Google liability for misleading or deceptive conduct: Australian perspective

On 6 of February 2013, the Australian High Court handed down an important decision in respect of the Google Inc's (Google) appeal against the decision of the Full Federal Court of Australia, holding that Google a search engine operator was not liable under s 52 of the Trade Practices Act (TPA) 1974 (Cth) for misleading or deceptive conduct (in respect of misleading advertisements published using Google's online ‘AdWords program’). The decision of the High Court is of great significance for jurisprudence on misleading and deceptive conduct with its broad implications for search engine providers such as Google, advertisers and trademark owners.

中国对船员外派机构实行海事行政许可制度,现行制度存在许多不必要、不可操作、相互矛盾的苛刻规定,不仅与《2006年海事劳工公约》所代表的国际立法发展趋势不符,同时也与上海自贸区实施的负面清单管理制度格格不入.在全面分析中国现行法律法规对参与船员外派服务的各类机构资质要求和监管规定的基础上,结合自贸区监管体制改革的新举措,对现行船员外派机构行政许可制进行了反思,并对船员外派机构在今后一段时间的发展进行了展望.     

中国自贸区建设的新特征:基于中国在欧洲实践的考察

多边贸易谈判进程举步维艰,使各国对双边自由贸易区谈判和建设更加重视。新近,区域和双边贸易安排也已成为中国促进贸易发展的新平台,中国正着力构建自身的自贸区世界版图。在区域自由化进程中,一方面中国积极开展与亚太国家的自贸区谈判;另一方面,中国并没有忽视与欧洲国家的经贸联系。2013年《中国-冰岛自贸区协定》、《中国-瑞士自贸区协定》相继签署。基于对上述自贸区协定的考察,不难发现中国自贸区建设正呈现出关注海外投资企业、注重协定实际效果、友好解决贸易摩擦、不断推进新领域的开放和合作等特征。中国在欧自由贸易区建设有助于保护中国的海外投资企业,深化与欧洲其他国家的贸易交往;有助于提升中国在全球贸易的话语权,防止被边缘化。     

An Uncertain Future for the BBC World Service

In recent years, the BBC World Service has undergone the most radical overhaul of its governance, finance and working practices since the Second World War. In examining these changes, the Foreign Affairs Select Committee report on The Future of the BBC World Service articulates ‘clear differences’ between it and the BBC about how the World Service should be governed, and ‘serious reservations’ about the transfer of funding in April this year from government grant‐in‐aid to the licence fee. With a new BBC Charter due in 2017, will the distinct ethos and culture of the World Service survive this major reorganisation?

近几年来,中国与东盟之间的稻米贸易发展迅猛,不断增长的趋势明显,但双方稻米贸易的不稳定性与不平衡性也显得尤为突出。本文从实证分析的角度出发,在探讨双方稻米贸易总体趋势的基础上利用出口集中度指数、显性比较优势指数、贸易互补性指数对其动态与前景进行分析。研究发现,双方稻米贸易具有市场地位极不对等、比较优势差异较大、贸易互补性较强等特征。本文对中国与东盟稻米贸易的前景进行展望。

中国参与和推动东北亚区域经济合作的战略

Editorials in national development: Perceptions of Nigerian journalists

This study examines the self‐reported perceptions of the role of editorials in national development for a purposive sample of 348 full‐time, salaried Nigerian journalists on nine national newspapers in two newspaper ownership groups: private and government. Three major findings are indicated.

The first finding is that, on seven‐statement comparisons of the role of editorials in national development, government journalists perceived their editorials as more supportive of the government than did private journalists, a result largely reflective of government newspapers’ persuasive role in behalf of government agencies.

The second finding is that ownership of newspapers is not a particularly strong factor in journalists’ perceptions of the role of editorials in development. Such a finding calls into question the rationale for the continuing case for private ownership of Africa's media institutions as a solution to the limitations of the region's media in exercising independent, effective, and persuasive influence on development.

Finally, because this study indicates that newspaper ownership is occasionally not a factor in the perception of the role of editorials in development, it questions the implications of the simple, traditional distinction between government and private newspapers for national development in sub‐Saharan Africa.     

Mortal threat: Latvian Jews at the dawn of Nazi occupation

In late June 1941, Nazi Germany stormed the borders of the Soviet Union, occupying the three Baltic republics within weeks. By the end of 1941, a significant proportion of the Jewish population had been murdered by German forces and local collaborators. In the days before full Nazi occupation of the territory, Latvia’s Jews confronted the question of whether to flee into the Russian interior or stay in their communities. History shows that this would be a critical choice. Testimonies and memoirs of Jewish survivors illuminate the competing motivations to leave or to remain. This article highlights the key factors that figured into these calculations and the interaction between individual agency and structural opportunities and obstacles in determining where Latvia’s Jews were when Holocaust in their homeland began.
