Supervision. This article explores the role of the European Parliament (EP) in the process of adapting the standards in European Union legislation passed in 2013 as the Capital Requirements Regulation/Capital Requirements Directive IV. Unlike accounts casting the EP as increasingly dependent upon outside sources in order to meet its enhanced legislative role, we find it increasingly dexterous in developing and using in‐house policy ideas, expertise, and not least a common sense of institutional purpose. Notable EP successes in final legislation include (but are not restricted to) a headline cap on bankers' bonuses in the face of entrenched business and national interests. The argument is developed by drawing upon a broad range of interviews together with other primary and secondary sources, tracing the contribution of the EP from the early stages of agenda‐setting through to the development of an “esprit de corps” among the committee lead team which survived intact throughout the “black box” of trilogue negotiations. Besides illuminating the notoriously opaque trilogue process, the analysis also contributes to contemporary debates about whether the EP's increased legislative powers are resulting in a shift away from its traditional allegiances with diffuse interests toward a greater engagement with producer sources in order to fulfill requirements for policy expertise.  相似文献
