American Indian Tribes: ``Not as Belonging to But as Existing Within'

This article is an extended analysis of the historyand anomalies in the doctrine of American Indiantribal sovereignty. I explain that America gainedindependence, but took Indian land and colonized thetribes just as it had been colonized under theBritish. It asserted sovereignty for itself, butsubordinated the once independent tribes with aparadoxical semi-sovereign status as `dependentdomestic nations', all of this justified by the racialand cultural otherness of Indians. Using a Lacanianperspective, I show that America was founded on a`wound' or inconsistency at the heart of itsideological and constitutional order. In order torectify the inconsistencies that the initial `wound'produces, the law and political order havecontinuously had to adopt fictions (legal and racial). American law and policy has never been able to settlethe ambiguous doctrine of Indian sovereignty. As aresult, the law circles round and round in trying todefine it, and asserting and denying it, all in anunsuccessful attempt to make the constitutional orderwhole. It cannot succeed, however, since the ultimatesolution is an American sovereignty which, like God,admits of no limitation.

Alliance of Civilizations： The global peace project of the 21st century

The Alliance of Civilizations was established in 2005, at the initiative of the Governments of Spain and Turkey; under the auspices of the United Nations for inter civilizations dialogue to bridge the gap between the West and Muslim world. This article analyzes advantage and disadvantage sides of the success of this initiative.     

慢病毒载体介导的西尼罗河病毒prME蛋白的表达

将西尼罗河病毒(WNV)的主要免疫原性基因prME插入HIV-1慢病毒载体pHR中,构建了转移质粒pHR-WNV/prME。在脂质体介导下,将该质粒与p△8.2、pVSV/G共转染293T细胞,48h后收获细胞上清。将上清转导正常的293T细胞,通过报告基因荧光观察、间接免疫荧光检测。结果表明,利用HIV-1慢病毒载体系统包装得到了假型病毒,可以高效转导293T细胞,并实现了WNVprME基因在被转导细胞中的表达,从而为基于慢病毒载体的WNV新型疫苗的研制奠定基础。     

Beyond the Z-score: A novel measure of bank stability for effective policymaking

This article looks beyond Z-score and proposes a novel methodological framework to build an all-encompassing indicator of bank stability for individual banks using the optimisation-based ‘benefit-of-the-doubt (BoD)’ approach. Unlike other available approaches, this approach is totally data-driven and generates endogenous weights to aggregate sub-indicators of bank stability and dimensions. Further, the final outcomes are not limited to a scalar measure of bank stability. The unique optimal weights offer valuable policy-relevant insights and highlight the most precarious areas of stability, which demand the immediate attention of the bank's management and the industry regulators for both micro-and macro-level policymaking. Using the data of Indian public sector banks operating in the year 2018, the study illustrates the proposed framework to obtain a holistic indicator of bank stability, defined on 14 ratio sub-indicators and 5 broad dimensions (soundness, asset quality, profitability, management efficiency, and liquidity) of bank stability.     

Examining the relationship between corporate social responsibility,corporate reputation and brand equity in Indian banking industry

This study is an attempt to explain the relationship between corporate social responsibility (CSR), corporate reputation, and brand equity in India's banking sector. The study uses Carroll's Pyramid of CSR and the ‘triple bottom line concept’ as the theoretical bases for proposing a conceptual model. The data pertaining to 482 saving bank customers were analysed using structural equation modelling for this study. The integrated effect of CSR and corporate reputation on brand equity has been examined using the analyses of both the direct and indirect model paths. The findings show that corporate reputation partially mediates the relationship between CSR and brand equity, and that there exists a direct relationship between CSR and brand equity. This research has significant implications for CSR managers seeking to gain a competitive advantage in the industry by focusing upon the CSR activities that help an organisation build a positive corporate reputation, leading to a high level of brand equity.     

认同视角下的土耳其对外政策

国家行为由国家利益决定,国家利益源于国家认同。土耳其持有突厥、伊斯兰、西方和外来者等多重身份认同并推崇西方价值观,这些身份认同和观念对土耳其对外政策均发挥不同程度的影响,但西方文明成员和欧洲国家是土耳其的核心身份,整体上决定着土耳其以西方为导向的对外政策,尽管这些身份发生冲突时,国家利益偏好和对外政策导向会受到不同程度的冲击。     

美国等西方国家对华“分化”策略的新变化及对策思考

基于政治制度和意识形态的冲突、地缘政治的竞争和战略的不信任,以美国为首的西方国家对华实施西化分化的战略图谋一刻也没有松懈。近年来,中国的快速发展迫使美国调整了对华实施分化战略的策略;同时,由于中国正处于社会转型、改革深化的关键时期,社会矛盾的增多、社会冲突的加剧为美西方的分化活动提供了诸多契机和借口。面对美国等西方国家的分化活动出现的新形式与新特点,为了维护国家的政治安全,中国不仅要在策略方面进行应对,还需要在战略层面提出适应国家整体发展的顶层设计,更为重要的是在软实力上构建一套让全世界都信服且能与西方相抗衡的价值体系。     

西方法理学的生成

西方法理学在法学史的意义上被称为西方法律思想史,是生成于西方特定时空环境和独有的哲理基础上的法律思辩。若泛泛而论,作为法的一般理论的西方法理学甚至先于法学而出现。但是严格说来却是十九世纪法学分化的结果,法学是其原生形态。考察词源,西语“法理学”、“法哲学”虽为同义语,其意蕴却有所不同,中经复杂的语言流转,嬗变出现代汉语“法理学”的名称。
