培养大学生创新意识是国家创新体系可持续发展的要求

国家创新体系建设是提升国家科技竞争力、提高国家综合实力的一项战略。大学作为国家创新体系建设的主体，承载着培养高素质的创新人才的重任。大学生是国家、民族的未来，大学生创新意识、创业精神的培养直接影响着国家创新体系的可持续发展，也是高等院校实践科学发展观的本质要求，必须加强对大学生创新意识、创业精神的培养途径的探讨与研究。     

验资机构对验资委托人的民事责任及其认定

验资机构和验资委托人之间的委托合同以委托人与验资机构之间的相互信任为前提,属于双务、有偿合同、不要式和诺成的特别委托合同。验资机构对验资委托人的民事责任存在契约责任与侵权责任竞合的情形。损害赔偿是验资机构对验资委托人承担民事责任的主要方式。由于委托人或第三人的原因而导致验资机构出具的验资报告与实际状况不符,委托人或第三人应当承担相应的责任。对于委托验资合同的免责条款的效力,应当从我国现行合同立法的规定和合同权利义务以及风险分配的合理性两个方面出发加以认定。     

Weakening forensic science in Spain: from expert evidence to documentary evidence

An amendment in 2002 to the Spanish Code of Criminal Procedure converted into documentary evidence the expert reports prepared by official laboratories aimed at determining the nature, weight, and purity of seized drugs. In most cases, experts are spared from appearance before the courts. This is likely to be extended to other forensic fields. After an overview of criminalistic identification in current forensic science, the objectivity and reliability concepts used by jurists and scientists are considered by comparing the paradigm of individualization with that of likelihood. Subsequently, a detailed critical study is made on the above-mentioned Spanish legal reform, and a comparison is made with the decision on the Melendez-Diaz v. Massachusetts case as ruled by the Supreme Court of the United States. Although the reform is in compliance with the Spanish Constitution, it is at odds with science, in particular regarding the logic underpinning the scientific evaluation of evidence.     

检察机关提起民事诉讼:法理、价值及其程序建构

授权检察机关提起民事诉讼为当今多数国家民事诉讼立法的共同选择,我国虽对此未作规定,但实务部门已进行了颇具启发性的探索。检察机关提起民事诉讼具备法理上的正当性,有利于维护社会公益,实现社会公正,提高诉讼效率。我国立法应确立检察机关提起民事诉讼制度。     

社区治理模式转型下的农民参与"新农合"分析——以内蒙古姚村为例

以往对农民参与新型农村合作医疗(简称新农合)的研究缺乏从农村社区治理视角的分析。以内蒙古姚村农民参与新农合为例,从社区治理模式转型这一视角分析农民在参与新农合制度中存在的不足,认为农村社区治理模式在由宗族型向由自治组织型的转变中,农民参与社区公共事务在参与决策制定、参与过程和参与结果的掌控方面存在缺乏组织依附、自我管理差的不足。加速自治组织的完善,克服农民的原子化倾向,提升农民社区参与程度,才能保证惠农支农政策的实施。     

建立我国海外投资保险制度体系的法律思考

本文从海外投资保险制度的最核心部分———代位权进行探讨 ,对两种类型的海外投资保险制度进行了法理分析 ,阐述了我国应建立双边的海外投资保险机制 ,同时应充分利用《汉城公约》和《华盛顿公约》对我国海外投资所提供的保障作用。     

略论侦查完美主义

侦查完美主义是侦查的理想状态。它的理论前提是国家赔偿制度、侦查法制化和侦查效益论;它注重侦查前周密策划,但又不排除侦查时随机应变;它主要体现在适当完美的侦查目标、完美的侦查人员、完美的侦查时空、对“可能”与“细节”的把握、取得最佳连锁反应、巧妙衔接侦查手段等方面。侦查完美主义必然由于侦查方的素质与犯罪的隐蔽,时间推移下的情况不断变化等因素而受到限制。     

What Is “Successful” Resettlement? Refugee Narratives From Regional New South Wales in Australia

This paper explores how people from refugee backgrounds experienced regional resettlement in New South Wales, Australia, by focusing on their narratives of determinants of “successful” resettlement. Semi-structured interviews with nine refugee participants in 2016 revealed challenges in relation to employment, social networks and relationships, and support services. While such challenges are consistent with research in metropolitan cities, there were limitations unique to the regional context. Resettlement policies have contradictory elements inherent to their design that can be detrimental to what refugees consider as successful resettlement. This has particular implications for more recent schemes like the Safe Haven Enterprise Visa (SHEV).     

An evaluation of measurement uncertainty of trajectory angles using a 3D laser scanner

Measuring trajectory angles of bullet defects at a crime scene is an important part of crime scene investigation as these angles can be used for shooting incident reconstructions. The Washington State Patrol Crime Scene Response Team (WSP CSRT) had a desire to report and use measured trajectory angles. To report quantitative measurements, a statement of uncertainty for the measurement must also be reported due to an accreditation requirement through the ANSI National Accreditation Board (ANAB), through which the WSP CSRT is accredited. This evaluation examined the measurement uncertainty of the 3D laser scanning method that the WSP CSRT utilizes for measuring the vertical and azimuth angles from trajectory rods fitted to bullet defects. Three studies were performed which examined the variation of vertical and azimuth angle measurements from trajectory rods on flat surfaces, the variation of azimuth angle measurements from a trajectory rod on a curved surface, and a traceability study with known vertical and azimuth angle measurements. Seven common substrates were selected as target materials and were shot with 9 mm Luger and 0.45 Auto caliber bullets. A vehicle with one bullet defect was utilized for the curved surface study. The WSP's current fleet of Trimble X7 3D laser scanners, the WSP Criminal Investigation Division (CID) Detectives who operate these scanners, and the Forensic Scientists responsible for trajectory rod placement and angle measurements were utilized. An overall measurement uncertainty of +/− 2.6 degrees at an approximate 95% confidence interval was determined for all trajectory angles measured from trajectory rods.     

More Money,More Problems: Quality Assurance in Higher Education in Chile (2006–2018)

Since the radical neoliberal reforms to Chilean higher education of the 1980s, the creation of a quality regulatory system has been gradual and unfinished. It was only in 2006 that a law created the National Commission for Accreditation and two instruments: programmes and institutions accreditation. This article analyses the design and implementation of the latter policy instrument using mixed methods, including in-depth interviews with key actors. Our findings show that, although regulations have introduced quality assurance as a key element in higher education policy, the link established between accreditation and financing has generated incentives that dangerously weaken these quality mechanisms.
