The positive role of the European Union (EU) in the democratization process in post-communist countries has been amply documented. The pre-accession conditionality was to a large extent the tool used to enhance adoption of norms, and implementation of policy. In this context, it is less clear what happens after countries join the EU and conditionality is no longer an option. This article seeks to provide an answer by analysing how the EU can influence democratic governance after accession of a new member state. In particular, it focuses on the reactions of EU actors in two institutional conflicts (the 2007 and 2012 presidential impeachment referendums) in Romania. The main findings indicate how EU leverage on domestic politics remains possible, though the effectiveness of involvement, monitoring and evaluation of respect for democratic principles depends on a complex interaction of international and domestic actors.  相似文献

This article explains the complex intertwinement between public and private regulators in the case of robot technology. Public policymaking ensures broad multi-stakeholder protected scope, but its abstractness often fails in intelligibility and applicability. Private standards, on the contrary, are more concrete and applicable, but most of the times they are voluntary and reflect industry interests. The ‘better regulation’ approach of the EU may increase the use of evidence to inform policy and lawmaking, and the involvement of different stakeholders. Current hard-lawmaking instruments do not appear to take advantage of the knowledge produced by standard-based regulations, virtually wasting their potential benefits. This fact affects the legal certainty with regards to a fast-paced changing environment like robotics. In this paper, we investigate the challenges of overlapping public/private regulatory initiatives that govern robot technologies in general, and in the concrete of healthcare robot technologies. We wonder until what extent robotics should be governed only by standards. We also reflect on how public policymaking could increase their technical understanding of robot technology to devise an applicable and comprehensive framework for this technology. In this respect, we propose different ways to integrate the technical know-how into policymaking (e.g., collecting the data/knowledge generated from the impact assessments in shared data repositories, and using it for evidence-based policies) and to strengthen the legitimacy of standards.  相似文献

There is a need for the countries of Southern Africa to invest in building infrastructure, for which purpose they can be expected to utilise the services of multilateral development banks (MDBs). MDB-funded infrastructure projects often become arenas for debate over the roles and responsibilities of different actors in the development process. This article discusses the fact that there is no longer a clear consensus on the relative responsibilities of governments, MDBs and non-state actors in regard to infrastructure projects, and analyses how these new tensions in the relations between these three actors could complicate efforts to develop the infrastructure so urgently needed in Southern Africa.  相似文献

In a rural agrarian economy like that of Nepal, land has traditionally been a primary source of livelihood and security, as well as a symbol of status. Thousands of poor farmers are completely dependent on land for their livelihoods, yet not all of them have access to or control over this fundamental resource. Negotiation for access to land has been a lengthy and complicated process. It remains so in the changed political context of Nepal, where increasing numbers of emerging actors need to be considered, often with conflicting claims and counterclaims. In this context the traditional ways of thinking need to be revised, both with regard to the negotiating process and the mechanisms of land reform, to accommodate the country’s recent and ongoing massive socio-economic transformation.  相似文献

ABSTRACT

The Sudan's Comprehensive Peace Agreement (CPA) of January 2005 is the outcome of regional and international mediation led by the Inter-Governmental Authority on Development (IGAD)1 and the IGAD Partners’ Forum broadened to include the United States of America, Norway, the Netherlands, Canada, Italy and the United Nations. Five years into its implementation the peace agreement appears to have transformed the war between North and South Sudan into a series of engagements of conflicting nature. Numerous contradictory actions by both the Sudanese People's Liberation Movement (SPLM) and the National Congress Party (NCP) (the main political forces behind the CPA) have been noted during the ongoing implementation process (Grawert forthcoming 2010; Grawert and El-Battahani 2005; Wassara 2008). Although internal Sudanese forces are the key actors in implementing the CPA, external forces are critical in providing the support and pressure needed for a complete realisation of the peace deal. The New Regionalism Approach (NRA), as advanced by Grant and Soderbäum (2003), is instrumental in understanding this dynamic. This article is based on the result of a study that seeks to examine why positive engagements of external forces are needed for a timely implementation of the Comprehensive Peace Agreement.  相似文献

Promotion of democracy in post-war and post-conflict societies became a hot topic during the 1990s. External actors linked their peace-building efforts to the promotion of democracy. Four modes of promotion of democracy by external actors can be distinguished: first, enforcing democratization by enduring post-war occupation (mode 1); second, restoring an elected government by military intervention (mode 2); third, intervening in on-going massacres and civil war with military forces (‘humanitarian intervention’) and thereby curbing the national sovereignty of those countries (mode 3); and fourth, forcing democracy on rogue states by ‘democratic intervention’, in other words, democracy through war (mode 4). In this special issue we consider the legality, legitimacy, and effectiveness of the four modes where the international community of states not only felt impelled to engage in military humanitarian or peace-building missions but also in long-term state- and democracy-building. All cases analysed here suggest that embedding democratization in post-war and post-conflict societies entails a comprehensive agenda of political, social, and economic methods of peace-building. If external actors withdraw before the roots of democracy are deep enough and before democratic institutions are strong enough to stand alone, then the entire endeavour may fail.  相似文献

ABSTRACT

Focussing on the example of domestic worker migration, this article seeks to explore the regulatory regimes that control the flow of migrants across Southeast Asia. Although at first glance this appears to be a deeply statist regime, the aim of this article is to complicate this picture and to look at the role that private power and authority places in shaping migration governance. The article focusses on three interrelated issues: (i) how states have increasingly come to regulate migration via partnership arrangements with private sector actors; (ii) how these partnership arrangements are emblematic of broader processes of state transformation that take shape within the complex governance practices surrounding domestic worker migration in Southeast Asia; (iii) how a focus on the micro-processes of domestic worker governance (that is, how migrant worker bodies are constructed and disciplined) also highlights the significance of private actors in this aspect of governance.  相似文献

The Bologna Process is an international policy project for the convergence of higher education structures in the European Higher Education Area. Most of the literature on Bologna represents studies that focus on the implementation implications of the reforms. The focus on the reform process, particularly in relation to the development process of Bologna policy actors, has been under-represented in the literature. This article investigates the process of the development of the main policy actors involved in the Bologna reform in the case of Ukraine. The timeframe includes the pre-history of Bologna since Ukrainian independence in 1991 until after the introduction of the relevant policy changes in 2003, and through to the issue of 2014 Law on Higher Education. Empirical data were collected through interviews with higher education actors in Ukraine and policy document search. Both types of data were thematically analyzed. The analysis in this article is informed by the policy learning theory and demonstrates the interconnection between path-dependency and change in the development of policy actors in the Bologna reform in Ukraine. This article shows that the old clusters of higher education actors, and the pre-Bologna relationships amongst some of them have been reproduced during the Bologna reform. At the same time, such a reproduction of the old during the reform was only partial as the Bologna Process has also been altering the relationships among some actors to an extent.  相似文献

随着政策问题复杂性和不确定性的提高,政策网络逐渐成为政策分析的主要范式,如何发展和完善政策网络理论也随之成为政策网络研究的重要主题。不同研究路径均尝试对政策网络理论的关键问题,即政策网络的产生、维持和变迁,政策网络和政策过程及其结果之间的关系,政策网络和政策变迁之间的关系等,进行解释和回应。尽管西方政策研究者通过政策网络类型学和行动者模型对政策网络理论进行了完善,但以上两种路径在对“结构与行动”“宏观与微观”问题的处理上存在明显二元对立的倾向,因而无法有效回应政策网络理论的关键问题。引入结构化理论之后,上述问题得到了较好解决,政策网络理论的适用性和解释力都大幅提高。  相似文献
